IV. INSCRIPCIÓN EN EL REGISTRO AGRARIO NACIONAL

Las partes acuerdan presentar el presente instrumento ante la Delegación competente del Registro Agrario Nacional (RAN) del Estado de la República en que se ubica el ejido para su inscripción. La presente cesión surtirá plenos efectos frente al ejido y terceros a partir de la fecha de inscripción en el RAN. El cedente se obliga a entregar el certificado de derechos parcelarios original al cesionario en el mismo acto de firma, para su presentación ante el RAN.

Asimismo, las partes darán aviso al comisariado ejidal del ejido señalado en la Cláusula II, a fin de que actualice el padrón ejidal con la nueva titularidad de los derechos parcelarios conforme a los Artículos 33 al 37 de la Ley Agraria.

La presente cesión se rige por la Ley Agraria, el Reglamento del Registro Agrario Nacional, el Código Civil Federal aplicado supletoriamente y demás disposiciones agrarias aplicables de los Estados Unidos Mexicanos. What Is a Assignment of Ejido Use Rights Mexico (Cesión de Derechos Ejidales)?

An Assignment of Ejido Use Rights Mexico (Cesión de Derechos Ejidales) is a formal legal instrument by which an ejidatario (member of an ejido community holding certified parcel rights) transfers their individual parcel rights (derechos parcelarios ejidales) to another person — either another ejidatario of the same ejido, a poblador (non-ejidatario resident of the ejido), or in certain cases an outsider (avecindado) — in accordance with Article 80 of the Ley Agraria, the principal statute governing ejido property rights in Mexico, and without converting the parcel to dominio pleno (full private ownership).

Article 80 of the Ley Agraria establishes that ejidatarios may transfer their parcel rights (derechos parcelarios) to other ejido members, their spouses, or their descendants — in the case of cesión to ejido members, without restrictions on compensation. The cesión constitutes a transfer of the ejidatario's rights within the ejido tenure framework — the parcel remains registered in the Registro Agrario Nacional (RAN) as ejido land, the assignee (cesionario) becomes the new ejidatario with all associated rights and obligations under the Ley Agraria, and the transaction must be registered in the RAN to be effective against third parties and the ejido community.

The distinction between a cesión de derechos ejidales and a dominio pleno compraventa is fundamental: a cesión transfers ejido rights within the ejido framework — the land remains ejido land in the RAN, the assignee acquires the rights of an ejidatario (including cultivation rights, participation in the asamblea ejidal, and a proportionate share of the ejido's common lands or solares urbanos), and the transaction is subject to agrarian law restrictions on subsequent transfers. A dominio pleno conversion under Ley Agraria Articles 81–83, in contrast, removes the parcel from the ejido register entirely and converts it to ordinary private property in the RPP (Registro Público de la Propiedad) — creating a fundamentally different legal status.

Under Ley Agraria Article 80, the cesión of parcel rights requires the written consent of the ejidatario's spouse (cónyuge) or partner — a protection designed to preserve the family unit's access to the agricultural parcel that constitutes the ejidatario's primary economic asset. If the ejidatario is married under the sociedad conyugal (community property) regime under the applicable state civil code, the spouse's signature on the cesión instrument is mandatory. Failure to obtain spousal consent renders the cesión voidable.

The Procuraduría Agraria — the federal agency created by Ley Agraria Article 134 to protect ejidatarios' rights, administered under the Secretaría de Desarrollo Agrario, Territorial y Urbano (SEDATU) — plays a supervisory role in cesión transactions. Ejidatarios who lack legal representation may request the Procuraduría Agraria's assistance in reviewing cesión documents and in registering the transfer in the RAN. The Procuraduría Agraria's representation is particularly important for elderly ejidatarios or those with limited literacy who may not fully understand the implications of transferring their parcel rights.

The RAN registration of the cesión de derechos ejidales is mandatory for the transfer to be enforceable against the ejido community and third parties. The RAN issues a new certificado de derechos parcelarios in the name of the cesionario upon registration — this certificate constitutes the cesionario's official title to the ejido parcel rights and is the document required for subsequent transactions involving the parcel.

When Do You Need a Assignment of Ejido Use Rights Mexico (Cesión de Derechos Ejidales)?

A Cesión de Derechos Ejidales Mexico is required whenever an ejidatario wishes to transfer their parcel rights to another person within the ejido framework — without converting the parcel to dominio pleno — under Ley Agraria Article 80.

The cesión is required when an ejidatario is elderly or infirm and wishes to transfer their parcel to a family member (spouse, children, grandchildren) who will continue to work the land. This intra-family cesión is the most common use of the instrument and allows agricultural families to maintain continuity of the family's ejido holding across generations without going through the dominio pleno conversion process.

The document is needed when an ejidatario relocates permanently to an urban area and no longer cultivates their parcel — rather than allowing the parcel to be declared abandoned (terreno abandonado) and reassigned by the asamblea ejidal under Ley Agraria Article 42, the ejidatario may cedee their rights to another ejido member who will put the land to productive use. The cesión provides fair compensation to the departing ejidatario while ensuring agricultural continuity.

A cesión is required when an ejidatario in financial distress wishes to realise the value of their parcel rights through a transaction with another ejido member. While traditional ejido law prohibited sale of parcel rights, the 1992 Ley Agraria now permits cesión with compensation — the RAN registration of the transfer documents the consideration paid, which may affect the subsequent tax treatment of the transaction under the Ley del Impuesto sobre la Renta.

The instrument is needed when two ejidatarios wish to consolidate adjacent parcels — one ejidatario acquires the other's parcel rights through cesión to create a larger contiguous agricultural unit. Land consolidation (concentración parcelaria) improves agricultural efficiency and may qualify for SAGARPA (Secretaría de Agricultura y Desarrollo Rural) subsidy programs requiring minimum parcel sizes.

A cesión de derechos ejidales is also required as a preliminary step when an ejidatario who is not the original PROCEDE certificate holder — perhaps having inherited or informally acquired the parcel — needs to formalise their title before proceeding to a dominio pleno conversion under Ley Agraria Articles 81–83. The cesión regularises the ejidatario's standing in the RAN before the dominio pleno application can be filed.

What to Include in Your Assignment of Ejido Use Rights Mexico (Cesión de Derechos Ejidales)

A valid Cesión de Derechos Ejidales Mexico under Ley Agraria Article 80 and RAN registration requirements must include the following elements to be effective as a transfer of ejido parcel rights and registrable in the Registro Agrario Nacional.

Cedent Ejidatario Identification: Full legal name, CURP (Clave Única de Registro de Población), RFC (Registro Federal de Contribuyentes), and official identity document number (INE credential) of the ejidatario cedente (transferring party). The cedente must be the holder of the certificado de derechos parcelarios issued by RAN — the certificate number must be referenced in the cesión instrument.

Cesionario Identification: Full legal name, CURP, RFC, and official identity document of the cesionario (recipient of the parcel rights). Under Ley Agraria Article 80, the cesionario must be an ejidatario of the same ejido, a poblador, an avecindado, or a family member of the cedente — the cesionario's eligibility under the Ley Agraria must be confirmed before the RAN will register the transfer.

Spousal Consent: Written consent of the cedente's spouse or partner, with their full name, CURP, and identity document — required under Ley Agraria Article 80 to protect the family unit's right to the agricultural parcel. If the cedente is unmarried or widowed, a sworn declaration (declaración bajo protesta de decir verdad) to that effect should be included.

Parcel Identification: The RAN parcel number (número de parcela), the ejido name and municipality, the surface area in hectares expressed in numbers and words, the colindancias (boundary descriptions by cardinal direction naming adjacent parcels or landmarks), and the PROCEDE certificate number (if issued) uniquely identifying the specific parcel in the RAN registry.

Consideration or Gratuitousness: The agreed consideration (contraprestación) for the cesión — either a stated monetary amount in MXN or a declaration that the transfer is made as a donation (a título gratuito) without monetary consideration. For cesiones with monetary consideration, the RAN requires documentation of the agreed price, which triggers ISR considerations under LISR for the cedente.

RAN Registration Intent: An express statement that both parties agree to present the cesión instrument to the Registro Agrario Nacional (RAN) delegación competente in the state where the ejido is located for registration, and that the transfer is effective from the date of RAN registration rather than from the date of signing.

Ejido Notification: A statement that the ejido commissariat (comisariado ejidal) — the executive body of the ejido under Ley Agraria Articles 33–37 — will be notified of the cesión, consistent with the ejido's right to maintain updated membership records (padrón ejidal). Some ejidos require comisariado approval or at minimum notification before the cesión is registered.

Procuraduría Agraria Participation: Reference to whether the Procuraduría Agraria reviewed the cesión document or represented either party in the transaction — particularly important for elderly or vulnerable ejidatarios to demonstrate that the transaction was made with full informed consent and without coercion.

Obligations Transfer: A declaration that the cesionario assumes all rights and obligations of the ejidatario with respect to the parcel — including cultivation obligations, payment of any parcel-specific assessments to the ejido, and compliance with the ejido's internal reglamento (regulations) — from the date of RAN registration.
