What Is a Employment Certificate Mexico (Constancia Laboral)?

An Employment Certificate Mexico (Constancia Laboral or Constancia de Empleo) is a formal written certification issued by an employer (patrón) confirming that a specific trabajador (worker) maintains an active employment relationship with the company, stating their job title (puesto), length of service (antigüedad), current salary, and registration status with the Instituto Mexicano del Seguro Social (IMSS). The Constancia Laboral is one of the most frequently requested employment documents in Mexico and is anchored in the documentation obligations established by the Ley Federal del Trabajo (LFT) — particularly Article 804 LFT, which requires employers to retain and produce employment records, and Article 132 Section VII LFT, which establishes the employer's duty to provide a written certification of the number of days worked and the wage earned when the worker requests it.

The constitutional foundation for this obligation lies in Article 123, Apartado A of the Constitución Política de los Estados Unidos Mexicanos of 5 February 1917, which enshrines the worker's right to full documentation of their employment relationship. The Secretaría del Trabajo y Previsión Social (STPS), through its Inspección del Trabajo, enforces the employer's documentation obligations — inspectors may demand production of constancias and related records during audits, and failure to comply exposes employers to sanctions under Articles 992 through 1002 LFT.

The Constancia de Empleo must be consistent with the worker's IMSS registration record. Under Article 15 of the Ley del Seguro Social (LSS, published in the Diario Oficial de la Federación on 21 December 1995), every employer must register workers with the IMSS before the first day of work, and the IMSS maintains a registry of all employer-worker relationships (movimientos afiliatorios) through the IMSS portal. The salary declared in the constancia must match or be consistent with the Salario Diario Integrado (SDI) reported to the IMSS for the worker, calculated under Article 84 LFT to include base salary plus proportional values of aguinaldo (Article 87 LFT), prima vacacional (Article 80 LFT), and other recurring benefits. Discrepancies between the constancia and IMSS records can trigger IMSS audits and SAT ISR withholding reviews.

The Constancia Laboral also interacts with the INFONAVIT credit system. Under Article 29 of the Ley del INFONAVIT, employers contribute 5% of each worker's SDI to the worker's individual housing subaccount (subcuenta de vivienda) managed through the Sistema de Ahorro para el Retiro (SAR/AFORE) overseen by CONSAR. When workers apply for INFONAVIT housing credits (créditos INFONAVIT), they must present a constancia confirming active employment and current salary as part of the INFONAVIT credit assessment process, alongside their IMSS point score (puntos INFONAVIT) and seniority record.

For ISR tax purposes, the constancia supports the employer's annual income tax certification obligations. Under Article 99 of the Ley del Impuesto sobre la Renta (LISR, published in the DOF on 11 December 2013), employers must provide workers with a constancia de percepciones y retenciones (Formulario 37 / CFDI de nómina) confirming total wages paid and ISR withheld during the fiscal year, enabling workers to file their declaración anual with the Servicio de Administración Tributaria (SAT) through the SAT portal. While this is a distinct document from the general Constancia Laboral, both are issued by the employer and rely on the same underlying payroll records.

The document also serves as the primary evidence of employment for purposes of the Ley Federal de los Trabajadores al Servicio del Estado (LFTSE, Apartado B of Article 123) and for workers in the public sector covered by the Servicio Profesional de Carrera regulated by the LSPCAPF. Public-sector workers who transfer between federal agencies or who apply for pensions through the Instituto de Seguridad y Servicios Sociales de los Trabajadores del Estado (ISSSTE) require constancias verifying their service history and salary at each prior posting. The ISSSTE administers a separate social security regime from IMSS, but the documentation standards for constancias are equivalent under both systems.

When Do You Need a Employment Certificate Mexico (Constancia Laboral)?

An Employment Certificate Mexico is needed across a wide range of administrative, financial, legal, and regulatory procedures that require documentary proof of active employment, salary, and seniority.

The constancia is most frequently requested by financial institutions when workers apply for personal loans (créditos personales), mortgage loans (créditos hipotecarios), car loans (créditos automotrices), or credit cards (tarjetas de crédito) from banks regulated by the Comisión Nacional Bancaria y de Valores (CNBV) under the Ley de Instituciones de Crédito (LIC). Retail banks including Banco Nacional de México (Banamex), Banco Bilbao Vizcaya Argentaria México (BBVA México), Santander México, and HSBC México, as well as Sofoles and Sofomes regulated by the CNBV, all require a constancia de empleo issued within 30 to 60 days of the application date as standard part of their credit assessment processes.

INFONAVIT housing credit applications are among the most common triggers for a constancia. Workers applying for a crédito INFONAVIT to purchase, build, expand, or renovate their home must present an employer-issued constancia confirming their current salary and employment status, alongside their accumulated INFONAVIT points and AFORE savings balance. Under the Ley del INFONAVIT and CONSAR regulations, all credit disbursements require verified current employment data.

The document is also required for immigration procedures. Foreign nationals residing in Mexico under a Tarjeta de Residencia Temporal con permiso para trabajar issued by the Instituto Nacional de Migración (INM) under the Ley de Migración must present proof of active employment when renewing their residence permit. The INM accepts employer-issued constancias confirming the worker's current salary and position as primary supporting documentation for permit renewals. Similarly, Mexican nationals applying for visas to foreign countries — particularly the United States visa (DS-160), Schengen area visas, and Canadian visas — must demonstrate stable employment, and consulates routinely accept the constancia laboral as evidence.

The constancia is needed for IMSS benefit processing. Workers claiming disability benefits (subsidio por incapacidad), maternity benefits (subsidio por maternidad under LSS Article 101), or occupational risk payments (prestaciones por riesgo de trabajo) must present documentary evidence of their active employment and salary to IMSS claims officers. The constancia provides the employer's official confirmation of employment status and SDI for benefit calculation purposes under the Ley del Seguro Social.

Pension and retirement procedures through IMSS (régimen RCV — Retiro, Cesantía en Edad Avanzada y Vejez) and ISSSTE also require constancias covering specific periods of employment, particularly where workers had multiple employers and need to consolidate their semanas cotizadas record for pension eligibility under LSS Article 154. Workers transitioning from private sector (IMSS) to public sector (ISSSTE) employment must document prior service history through constancias from each prior employer.

What to Include in Your Employment Certificate Mexico (Constancia Laboral)

A valid Employment Certificate Mexico under the Ley Federal del Trabajo must include the following elements to meet the requirements of financial institutions, IMSS, INFONAVIT, and government agencies.

Issuer Details: Full legal name (razón social) and RFC of the issuing company (patrón), its domicilio fiscal, IMSS employer registration number (registro patronal), and the name, job title, and direct contact details of the authorized signatory. The letter must be printed on official company letterhead (membrete) bearing the company's name, logo, RFC, and contact details. The signatory must have authority to represent the employer in personnel matters under Articles 11 and 12 LFT.

Worker Identification: Full legal name of the worker, their RFC (Registro Federal de Contribuyentes assigned by the SAT), CURP (Clave Única de Registro de Población issued by RENAPO), and IMSS Social Security Number (NSS — Número de Seguridad Social). The RFC and CURP are essential for cross-referencing with SAT payroll records and IMSS registration data respectively. Some institutions also require the worker's INE/IFE credential number for identity verification.

Employment Status and Start Date: A clear declaration that the worker is currently employed (actualmente labora) or, if applicable, the dates of the completed employment relationship. The start date (fecha de ingreso) must match the IMSS alta patronal record. For current employees, the date of issuance serves as the reference date for seniority calculation — institutions typically require a constancia issued within the last 30 to 90 days.

Job Title and Department: The worker's current puesto and the area or department (área o departamento) in which they perform their functions, consistent with the employment contract and the IMSS occupational classification. Some specialized applications — such as INFONAVIT housing credits — require specification of whether the worker is classified as base (permanent), confianza (managerial trust position), or sindicalizado (unionized) under the applicable contrato colectivo de trabajo.

Salary Information: The worker's current base salary (salario base) expressed as a daily, biweekly, or monthly figure in Mexican pesos (MXN), and the Salario Diario Integrado (SDI) calculated under Article 84 LFT. Financial institutions use the net monthly salary (salario neto mensual after ISR withholding and IMSS worker contributions) to calculate the debt-to-income ratio for credit assessment. INFONAVIT credit scoring requires the SDI. The constancia should clearly specify which salary figure is being reported.

IMSS Registration Confirmation: An explicit statement that the worker is registered and actively contributing to the IMSS social security system, with reference to the employer's registro patronal. This confirms that the employer is complying with Article 15 LSS and that the worker is entitled to IMSS healthcare, disability, and retirement benefits. For INFONAVIT applications, confirmation that the employer is making the 5% SDI housing fund contributions under Article 29 Ley del INFONAVIT should also be included.

Purpose Declaration (Optional but Recommended): A statement specifying the purpose for which the constancia is issued — for example, 'Se expide la presente para efectos de trámite de crédito bancario' or 'Para los fines que al interesado convengan.' Many financial institutions require this clause to ensure the document was prepared for the stated purpose.

Signature Block: Handwritten signature (firma autógrafa) of the authorized signatory, company seal (sello oficial), place (ciudad) and date of issuance in DD/MM/YYYY format, and a direct telephone number and email address where the prospective institution can verify the information. The Asociación de Bancos de México (ABM) recommends that credit-related constancias include verification contact details.

Forms-legal.com provides this Employment Certificate Mexico template as a starting point for generating constancias laborales. Each constancia should reflect current IMSS and SAT records, and companies with high volumes of constancia requests should designate an authorized HR officer as the point of contact for verification inquiries from banks, INFONAVIT, and government agencies.
