What Is a AFORE Retirement Withdrawal Mexico (Solicitud de Pensión de Retiro AFORE)?

An AFORE Retirement Withdrawal Mexico (Solicitud de Pensión de Retiro AFORE) is the formal application document filed by a worker — or their authorized representative — with their Administradora de Fondos para el Retiro (AFORE) to initiate the disbursement of retirement savings accumulated in the cuenta individual (individual retirement account) under the Sistema de Ahorro para el Retiro (SAR). The legal framework governing the AFORE retirement system derives principally from the Ley del Sistema de Ahorro para el Retiro (Ley del SAR), published in the Diario Oficial de la Federación on 23 May 1996 and substantially amended multiple times, with Articles 37 through 40 establishing the conditions and procedures for retirement withdrawals, pension modalities, and fund portability. The Comisión Nacional del Sistema de Ahorro para el Retiro (CONSAR) — the regulatory and supervisory authority for all AFOREs created by Article 2 of the Ley del SAR — issues the operational rules (circulares CONSAR) that govern the technical procedures for filing withdrawal requests.

The AFORE system was introduced as part of Mexico's 1997 pension reform, which transformed the Instituto Mexicano del Seguro Social (IMSS) pension regime from a pay-as-you-go defined benefit system to a funded defined contribution system under the Ley del Seguro Social (LSS) published in the DOF on 21 December 1995. Workers who entered the formal labour market for the first time on or after 1 July 1997 (known as generación AFORE or generación 1997) retire exclusively under the new AFORE-based regime. Workers with IMSS registration before 1 July 1997 (generación transición) may choose between the old defined benefit regime (régimen de 1973 under the repealed LSS) and the AFORE system when they reach retirement age — a choice known as la selección del régimen.

Each worker registered with IMSS has a cuenta individual consisting of three sub-accounts: the subcuenta de retiro, cesantía en edad avanzada y vejez (RCV) — which receives employer contributions of 2% of Salario Diario Integrado (SDI), worker contributions of 1.125% SDI, and federal government contributions; the subcuenta de vivienda — which receives INFONAVIT contributions of 5% SDI managed by INFONAVIT rather than the AFORE; and the subcuenta de aportaciones voluntarias — which holds additional voluntary savings made by the worker or employer. The AFORE manages and invests these funds through Sociedades de Inversión Especializadas en Fondos para el Retiro (SIEFOREs), which invest in diversified portfolios regulated by CONSAR's investment regime rules, with different SIEFOREs assigned to workers based on age (SIEFOREs básicas 1 through 5, transitioning to generational SIEFOREs — SIEFOREs generacionales — after CONSAR's 2020 reform).

To qualify for retirement under the AFORE system, a worker must meet the requirements of LSS Articles 154 through 165. For vejez (old-age) pension, Article 162 LSS requires 1,250 weeks of IMSS contributions (approximately 25 years) and attainment of age 65. For cesantía en edad avanzada (early retirement due to unemployment), Article 154 LSS requires age 60, 1,250 weeks of contributions, and cessation of paid employment. Workers who do not meet the weeks requirement may still access their accumulated savings through a retiro programado (programmed withdrawal) or a lump-sum withdrawal (negativa de pensión) of their subcuenta RCV balance. The Ley del SAR Articles 37–40 set out the detailed mechanics of how these different pension modalities interact with the cuenta individual balance.

All requests to withdraw AFORE savings — whether as a pension, lump sum, partial withdrawal, or transfer to another AFORE — must be filed through the AFORE's authorized channels. The Solicitud de Pensión de Retiro AFORE is the primary document initiating the pension disbursement process and must include biometric verification, identity documentation, IMSS resolution (resolución de pensión), and beneficiary designations. CONSAR's Circular CONSAR 71-19 (updated 2022) governs the digital filing and authentication requirements for AFORE withdrawal requests.

When Do You Need a AFORE Retirement Withdrawal Mexico (Solicitud de Pensión de Retiro AFORE)?

A Solicitud de Pensión de Retiro AFORE Mexico is needed at the point when a worker meets the eligibility requirements under the Ley del Seguro Social and Ley del SAR to begin drawing retirement income from accumulated savings. Filing the request is the mandatory first procedural step — without a formal application, the AFORE cannot initiate the pension calculation, present options to the worker, or transfer funds to an insurance company (aseguradora) for a life annuity (renta vitalicia) purchase.

The withdrawal request is required when a worker reaches age 65 with 1,250 or more weeks of IMSS contributions (vejez) under LSS Article 162 and wishes to convert the cuenta individual balance into a retirement pension. At this stage, the AFORE is obligated under Ley del SAR Article 37 to present the worker with a comparison of all available pension modalities — renta vitalicia (life annuity purchased from an aseguradora authorized by the Comisión Nacional de Seguros y Fianzas — CNSF), retiro programado (phased withdrawal managed by the AFORE), and combinations — and to provide a calculation of the monthly benefit under each option using official mortality tables and technical interest rates established by CONSAR.

The request is also needed when a worker reaches age 60 and ceases employment (cesantía en edad avanzada under LSS Article 154) — retirement without reaching 65 requires the additional documentation of employment cessation. Workers who retire before 65 under this modality face an actuarially reduced benefit, and the AFORE must present the comparison table before any election is made.

For workers who do not have sufficient weeks to qualify for a pension (generación AFORE workers with fewer than 1,250 IMSS contribution weeks), the withdrawal request initiates the negativa de pensión procedure — the IMSS formally denies the pension and the worker may then withdraw the total accumulated subcuenta RCV balance as a lump sum. This lump-sum withdrawal request is governed by Ley del SAR Article 39 and requires an IMSS negativa de pensión resolution as a supporting document.

The withdrawal request is additionally required for partial early withdrawals authorized under specific circumstances: desempleo (unemployment withdrawal) after 46 days of continuous unemployment under Ley del SAR Article 35; matrimonio (marriage withdrawal — a one-time withdrawal of 30 days' minimum wage equivalent upon first marriage, available only to workers in the 1973 generación transición regime under LSS Article 168); and retiro de aportaciones voluntarias, which may be requested at any time under Ley del SAR Article 40 subject to ISR tax implications on earnings.

What to Include in Your AFORE Retirement Withdrawal Mexico (Solicitud de Pensión de Retiro AFORE)

A valid AFORE Retirement Withdrawal request under Ley del SAR arts. 37–40 and CONSAR's operational circulars must contain the following essential elements for the AFORE to process the application and present pension modality options to the worker.

Worker Identification: Full legal name, CURP (Clave Única de Registro de Población issued by RENAPO), NSS (Número de Seguridad Social assigned by IMSS), RFC (Registro Federal de Contribuyentes assigned by SAT), and official identity document (INE/IFE credential or valid passport with photograph). The NSS is the primary identifier linking the worker to the IMSS contribution history and to the cuenta individual in the AFORE system. CURP and RFC are required for tax withholding calculation — retirement income is subject to ISR withholding by the AFORE or aseguradora under LISR Articles 93 and 95.

IMSS Pension Resolution: For vejez and cesantía modalities, the worker must present the resolución de pensión issued by the IMSS after the pension application at the Unidad de Medicina Familiar (UMF) or Subdelegación IMSS competent for the worker's last registered employer. The IMSS resolution confirms eligibility, states the number of cotización weeks recognized, and specifies the Salario Base de Cotización (SBC) for benefit calculation. For negativa de pensión withdrawals, the IMSS issues a resolution denying the pension due to insufficient weeks.

Pension Modality Election: Under Ley del SAR Article 38, the worker must formally elect the pension modality after receiving the AFORE's comparative table (cédula de comparación) prepared in accordance with CONSAR Circular 71-19. Available modalities include: renta vitalicia — the worker transfers the entire cuenta individual balance to an aseguradora authorized by CNSF, which pays a guaranteed monthly income for life including survivor benefits (pensión de viudez y orfandad) under LSS; retiro programado — the AFORE retains the funds and pays monthly withdrawals calculated annually based on remaining balance and mortality tables, with the residual balance transferable to heirs upon death; and a mixed modality combining a partial annuity purchase with a programmed withdrawal supplement.

Beneficiary Designation: Designation of beneficiaries (designación de beneficiarios) entitled to receive the remaining cuenta individual balance or survivor pension upon the worker's death, in accordance with Ley del SAR Article 27. Legal beneficiaries include the spouse or concubine, minor children, and financially dependent parents. The AFORE requires official documentation of each beneficiary's identity (INE, birth certificate, marriage certificate) and their CURP.

Bank Account for Deposits: The worker's bank account number (CLABE interbancaria — 18-digit standardized code) at a Mexican banking institution (institución de crédito regulated by CNBV) for electronic transfer of pension payments or lump-sum withdrawals. Ley del SAR Article 40 requires that all disbursements be made by electronic transfer — cash withdrawals are not permitted.

Tax Declaration: Statement of whether the worker is registered in the SAT's RFC system and whether ISR withholding should apply. Retirement income from the AFORE subcuenta RCV is exempt from ISR up to fifteen times the general daily minimum wage under LISR Article 93 Section XIII — amounts above this threshold are subject to ISR withholding. Voluntary savings withdrawals (subcuenta de aportaciones voluntarias) are subject to different ISR treatment depending on whether contributions were pre-tax or post-tax.

Forms-legal.com provides this AFORE Retirement Withdrawal Mexico template as a drafting guide for the application. Workers are strongly advised to attend in person at their AFORE's service branch (ejecutivo de cuenta AFORE) and to consult with an authorized CONSAR-registered independent investment adviser (asesor en estrategias de retiro — AER) before electing a pension modality, as the choice between renta vitalicia and retiro programado has irreversible lifetime financial consequences. The CONSAR consumer portal at consar.gob.mx provides free pension modality comparison tools and a database of authorized AFOREs and aseguradoras.
