What Is a Advance Healthcare Directive Colombia (Voluntad Anticipada)?

An Advance Directive (Directiva Anticipada de Voluntades) in Colombia is a legal document through which a competent adult expresses their wishes regarding medical treatment, end-of-life care, and life-sustaining procedures in the event that they become incapacitated and are unable to communicate their decisions. It may also designate a healthcare proxy (apoderado de salud) to make medical decisions on the person's behalf. In Colombia, advance directives are recognized by Resolution 2665 of 2018 of the Ministry of Health and Social Protection, which regulates the right to a dignified death and the withdrawal of disproportionate life-sustaining treatment (futile treatment, known as obstinación terapéutica in Spanish). The Constitutional Court has reinforced this right through its jurisprudence on personal autonomy and human dignity, notably in Sentences T-970 of 2014 and T-544 of 2017. The document allows the person to accept or reject specific treatments, request palliative care, donate organs, and establish any other preferences regarding their medical care when they cannot speak for themselves.

When Do You Need a Advance Healthcare Directive Colombia (Voluntad Anticipada)?

An Advance Directive in Colombia is advisable for any adult who wishes to ensure their medical preferences are respected if they become incapacitated. It is particularly important for: elderly persons who wish to document their end-of-life care preferences in advance; persons diagnosed with terminal illnesses or progressive degenerative conditions such as Alzheimer's, ALS, or advanced cancer; persons undergoing major elective surgery who wish to document their wishes in case of complications; persons with religious or ethical convictions about specific medical interventions (such as blood transfusions or certain surgical procedures); persons who wish to donate organs upon death; persons who want to formally designate a specific family member or friend as their healthcare proxy rather than leave the decision to the default legal next-of-kin; and any person who values personal autonomy and wishes to ensure their medical care aligns with their values and preferences even when they cannot express them.

What to Include in Your Advance Healthcare Directive Colombia (Voluntad Anticipada)

An Advance Directive in Colombia, to be legally effective and respected by healthcare providers, should include: complete identification of the declarant with ID number and date of birth; a statement of mental competence at the time of signing; specific directives about desired and unwanted medical treatments (CPR, mechanical ventilation, artificial nutrition, dialysis, antibiotics for terminal infections); preferences regarding palliative and comfort care; organ and tissue donation wishes; designation of a healthcare proxy with complete identification and contact information; specific instructions to the proxy regarding the scope of their decision-making authority; revocation conditions; signature of the declarant; signatures of two independent witnesses who are not family members or potential heirs; and ideally notarial certification to maximize legal force. The document should be registered with the treating physician, the primary hospital, and kept accessible by the designated proxy.
