What Is a Patent Registration Application SIC Colombia (Solicitud de Registro de Patente)?

A Patent Registration Application SIC Colombia (Solicitud de Registro de Patente ante la Superintendencia de Industria y Comercio) is the formal petition to Colombia's intellectual property authority to obtain exclusive rights over a new invention or utility model, granting the patent holder a temporary monopoly on the manufacture, use, sale, and importation of the patented technology within Colombian territory. Patent protection in Colombia is governed by Decisión 486 de 2000 of the Comunidad Andina de Naciones (CAN) — the same supranational regime that governs trademarks — which takes direct precedence over national law and creates harmonised patent protection across Bolivia, Colombia, Ecuador, and Peru. The Superintendencia de Industria y Comercio (SIC) is the competent authority for patent examination, grant, and post-grant proceedings.

Colombia recognises two main categories of patents under Decisión 486. Invention patents (patentes de invención) under Articles 14-45 protect novel, inventive, and industrially applicable inventions in all fields of technology — covering products, processes, methods, compositions of matter, and combinations thereof. To qualify, an invention must be new (novedad — not previously disclosed anywhere in the world), involve an inventive step (nivel inventivo — not obvious to a person skilled in the art), and be capable of industrial application (aplicación industrial — capable of being made or used in any kind of industry). Invention patents are granted for 20 years from the filing date, non-extendable, under Decisión 486 Article 50. Utility model patents (patentes de modelo de utilidad) under Articles 81-85 protect functional improvements to existing tools, devices, instruments, or mechanisms that provide practical utility advantages — a lower inventive threshold than invention patents. Utility models are protected for 10 years from the filing date.

Colombia has been a member of the Patent Cooperation Treaty (PCT) since its ratification through Ley 463 de 1998, allowing Colombian inventors to file international patent applications through WIPO designating Colombia and other PCT member countries simultaneously. The Colombian national phase of PCT applications is processed by the SIC as the designated office. Colombia is also party to the Paris Convention for the Protection of Industrial Property (Convenio de París), ratified through Law 178 de 1994, enabling priority claims from prior foreign patent applications within 12 months. Forms-legal.com provides a template to guide inventors and companies through the complex SIC application documentation requirements.

When Do You Need a Patent Registration Application SIC Colombia (Solicitud de Registro de Patente)?

A Patent Registration Application SIC Colombia becomes necessary whenever an inventor, research team, or company has developed a new technical solution — whether a product, process, method, or functional improvement — that meets the patentability criteria and for which exclusive market rights are commercially valuable. Filing urgency is created by the absolute novelty requirement of Decisión 486 Article 16: any prior public disclosure of the invention anywhere in the world — including scientific publications, conference presentations, trade show demonstrations, or commercial sales — destroys novelty and prevents patent protection, unless the disclosure was made by the inventor within the 12-month grace period (período de gracia) before the Colombian filing date under Decisión 486 Article 17.

Key situations requiring patent applications include: technology companies in Colombia's growing tech ecosystem (Medellín's Distrito de Innovación, Bogotá's Centro de Innovación) developing proprietary software-implemented inventions, hardware innovations, or telecommunications solutions; pharmaceutical and biotechnology companies conducting research under agreements with Colombian research institutions such as Minciencias through the National System of Science, Technology and Innovation (SNCCTI) framework; agricultural technology developers working with Colombia's biodiversity-rich environment under the Convention on Biological Diversity (CBD) — Colombia ratified the CBD and the Nagoya Protocol through Law 1159 de 2007 and must comply with access and benefit-sharing obligations when patenting inventions derived from Colombian genetic resources or traditional knowledge; and companies seeking to establish freedom to operate in Colombia by filing defensive patents.

Colombian universities and research institutes (Universidad Nacional de Colombia, Universidad de Antioquia, Universidad de los Andes, SENA's research divisions) are increasingly active patent filers under Minciencias programmes that incentivise technology transfer from public research to the private sector.

What to Include in Your Patent Registration Application SIC Colombia (Solicitud de Registro de Patente)

A complete Patent Registration Application SIC Colombia must include the following elements as required by Decisión 486 de 2000, the Patent Cooperation Treaty (PCT) for international applications, and the SIC's specific procedural requirements. The forms-legal.com template provides a framework for organising this complex documentation.

Request form (formulario de solicitud): The official SIC application form including: applicant name and NIT/identification; inventor name(s) and nationality; title of the invention in Spanish; type of patent (invention patent or utility model); priority claim details if applicable; and appointment of a registered Colombian industrial property agent (API) for foreign applicants.

Technical description (descripción técnica): The most critical element of the patent application — a complete, clear, and sufficiently detailed disclosure of the invention that allows a person skilled in the relevant technical field to reproduce the invention without undue experimentation (requisito de suficiencia descriptiva under Decisión 486 Article 28(b)). The description must include: the technical field, prior art (estado de la técnica), problem solved by the invention, detailed description of preferred embodiments, and industrial applicability.

Claims (reivindicaciones): The legal definition of the scope of patent protection. Claims must be clear, concise, and fully supported by the technical description (Decisión 486 Article 30). Independent claims define the broadest protection sought; dependent claims add specific features.

Abstract (resumen): A brief technical summary (maximum 150 words) of the disclosure, used for search and publication purposes only.

Drawings (dibujos): Where necessary to understand the invention — required for virtually all mechanical, electronic, chemical apparatus, and biological inventions. The SIC has specific format requirements for drawings (line thickness, numbering, sheet size A4, black ink on white background).

Biological resource disclosure: For inventions involving Colombian genetic resources or traditional knowledge, the applicant must provide evidence of prior informed consent (consentimiento previo informado) from the relevant Colombian authority (MADS — Ministerio de Ambiente y Desarrollo Sostenible) or indigenous community, and compliance with the Nagoya Protocol access and benefit-sharing requirements under Ley 1159 de 2007.
