What Is a Complaint for Land Invasion/Squatting Colombia (Denuncia por Invasión de Predio)?

A Property Invasion Complaint (Denuncia por Invasión de Predio) in Colombia is the formal legal mechanism through which a property owner or legitimate possessor reports to the competent authorities that a third party has occupied, seized, or encroached upon their real property without authorization. Property invasion is criminally sanctioned in Colombia under Article 263 of the Penal Code (Law 599 of 2000), which establishes imprisonment of two to seven years for whoever invades land or buildings owned by another. The complaint activates both criminal prosecution through the Fiscalía General de la Nación and civil remedies including possessory actions (acciones posesorias) before ordinary judges under Articles 972 and following of the Civil Procedure Code (Law 1564 of 2012, Código General del Proceso).

When Do You Need a Complaint for Land Invasion/Squatting Colombia (Denuncia por Invasión de Predio)?

A Property Invasion Complaint in Colombia must be filed urgently as soon as the unauthorized occupation is detected. Colombian law protects the possessor who acts promptly: possessory actions (acciones posesorias) to recover possession must be brought within one year of the date of dispossession. Beyond this period, the possessor must rely on ordinary property actions (acción reivindicatoria) which are more complex and time-consuming. The complaint is appropriate when: a third party has physically occupied all or part of the property without authorization; squatters have constructed structures on the land; neighbors have expanded their fences or walls into the complainant's property; or any person is conducting activities on the property without a valid title or lease agreement. Both urban and rural properties are protected, and the complaint can be filed regardless of whether the complainant holds title deed or possessory rights.

What to Include in Your Complaint for Land Invasion/Squatting Colombia (Denuncia por Invasión de Predio)

A Property Invasion Complaint in Colombia must contain: complete identification of the complainant with evidence of ownership or possession (title deed, tax receipts, cadastral certificate, lease agreement); detailed description and location of the invaded property with cadastral number (número catastral) and real estate registration number (matrícula inmobiliaria); identification of the invaders if known; date and manner of the invasion; description of any structures built or activities conducted by the invaders; evidence of prior peaceful possession by the complainant; photographs documenting the invasion; witness testimony if available; and explicit petition requesting eviction of the invaders, restoration of possession, and criminal prosecution under Article 263 of the Penal Code. The complaint can be filed with the Fiscalía General de la Nación (criminal track) or with the Municipal Inspector (inspector de policía) for immediate administrative eviction proceedings under Law 1801 of 2016 (Código Nacional de Seguridad y Convivencia Ciudadana).
