A Prenuptial Agreement establishing Community Property Mexico (Capitulaciones Matrimoniales bajo el Régimen de Sociedad Conyugal) is a formal notarial contract executed between two persons before their civil marriage (matrimonio civil) — or in some circumstances during the marriage — that establishes the matrimonial property regime (régimen patrimonial del matrimonio) governing ownership, administration, and dissolution of assets acquired by the spouses. The legal foundation is the Código Civil Federal (CCF) Articles 178 through 200, applicable in cases governed by federal law, with corresponding provisions in each state's Código Civil — for the Ciudad de México, the Código Civil para el Distrito Federal governs, while states such as Jalisco, Nuevo León, and Veracruz have their own civil codes with substantially similar provisions.

CCF Article 178 establishes that future spouses (futuros consortes) may stipulate their patrimonial conditions by means of capitulaciones matrimoniales (marriage contracts) before or after the marriage celebration — the most common choices being sociedad conyugal (community property) or separación de bienes (separate property). Under the sociedad conyugal regime, Article 183 CCF creates a community estate (patrimonio común) comprising all property and rights acquired by either spouse during the marriage through onerous title (título oneroso), such as purchase, employment income, or business activity — while property owned before marriage or acquired during marriage by gratuitous title (donación, herencia, or legado) remains the individual property (bien propio) of the acquiring spouse unless the parties expressly agree to include it in the community.

The sociedad conyugal generates a community interest (participación en la comunidad) for each spouse — typically equal shares (50/50), though Article 189 CCF allows the parties to agree on unequal proportions, provided neither party is left with less than 25% of the community assets. This proportionality protection distinguishes Mexican law from some civil law systems that allow unlimited waiver. The community property regime is the default regime under many state civil codes when spouses do not expressly stipulate otherwise before the Registro Civil officer (Oficial del Registro Civil) at the time of marriage — Article 178 CCF allows oral stipulation at the time of marriage registration if no prior written capitulaciones exist.

When Do You Need a Prenuptial Agreement — Community Property Mexico (Capitulaciones Matrimoniales — Sociedad Conyugal)?

Capitulaciones matrimoniales establishing sociedad conyugal in Mexico are needed whenever two persons planning to marry wish to expressly establish, customise, or document the community property regime that will govern their economic relationship during marriage. In many Mexican states, absence of express capitulaciones results in automatic application of sociedad conyugal as the default regime — but executing formal written capitulaciones is strongly advisable to define the scope of the community, administration rights, and dissolution procedures with legal certainty.

Administration of Community Assets (Administración del Patrimonio Común): Under CCF Article 191, administration of community assets may be joint (administración conjunta) or entrusted to one spouse (administración delegada).
