What Is a Workplace Accident Report Spain (Acta de Accidente Laboral)?

A Workplace Accident Report Spain (Acta de Accidente Laboral) is a formal written record prepared by an employer whenever an occupational accident — accidente de trabajo — occurs on company premises or in connection with the performance of work duties, as required under Article 23 of Ley 31/1995, de 8 de noviembre, de Prevención de Riesgos Laborales (LPRL). The Acta de Accidente Laboral captures the factual circumstances, causes, injuries sustained, witnesses, and immediate corrective measures following an occupational incident, serving simultaneously as an internal safety record and the evidentiary basis for official notifications to the Ministerio de Trabajo y Economía Social.

Spain's primary occupational health and safety statute — Ley 31/1995 de Prevención de Riesgos Laborales — imposes on every employer the duty to investigate all accidents and occupational diseases, document the findings, and notify the competent authority where required. Article 23 LPRL specifically mandates that employers maintain documentation on accident investigations and corrective measures taken. The obligation to report serious, very serious, or fatal accidents to the Inspección de Trabajo y Seguridad Social (ITSS) within 24 hours arises under Royal Decree 1299/2006 and the sistema Delt@ — the electronic portal managed by the Ministerio de Trabajo for all official workplace accident communications in Spain.

The concept of accidente de trabajo in Spain is defined under Article 156 of the Ley General de la Seguridad Social (Real Decreto Legislativo 8/2015, LGSS) as any bodily injury sustained by a worker as a consequence or on the occasion of the work performed. The definition extends to accidents occurring during the commute to and from the workplace (accidente in itinere) under Article 156.2.a LGSS, accidents occurring during union or representative functions, and occupational diseases contracted in the course of employment. This broad legal definition means that the Acta de Accidente Laboral may need to be prepared for incidents beyond the immediate physical workplace.

The Mutua Colaboradora con la Seguridad Social — a mutual insurance entity authorised by the Tesorería General de la Seguridad Social (TGSS) — handles medical treatment and economic benefits for workers affected by workplace accidents. Employers are legally required to affiliate with a Mutua or with the INSS (Instituto Nacional de la Seguridad Social) for contingencias profesionales coverage under Article 83 LGSS. The Acta de Accidente Laboral must be provided to the Mutua to initiate the worker's healthcare and temporary disability (incapacidad temporal — IT) benefits under Article 169 LGSS, which cover 75% of the regulatory base from the day after the accident.

The Comité de Seguridad y Salud — where obligatory under Article 38 LPRL in workplaces with 50 or more employees — must be informed of significant workplace accidents, and the Acta forms part of the documentation reviewed by this joint employer-worker body. The Delegados de Prevención (prevention delegates elected by workers under Article 35 LPRL) have the right to participate in accident investigations and must receive a copy of the Acta. Failure to properly document and notify workplace accidents constitutes a serious infraction under Article 12.3 of the Real Decreto Legislativo 5/2000 (Ley de Infracciones y Sanciones en el Orden Social — LISOS), sanctionable with fines between €2,046 and €40,985 depending on severity and company size.

When Do You Need a Workplace Accident Report Spain (Acta de Accidente Laboral)?

A Workplace Accident Report Spain must be prepared immediately — or within the shortest practicable time after the incident — whenever any of the following circumstances arise in connection with employment activities governed by Ley 31/1995 de Prevención de Riesgos Laborales.

The Acta is required whenever a worker sustains any bodily injury — however minor — in the course of or as a consequence of their work, whether on company premises, at a client site, during travel for work purposes, or on the commute to or from the workplace (accidente in itinere under Article 156.2.a LGSS). Even injuries that do not result in time off work (accidentes sin baja) require internal documentation, though the official Delt@ notification obligation applies specifically to accidents with medical leave (accidentes con baja).

The report is mandatory whenever a serious, very serious, or fatal workplace accident occurs — in these cases the employer must also notify the ITSS and the competent autonomous community labour authority within 24 hours under the Orden TAS/2926/2002. Collective accidents involving more than four workers simultaneously also trigger this expedited notification obligation regardless of injury severity.

An Acta de Accidente Laboral is needed whenever a near-miss incident (cuasi-accidente) occurs — an event that did not result in injury but had the potential to do so. Although near-miss reporting is not always legally mandated in the same way as injury reports, the LPRL's general prevention duty and the Plan de Prevención de Riesgos Laborales required under Article 16 LPRL make near-miss documentation a best practice recognised by the ITSS.

The report is required as part of the employer's obligations to the Mutua Colaboradora whenever a worker requires medical attention or temporary incapacity leave following a workplace accident, since the Mutua uses the Acta to determine whether the incident qualifies as accidente de trabajo under Article 156 LGSS and to initiate the appropriate economic benefit payments to the worker.

A Workplace Accident Report is also needed whenever the Comité de Seguridad y Salud or the Delegados de Prevención request an investigation of an incident, or whenever the ITSS conducts an inspection following an accident — inspectors routinely request the Acta as primary documentary evidence of the employer's compliance with Article 23 LPRL investigation and documentation obligations.

Under the Estatuto de los Trabajadores (ET) RDL 2/2015, Spanish employment law governs contracts, dismissals, and working conditions. The Tesorería General de la Seguridad Social (TGSS) administers social security contributions. The Servicio Público de Empleo Estatal (SEPE) manages unemployment benefits. The Inspección de Trabajo y Seguridad Social enforces labour compliance. The Juzgados de lo Social hear employment disputes under the Ley Reguladora de la Jurisdicción Social (Ley 36/2011).

What to Include in Your Workplace Accident Report Spain (Acta de Accidente Laboral)

A valid Workplace Accident Report Spain under Ley 31/1995 de Prevención de Riesgos Laborales and the reporting requirements of the sistema Delt@ must contain the following essential elements.

Employer Identification: Full company name, NIF/CIF, registered address, CNAE activity code, and the employer's Código de Cuenta de Cotización (CCC) with the Tesorería General de la Seguridad Social. The name and position of the person completing the report must also be stated, along with the applicable Mutua Colaboradora con la Seguridad Social or INSS entity covering contingencias profesionales.

Injured Worker Details: Full name, DNI/NIE, Número de Seguridad Social (NSS), job title, professional category, type of employment contract (indefinido, temporal, ETT), seniority in the company, and the worker's regular work location (centro de trabajo). For temporary agency workers (trabajadores de ETT), the name of the Empresa de Trabajo Temporal under Ley 14/1994 must be included alongside the user company's details.

Accident Date, Time and Location: Precise date and time of the accident, the exact location (specific workplace area, machinery, or external location), and whether the accident occurred during ordinary working hours, during overtime, or outside the workplace (accidente in itinere). The activity being performed at the time of the accident and the phase of the work task must be described in accordance with the Delt@ classification codes.

Description of the Accident: A factual, chronological narrative of the sequence of events leading to the accident — including the agent material (physical object, substance, or equipment involved), the type of contact or mode of injury (fall, struck by object, exposure to substance, repetitive strain, etc.) classified according to the Delt@ codes established in Orden TAS/2926/2002. The description must avoid speculation and focus on objectively verifiable facts.

Nature and Location of Injuries: Description of the bodily injury — type of lesion (fracture, laceration, contusion, burn, etc.) and the body part affected — classified using the ESAW (European Statistics on Accidents at Work) taxonomy adopted in Spain through the sistema Delt@. The medical diagnosis, if available from the Mutua or hospital at the time of reporting, must be referenced.

Immediate First Aid and Emergency Response: Actions taken immediately after the accident — first aid administered, emergency services called, worker transported to the Mutua's medical centre or hospital. The name of any first aid personnel who responded must be recorded, referencing the first aid obligations under Article 20 LPRL and the employer's emergency plan (plan de emergencia).

Witness Statements: Names, job titles, and contact details of any colleagues or other persons who witnessed the accident, together with a summary of each witness's account. Witness statements are critical evidence for the ITSS and for any subsequent social security or labour court proceedings before the Juzgado de lo Social.

Causal Analysis: Identification of immediate and underlying causes — unsafe conditions (condiciones inseguras) such as defective equipment, inadequate guarding, or absence of personal protective equipment (EPIs — Equipos de Protección Individual) required under Royal Decree 773/1997; and unsafe behaviours (actos inseguros) such as failure to follow safety procedures. The causal analysis informs corrective actions and documents compliance with Article 16.3 LPRL.

Corrective and Preventive Measures: Specific actions taken or planned to prevent recurrence — machinery repairs, procedural changes, additional EPI provision, worker retraining, or updates to the Plan de Prevención de Riesgos Laborales — with assigned responsible persons, deadlines, and verification mechanisms.
