3. CHILDREN AND PARENTAL RESPONSIBILITIES

3.1 Los miembros de la pareja reconocen que la custodia, el régimen de visitas y los alimentos de los hijos de la relación se rigen por normas imperativas de protección del menor —en particular la Ley Orgánica 1/1996 de Protección Jurídica del Menor y la normativa de derecho de familia de la comunidad autónoma aplicable— y no pueden ser objeto de renuncia contractual en este Acuerdo. Los miembros de la pareja se comprometen a cooperar de buena fe en todas las cuestiones de responsabilidad parental en el interés superior de los hijos.

4. INHERITANCE RIGHTS

4.1 En las Comunidades de Derecho Común, el miembro de una pareja de hecho no tiene derechos sucesorios intestados automáticos. Se recomienda a cada miembro otorgar un testamento válido designando al otro miembro como heredero o legatario para garantizar la protección sucesoria. En las comunidades forales (Cataluña, Aragón, Navarra y otras), pueden aplicarse derechos sucesorios limitados a las parejas inscritas conforme al derecho sucesorio foral aplicable.

4.2 Para la pensión de viudedad de la Seguridad Social conforme a los artículos 220-223 de la LGSS, este Acuerdo y el certificado de inscripción constituyen documentación acreditativa esencial, sujeta a los requisitos de 2 años de inscripción y 5 años de convivencia previstos en el Real Decreto-Ley 9/2008.

5. GENERAL PROVISIONS

5.1 Este Acuerdo se rige por la normativa de [Autonomous Community] y, subsidiariamente, por el derecho civil español. Las controversias se someterán al Juzgado de Primera Instancia de la última residencia habitual común de los miembros de la pareja.

A De Facto Couple Agreement Spain (Acuerdo de Pareja de Hecho or Contrato de Convivencia) is a written agreement between two persons living together in a stable affective relationship (unión de hecho estable) without being married, regulating their property rights, financial obligations during cohabitation, and the consequences of separation.
