What Is a Military Will Colombia (Testamento Militar)?

A Military Will Colombia (Testamento Militar) is a privileged testamentary instrument recognized under Colombian law that permits active-duty military personnel, national police officers, and certain civilian personnel accompanying military forces in the field to execute a valid will in circumstances where access to a notario publico is impossible — specifically during active military campaigns, combat operations, or deployments in remote regions under military control. The testamento militar is one of the three privileged wills (testamentos privilegiados) recognized in the Codigo Civil colombiano (Ley 57 de 1887), alongside the maritime will (testamento maritimo) under CC Articles 1092-1095 and the verbal will (testamento verbal) under CC Articles 1096-1100.

The legal framework for the Colombian military will is established in Codigo Civil Articles 1085 through 1091. These provisions reflect the legislative recognition that military service — particularly in the context of Colombia's internal armed conflict and counter-narcotics operations conducted by the Fuerzas Militares de Colombia (Ejercito Nacional, Armada Nacional, Fuerza Aerea Colombiana) and the Policia Nacional — may place personnel in situations where death or incapacity is imminent and ordinary notarial formalities are inaccessible.

The Fuerzas Militares de Colombia are regulated under the Decreto Ley 1790 de 2000 (Estatuto del Personal de las Fuerzas Militares), which establishes the ranks, career structure, and official functions of military officers. The Policia Nacional operates under the Decreto Ley 1791 de 2000 (Estatuto del Personal de la Policia Nacional). The commanding officer (oficial al mando or jefe de cuerpo) who receives the military will must hold the rank of at least Captain (Capitan) in the Army or equivalent in the other branches, or their superior, to exercise the quasi-notarial function assigned to them under CC Article 1086.

Under CC Article 1085, the military will may be executed during: an actual or imminent armed engagement (combate o confrontacion armada); a military campaign (campaña militar) in the field away from populated centers where notaries operate; deployment in zones declared as public order disturbance areas (zonas de perturbacion del orden publico) under Decreto Legislativo of the executive under Constitution Article 213; or any other military operation in which the testator's unit is deployed in a location without access to notarial services. The Ministerio de Defensa Nacional and the Comandos de Fuerza of each branch determine which operations qualify as campaigns justifying military wills.

Civilian personnel accompanying military forces — including ICRC (International Committee of the Red Cross) representatives in authorized roles, civilian contractors providing logistics support, journalists with embedded status, and government officials on inspection missions — may also execute a military will under CC Article 1087 when they are present with the force in field conditions and cannot access notarial services. The Fiscalia General de la Nacion and the Procuraduria General have investigated cases where military wills were used to transfer property among military personnel, reinforcing the requirement that the instrument be used only in genuine campaign conditions.

The legal framework governing the Military Will Colombia (Testamento Militar) in Colombia draws on several key statutes and regulatory bodies. Under the Codigo Civil Articles 1008-1226, Colombian succession law applies the legitima system (forced heirship). The Decreto 960 de 1970 governs testamentary forms before Notaria. The Impuesto de Sucesiones applies to inheritances. The Juzgados de Familia have jurisdiction over succession disputes. The Codigo General del Proceso (CGP, Ley 1564 de 2012) governs succession proceedings. Parties executing a Military Will Colombia (Testamento Militar) in Colombia should confirm the document reflects current law, including any amendments enacted since the original drafting date. The Codigo Civil (CC) arts. 1085-1091; Decreto Ley 1790 de 2000 (Estatuto del Personal Militar); Ley 836 de 2003 (Reglamento del Regimen Disciplinario Militar) sets the foundational requirements.

When Do You Need a Military Will Colombia (Testamento Militar)?

A Military Will Colombia becomes necessary when a member of the Fuerzas Militares de Colombia or the Policia Nacional — or civilian personnel accompanying these forces — finds themselves in field conditions during an active military operation and cannot access a notario publico to execute an ordinary testamento abierto under Codigo Civil Article 1070.

The testamento militar is appropriate during active counter-insurgency operations conducted by the Ejercito Nacional against armed groups in remote jungle, mountain, or rural areas of departments such as Arauca, Caqueta, Guainia, Vichada, Nariño, Putumayo, and Norte de Santander — regions historically affected by the internal armed conflict where military units operate far from populated centers with notarial services.

The document is needed during counter-narcotics operations (operaciones antinarcoticos) conducted by the Policia Nacional's Direccion Antinarcoticos (DIRAN) and the Ejercito Nacional in coca-growing regions where military personnel face significant operational risks and may be deployed for extended periods without access to urban centers.

The military will is required during peacekeeping operations where Colombian military contingents are deployed internationally under United Nations mandates — for example, Colombian participation in MINUSTAH (Haiti) or other UN missions. Colombian military law extends the military will provisions to international deployments where the host nation's notarial system is unavailable or incompatible with Colombian legal requirements.

The document is appropriate when a military officer is injured in combat and is being transported to a field medical facility (hospital de campaña) or evacuated by helicopter to a military hospital, but wishes to make or update their testamentary dispositions before potentially fatal surgery or medical procedures. The urgency of the military medical situation justifies the privileged will format.

The testamento militar is needed when a police officer or military member is assigned to a protection mission in a rural or jungle area under a security convoy operation and is isolated from urban centers for extended periods — sometimes weeks or months — without realistic access to the nearest notary office, which may be hundreds of kilometers away over difficult terrain.

Parties in Colombia should prepare a Military Will Colombia (Testamento Militar) proactively rather than waiting for a dispute to arise. Courts interpret agreements based on the written terms rather than oral representations. Where the transaction involves regulated activities, prior approval from the relevant authority may be required before execution.

What to Include in Your Military Will Colombia (Testamento Militar)

A valid Military Will Colombia under Codigo Civil Articles 1085-1091 must satisfy specific formal requirements adapted to military field conditions.

Authorized Receiving Officer (Oficial Receptor): Under CC Article 1086, the military will must be received by an officer in the military hierarchy of the testator's unit. For Army (Ejercito Nacional) personnel, this is typically the commanding officer of the unit — a Captain (Capitan), Major (Mayor), Lieutenant Colonel (Teniente Coronel), or higher rank. For Navy (Armada Nacional) personnel at sea, the ship's commanding officer receives the will. For Air Force (Fuerza Aerea Colombiana) personnel, the base commander or mission commander receives the will. For Policia Nacional personnel, the commander of the operational unit acts as receiving officer. The receiving officer must not be a beneficiary named in the will.

Qualifying Military Circumstances (Circunstancias Militares Habilitantes): The will must be executed during an actual military campaign, armed engagement, or equivalent qualifying circumstance under CC Article 1085. The receiving officer should document in the will the specific operational circumstances justifying its use — the unit designation, operation name or code, geographic location, and the reason ordinary notarial access is unavailable.

Presence of Witnesses (Testigos): Under CC Article 1086, the military will requires two qualified witnesses (testigos habiles) who must be: present with the military unit; not beneficiaries under the will; not the receiving officer; and capable of serving as witnesses under CC Articles 1068-1069 (of full legal age, literate, sound mind). Witnesses are typically fellow soldiers or officers of the testator's unit, though civilian accompanying personnel may also serve as witnesses.

Declaration and Documentation (Declaracion y Documentacion): The testator must declare their testamentary wishes before the receiving officer and witnesses. The receiving officer records the complete declaration in the military unit's official operations log (libro de operaciones or bitacora de unidad) — the military equivalent of the notarial protocol. The entry must include: date, time, and location of execution (coordinates if in field); identification of the testator (rank, name, military service number, cedula); identification of the receiving officer and witnesses; and the complete text of testamentary dispositions, including the identity of beneficiaries and the specific assets or portions being bequeathed.

Signature Requirements (Firmas): The military will must be signed by the testator, the receiving officer, and the witnesses. If the testator is wounded and physically unable to sign, CC Article 1088 permits another person designated by the testator to sign on their behalf in the presence of the officer and witnesses, with notation of the reason for the testator's inability to sign personally.

Delivery to Civilian Authorities (Entrega a Autoridades Civiles): Under CC Article 1090, upon return from the campaign or upon cessation of hostilities, the commanding officer must transmit a certified copy of the military will to the nearest Notaria or Juzgado de Familia. The receiving officer must deliver the will within thirty days of the end of the campaign or armed engagement. If the testator has died in the field, the will must be transmitted immediately to the competent Juzgado de Familia for opening of the succession proceeding under CGP Articles 487-524, and the Ministerio de Defensa or Policia Nacional must notify the testator's next of kin.

Limited Validity Period (Vigencia): Under CC Article 1091, the military will expires if the testator survives for ninety days after returning to a location where ordinary testamentary formalities are accessible. Within those ninety days, the testator must execute an ordinary testamento abierto before a notario publico. This caducity rule confirms that military wills serve only as emergency instruments.

Forced Heirship Compliance: Like all Colombian wills, the military will must respect the asignaciones forzosas of CC Article 1226. Military personnel should be aware that members of the Fuerzas Militares killed in combat may also have rights under the military pension regime (Caja de Retiro de las Fuerzas Militares — CREMIL) and the Direccion de Sanidad Militar for health benefits, which are governed by specific military statutes separate from civil succession law.
