What Is a Work Permit Application for Foreign Worker Mexico (Solicitud de Permiso de Trabajo para Extranjero)?

A Work Permit Application for Foreign Worker Mexico (Solicitud de Permiso de Trabajo para Extranjero) is the formal application process through which a foreign national (extranjero) and their Mexican employer-sponsor initiate the administrative proceedings before the Instituto Nacional de Migración (INM) — the federal agency within the Secretaría de Gobernación (SEGOB) responsible for immigration control — to obtain immigration status authorizing paid employment in Mexico. The foundational legal framework governing foreign worker authorization in Mexico is the Ley de Migración (LM), published in the Diario Oficial de la Federación on 25 May 2011 and replacing the prior Ley General de Población as the primary immigration statute. Article 40 LM establishes that foreign nationals who enter Mexico and engage in paid activities must hold the immigration status appropriate to the activity, and Article 52 LM establishes the categories of immigration status available to foreign nationals, including Residente Temporal (temporary resident), Residente Temporal Estudiante (student temporary resident), and Residente Permanente (permanent resident) — with the Residente Temporal category being the primary vehicle for authorized foreign employment in Mexico.

The Ley de Migración is supplemented by the Reglamento de la Ley de Migración (RLM), published in the DOF on 28 September 2012, which provides detailed procedures for immigration applications, including the employer-sponsored work authorization process. The INM's operational procedures are further detailed in circulares and instructivos issued by the Comisionado del INM. The Ley sobre Refugiados, Protección Complementaria y Asilo Político governs asylum and refuge procedures separately from the LM work authorization framework.

Under the LM framework, a foreign national who wishes to work in Mexico must hold either a Tarjeta de Residente Temporal con autorización para trabajar (temporary resident card with work authorization, valid 1 to 4 years, renewable) or a Tarjeta de Residente Permanente (permanent resident card with unrestricted work rights). The Residente Temporal category is the standard path for employer-sponsored foreign workers. The work authorization is linked to a specific employer-offer (oferta de empleo) in most cases — the employer plays a central role in the application as the responsable (sponsor), accepting legal obligations toward the INM for the foreign worker's immigration compliance.

Mexico applies a national labor market test (análisis de mercado laboral) through the Secretaría del Trabajo y Previsión Social (STPS) for certain employer-sponsored work authorizations — specifically, the employer must demonstrate through a certificación de no existencia de trabajadores nacionales (CENTN) that no qualified Mexican national is available for the position before sponsoring a foreign worker, under Article 7 of the Ley Federal del Trabajo (LFT) which limits foreign workers to 10% of a company's total workforce in any category except specialized technical and management positions. However, for highly specialized, executive, and intracompany transfer positions, the LFT Article 7 quota and STPS analysis may not apply, and employers can proceed directly with the INM petition.

Upon obtaining the Residente Temporal with work authorization, the foreign worker must be registered with IMSS by the employer within the same timeframe as Mexican workers under LSS Article 15, and the employer must withhold ISR from the foreign worker's salary under LISR Article 1 (which taxes all Mexican-source income regardless of the recipient's nationality or residency status).

When Do You Need a Work Permit Application for Foreign Worker Mexico (Solicitud de Permiso de Trabajo para Extranjero)?

A Work Permit Application for Foreign Worker Mexico is needed in every case where a foreign national intends to receive remuneration for employment activities performed within Mexican territory, regardless of whether the employer is a Mexican entity or a foreign company with operations in Mexico. Mexican immigration law does not recognize an informal or de facto work authorization category — even short-term paid assignments require the appropriate immigration status.

The application is required when a foreign national has received a formal job offer (oferta de trabajo) from a Mexican-registered company and will be hired under a contrato individual de trabajo governed by the Ley Federal del Trabajo. The employer initiates the sponsorship process at the INM with the formal offer and supporting corporate documents before the foreign national's visa is issued.

Work authorization is needed for intracompany transfers — when a multinational corporation (empresa transnacional) transfers an employee from a foreign affiliate to its Mexican subsidiary or branch. These transfers qualify for the Residente Temporal intracompany category, and the relationship between the foreign company and the Mexican entity must be documented (ownership structure, affiliate relationship).

The application is required when a foreign national who previously held a Residente Temporal without work rights (such as a student or a family member of a main applicant) wishes to engage in paid employment — a category change (cambio de condición migratoria) before the INM is required to add work authorization.

Short-term business visitors (visitors conducting commercial activities without remuneration from a Mexican source) may operate under the Visitante sin permiso para realizar actividades remuneradas category for activities like business meetings, contract negotiations, and trade fairs. But as soon as a foreign national receives payment from a Mexican-registered entity for services performed in Mexico — even a single consulting invoice — work authorization is technically required under LM Article 40.

For professionals working under service contracts (contratos de prestación de servicios profesionales) rather than employment contracts — consultants, specialists, and technical advisers — the Residente Temporal con permiso para actividades lucrativas category under LM Article 52 Section II covers self-employed and independent professional activities and also requires INM authorization.

What to Include in Your Work Permit Application for Foreign Worker Mexico (Solicitud de Permiso de Trabajo para Extranjero)

A valid Work Permit Application for Foreign Worker Mexico under Ley de Migración arts. 40 and 52 and the RLM must contain the following essential elements for the INM to process the application and issue the Tarjeta de Residente Temporal con autorización para trabajar.

Foreign Worker Identification: Full legal name (as it appears in the foreign passport), passport number, country of issuance, date of birth, nationality, current immigration status in Mexico (if the worker is already in Mexico on another category), last entry stamp details, and current address in Mexico or abroad. A valid passport with at least 6 months of remaining validity beyond the requested residence period is required.

Employer Sponsor Identification: Full corporate name (razón social) of the Mexican-registered employer, RFC, Registro Público de Comercio inscription number, industry classification (actividad económica), and contact information of the designated HR representative or legal representative. The employer must have a valid IMSS employer registration number (registro patronal) and demonstrate active tax compliance status (situación fiscal vigente) through a current Opinión de Cumplimiento from the SAT. Companies with a history of immigration violations may be required to post a bond (garantía) with the INM.

Job Offer Documentation: A formal carta oferta de empleo (employment offer letter) signed by the employer's legal representative (with power of attorney from a Notario Público), specifying: the position title (puesto) and job functions (descripción de actividades); the agreed monthly salary in Mexican pesos (salario mensual); the proposed employment start date; the work location address; and whether the employment is on a temporary (tiempo determinado) or indefinite (tiempo indeterminado) basis. The salary must be competitive with market rates for the position — the INM may request evidence that the foreign worker's salary is not below the market level for Mexican nationals in equivalent positions.

Evidence of Foreign Worker Qualifications: Official certificates, diplomas, or university degrees (títulos universitarios) demonstrating the qualifications required for the offered position, with apostille (Apostilla de La Haya) certification if issued by a Hague Convention signatory country, or legalization by the Mexican consulate in the country of issuance. Professional degrees in regulated professions (medicina, derecho, ingeniería, arquitectura, contaduría) must also be validated (revalidación o reconocimiento de título) by the Secretaría de Educación Pública (SEP) for the foreign professional to practice that profession in Mexico.

LFT Article 7 Compliance Documentation: For positions subject to the 10% foreign worker workforce quota under LFT Article 7, evidence of the employer's total headcount and percentage of foreign workers currently employed. For specialist or management positions exempt from the STPS análisis de mercado laboral requirement, a technical justification explaining why the position requires specialized expertise not available in the Mexican labor market.

Visa Application (if filing from abroad): For foreign nationals outside Mexico, the employer's sponsorship documents are used by the foreign national to apply for a Visa de Residente Temporal at the Mexican Consulate in their country of residence. The consulate transmits the case to the INM for approval, and upon arrival in Mexico, the foreign national completes the trámite at the INM to obtain the Tarjeta de Residente Temporal within 30 calendar days under RLM Article 44.
