La presente solicitud se fundamenta en el Artículo 44 de la Constitución Política de Colombia, que consagra como derechos fundamentales de los niños, niñas y adolescentes el cuidado y el amor, la educación, la salud y la protección contra toda forma de abandono.

El Artículo 102 de la Ley 1098 de 2006 faculta a la Defensoría de Familia del ICBF y a la Comisaría de Familia para ordenar la guarda provisional cuando la persona o personas a cargo del menor sean incapaces de protegerlo, sin perjuicio de que el asunto sea remitido al Juez de Familia.

El Artículo 22 de la Ley 1098 de 2006 reconoce el derecho del menor a tener una familia y a no ser separado de ella, lo cual incluye el derecho a ser cuidado por parientes cercanos cuando los padres estén temporalmente impedidos.

What Is a Temporary Guardianship Application (ICBF) Colombia?

A Temporary Guardianship Application Colombia (Solicitud de Guarda Provisoria) is a formal petition directed to the Instituto Colombiano de Bienestar Familiar (ICBF) Defensoría de Familia or, where no ICBF Defensoría is present, to the Comisaría de Familia of the relevant municipality, requesting that a responsible adult relative or trusted third party be appointed as provisional guardian (guardador provisional) of a minor child whose parents are temporarily incapable of exercising parental authority (patria potestad) due to illness, incarceration, migration, incapacitation, or other compelling circumstances.
