What Is a Elder Support Agreement Mexico (Convenio de Alimentos para Adulto Mayor)?

An Elder Support Agreement Mexico (Convenio de Alimentos para Adulto Mayor) is a formal written agreement documenting the obligation of one or more family members (deudores alimentarios) to provide financial and in-kind support to an elderly parent, grandparent, or other relative (acreedor alimentario adulto mayor) who requires assistance due to age, health condition, or economic need. The agreement is governed principally by the Código Civil Federal (CCF) Articles 301 through 323, which establish Mexico's comprehensive legal framework for the alimentary obligation (obligación alimentaria) — one of the most fundamental duties in Mexican family law.

CCF Article 301 establishes that the obligation to provide alimentos (support) is reciprocal (recíproca) — those who are obliged to give alimentos have the right to receive them in turn when they need it. Article 303 CCF establishes the hierarchy of alimentary obligations among family members: parents have the primary obligation to support their minor children, and adult children have the corresponding primary obligation to support their parents (padres) when they reach old age or become incapacitated. Article 305 CCF extends the obligation to grandparents (abuelos) when parents cannot meet the obligation, and to siblings (hermanos) in certain circumstances. Article 308 CCF defines alimentos broadly to include not only food (comida) but also shelter (habitación), clothing (vestido), medical and hospital care (atención médica y hospitalaria), transportation, and — for minor children — education. For elderly persons (adultos mayores), the concept of alimentos encompasses all care necessary for their dignified subsistence (subsistencia digna).

The Ley de los Derechos de las Personas Adultas Mayores (published 25 June 2002, amended multiple times), under the coordination of the Sistema Nacional para el Desarrollo Integral de la Familia (DIF) and the Instituto Nacional de las Personas Adultas Mayores (INAPAM), establishes additional protections for persons 60 years of age and older (adultos mayores), including the right to receive family support and the right not to be subjected to abandonment (abandono familiar). Article 5 of that law establishes that adultos mayores have the right to a life free of violence and to adequate support from their family members.

In practice, the Convenio de Alimentos para Adulto Mayor serves several critical functions: it quantifies and formalises the alimentary obligation so that the amount and modality of support are not subject to future dispute; it creates an enforceable title (título ejecutivo) — when ratified before a Notario Público or conciliation authority — that allows the elderly person or their legal representative to seek immediate judicial enforcement (ejecución inmediata) before the Juzgado de lo Familiar if family members fail to meet their obligations; and it allocates the obligation among multiple family members in a proportional and transparent manner.

The Código Civil Federal Article 311 establishes that the amount of alimentos must be proportional (proporcional) to the resources (posibilidades) of the person who gives them and to the necessities (necesidades) of the person who receives them — courts apply this proportionality standard when determining or modifying alimentary amounts in judicial proceedings before the Juzgado de lo Familiar. Mexican state civil codes largely parallel the CCF on alimentos, with some variations in procedural enforcement — the Código Civil para el Distrito Federal (now Ciudad de México) and state codes apply to domicile-based family relationships.

When Do You Need a Elder Support Agreement Mexico (Convenio de Alimentos para Adulto Mayor)?

A Convenio de Alimentos para Adulto Mayor Mexico is required or strongly advisable in the following family and legal situations.

Ageing parents with limited income: When parents reach retirement age and have insufficient pension (pensión del IMSS or ISSSTE) or savings to meet their living expenses, Article 303 CCF imposes the legal obligation on adult children to provide support. A written agreement documents the amount and method of contribution from each child, preventing disputes about who owes what.

Parents with serious health conditions: When an elderly parent requires ongoing medical care for chronic conditions such as diabetes, heart disease, dementia, or cancer — conditions prevalent in Mexico's ageing population — the cost of medicines, specialist consultations, and hospitalisation can exceed any pension income. The agreement allocates these costs among family members and documents the healthcare support obligation under the Ley General de Salud and IMSS coverage rules.

Preventing elder abandonment: Mexico's DIF system and INAPAM actively enforce the Ley de los Derechos de las Personas Adultas Mayores against adult children who abandon elderly parents. A written support agreement demonstrates family responsibility and can prevent DIF intervention proceedings (diligencias del DIF para protección del adulto mayor) and criminal complaints for abandonment of incapacitated persons under CCF Article 323 Quáter.

Family estate planning: When adult children are making decisions about inheritance, property management, or the elderly parent's housing, a formal support agreement documents the financial obligations alongside any property arrangements, ensuring clarity and preventing future legal disputes between siblings (hermanos) about who contributed to parental support.

Divorce and family restructuring: When elderly parents' support depends on a child who is going through divorce, business difficulties, or relocation, the support agreement provides a documented and judicially enforceable obligation that survives changes in the child's personal circumstances. The Juzgado de lo Familiar has jurisdiction to enforce or modify alimentary obligations under CCF Article 317 at any time based on changed circumstances.

Multiple siblings sharing responsibility: Families with several adult children often experience disputes about proportional contributions, especially when children have different income levels and their own households. A written Convenio de Alimentos establishes each sibling's share based on posibilidades económicas under CCF Article 311, references INPC adjustment clauses (Índice Nacional de Precios al Consumidor published by INEGI) for annual increases, and provides a mechanism for revision when any child's financial situation changes materially — avoiding costly Juzgado de lo Familiar proceedings to resolve sibling disagreements.

Long-term care and assisted living: When the family decides to place an elderly parent in a Casa de Día (day centre) or residencia geriátrica, the agreement documents which family members cover the monthly fees, INAPAM registration, medical insurance, and transportation costs, creating enforceable commitments that the facility and the elderly person can rely on.

What to Include in Your Elder Support Agreement Mexico (Convenio de Alimentos para Adulto Mayor)

A valid Elder Support Agreement Mexico under CCF Articles 301–323 and the Ley de los Derechos de las Personas Adultas Mayores must contain the following essential elements.

Identification of Parties: Full legal name, RFC, CURP, age, civil status, and domicile of the elderly person (acreedor alimentario — the beneficiary of the support obligation) and all family members assuming the support obligation (deudores alimentarios). The family relationship between each deudor alimentario and the acreedor must be stated (hijo/a, nieto/a, hermano/a, etc.) with references to birth certificates or other documentary proof of kinship.

Description of the Elderly Person's Needs: A detailed description of the acreedor alimentario's current living situation, health status, income (pension, savings, rental income), and specific needs for which support is required: food and household expenses (alimentación y gastos del hogar); housing (habitación — whether the acreedor lives in their own property, a family member's home, or a rented dwelling); medical care (atención médica — regular medicines, specialist consultations, hospitalisation costs); clothing and personal care; transportation; and any other dignified subsistence needs identified.

Monetary Support Amount and Distribution: The total monthly support amount (pensión alimenticia mensual) agreed, expressed in Mexican pesos (MXN), and the allocation among multiple deudores alimentarios — proportional to each family member's economic capacity (posibilidades económicas) under CCF Article 311. Payment method (bank transfer to the acreedor's account or to a designated family member's account, cash) and payment date must be specified. An annual INPC adjustment clause (cláusula de actualización conforme al INPC publicado por el INEGI) maintains the real value of the support amount over time.

In-Kind Support: Description of any non-monetary support — accommodation provided in a family member's home (habitación en especie), meals, transportation to medical appointments, and direct provision of medicines or medical supplies — with an estimated monetary equivalent for accountability purposes.

Medical Insurance and Emergency Care: Whether the deudores alimentarios will maintain the acreedor as a beneficiary (beneficiario) on their employer medical insurance (seguro médico del empleador) or seguro de gastos médicos mayores, or will provide direct payment for medical expenses. Allocation of emergency hospitalisation costs among family members. Reference to the acreedor's IMSS or ISSSTE pensioner medical entitlements and INAPAM card benefits that reduce the cost burden on family members.

Modification and Enforcement: CCF Article 317 allows either party to request judicial modification of the support amount when the deudor's economic circumstances or the acreedor's needs change materially. The agreement should state that it is subject to judicial revision and that either party may apply to the Juzgado de lo Familiar for enforcement or modification. If ratified before a Notario Público, the agreement constitutes a título ejecutivo (enforceable title) for direct judicial enforcement without prior lawsuit.

Duration and Review: The agreement should specify a review period — typically annual — at which the parties reassess the acreedor's needs and each deudor's economic capacity. The INPC adjustment clause (Índice Nacional de Precios al Consumidor published monthly by INEGI) ensures the monetary support amount maintains its real purchasing power without requiring renegotiation each year. Either party may apply to the Juzgado de lo Familiar for a judicial review (revisión judicial) of the support amount at any time when circumstances change materially under CCF Article 317 — including job loss, serious illness of a deudor, or significant improvement in the acreedor's own resources such as receipt of an inheritance or new pension benefits.

The obligation to provide alimentos to elderly parents under CCF Article 303 exists independently of any written agreement — a written convenio documents and quantifies an obligation that already exists by law. Consult a family law attorney (abogado de derecho familiar) or contact the INAPAM or DIF for additional guidance on elder support enforcement.
