What Is a ARL Occupational Risk Affiliation Form Colombia?

The ARL Occupational Risk Affiliation Form Colombia (Formulario de Afiliación ARL) is the official document used to enroll a worker in the Sistema General de Riesgos Laborales (SGRL) through an Administradora de Riesgos Laborales (ARL), as mandated by Ley 1562 de 2012 and regulated in detail by the Decreto Único Reglamentario del Sector Trabajo — Decreto 1072 de 2015. The SGRL provides insurance coverage and preventive services for work-related accidents (accidentes de trabajo) and occupational diseases (enfermedades laborales) recognized in the Tabla de Enfermedades Laborales established by Decreto 1477 de 2014 issued by the Ministerio del Trabajo and the Ministerio de Salud y Protección Social.

Class I covers the lowest-risk activities (administrative, financial services) with a minimum contribution rate of 0.348% of the IBC, while Class V covers the highest-risk activities (mining, explosives handling, deep-sea diving) with a contribution rate of 8.7% of the IBC. The employer's contribution rate is determined by the assigned risk class — workers pay no portion of ARL contributions. Ley 1562 de 2012 expanded the definition of work accident (accidente de trabajo) in Article 3 to include accidents occurring during work travel (in itinere), accidents during recreational or sports activities organized or sponsored by the employer, and accidents during union activities conducted with the employer's authorization. Article 4 of Ley 1562 defines occupational disease as any disease contracted as a result of work-related factors, including diseases listed in Decreto 1477 de 2014 and diseases not listed but whose causal connection to work is proven by the worker through expert medical evidence.

Independent Contractor Conversion: When an independent contractor (contratista) is reclassified as a dependent worker following a labor inspection by the Ministerio del Trabajo or a judicial ruling by the Juzgado Laboral del Circuito recognizing a de facto employment relationship (contrato realidad under CST Article 23), the employer must retroactively affiliate the worker with the ARL and pay outstanding contributions plus late-payment interest.
