What Is a Surgical Procedure Authorization Mexico (Carta de Consentimiento Informado Quirúrgico)?

A Surgical Procedure Authorization Mexico (Carta de Consentimiento Informado Quirúrgico or Autorización para Procedimiento Quirúrgico) is a medico-legal document through which a patient (paciente) or their legal representative (representante legal) provides written informed consent (consentimiento informado) to a surgeon and healthcare facility before undergoing a surgical procedure (procedimiento quirúrgico) — acknowledging that the patient has been fully informed of the nature, risks, benefits, alternatives, and consequences of the proposed surgery. In Mexico, the legal framework for medical informed consent is established primarily by the Ley General de Salud (LGS) Article 81, Norma Oficial Mexicana NOM-004-SSA3-2012 sobre el Expediente Clínico, and the Reglamento de la Ley General de Salud en Materia de Prestación de Servicios de Atención Médica.

The Ley General de Salud Article 81 establishes that medical or surgical procedures (procedimientos médicos o quirúrgicos) that may involve significant risk to the patient's life or health require the patient's written consent (consentimiento escrito) prior to performance — except in emergency situations (urgencias) where the patient's life is immediately at risk and the patient is unable to consent. Article 81 LGS further requires that the patient be fully informed about: the nature of the condition requiring surgery (diagnóstico); the proposed surgical procedure (procedimiento propuesto); the expected benefits (beneficios esperados); the significant risks (riesgos significativos); the available alternatives (alternativas terapéuticas); and the consequences of refusing the procedure (consecuencias de no aceptar). The attending surgeon (médico cirujano tratante) bears the professional responsibility for obtaining valid informed consent under Article 81 LGS.

Norma Oficial Mexicana NOM-004-SSA3-2012, Del Expediente Clínico, published in the DOF on 15 October 2012, establishes the mandatory standards for the preparation, content, and conservation of the clinical record (expediente clínico) in Mexico — including mandatory requirements for the Carta de Consentimiento Informado. NOM-004-SSA3-2012 Section 10.1.1 specifically requires that the carta de consentimiento informado for high-risk procedures (procedimientos de alto riesgo), including all surgical procedures, contain the date and hour, the name of the medical institution, the patient's full name, age, and sex, the diagnosis (diagnóstico), the proposed procedure, the name and signature of the treating physician, the name and signature of the patient or legal representative, and the name and signature of two witnesses.

The Comisión Federal para la Protección contra Riesgos Sanitarios (COFEPRIS), operating under the Secretaría de Salud and governed by the Ley Federal sobre Metrología y Normalización, supervises compliance with NOM-004-SSA3-2012 in both public and private healthcare facilities (establecimientos de atención médica). COFEPRIS verifies that private hospitals (hospitales privados), clinics (clínicas), and surgical centres (centros de cirugía) maintain proper informed consent records as part of regular facility inspections. The Comisión Nacional de Arbitraje Médico (CONAMED), established in 1996 under Decreto Presidencial, resolves medical malpractice disputes (controversias médicas) between patients and healthcare providers — improper or absent informed consent is one of the most common grounds for CONAMED complaints.

The Ley General de los Derechos de Niñas, Niños y Adolescentes (LGDNNA) and the Código Civil Federal govern consent for surgical procedures on minors — for patients under 18 years, informed consent must be provided by both parents (patria potestad) or the legal guardian (tutor), with assent (asentimiento) of the minor child sought whenever the child's age and maturity permit meaningful participation in the decision. For adult patients who lack legal capacity (incapacidad legal) due to cognitive impairment, the legal representative appointed by the Juzgado de lo Civil must provide substitute consent following the patient's best interests standard.

From a malpractice and liability perspective, Mexican healthcare law under the Código Civil Federal Articles 1910 through 1934 (responsabilidad civil extracontractual) and the Ley General de Salud establish physician liability for damages caused by failure to obtain informed consent — even where the surgery was technically performed correctly — since the patient's right to bodily autonomy and free health decision-making is a constitutionally protected fundamental right under Artículo 4 of the Constitución Política de los Estados Unidos Mexicanos.

When Do You Need a Surgical Procedure Authorization Mexico (Carta de Consentimiento Informado Quirúrgico)?

A Surgical Procedure Authorization Mexico is required before any surgical procedure (procedimiento quirúrgico) performed in a Mexican hospital, surgical centre, or clinic — whether under public health institutions (IMSS, ISSSTE, IMSS-Bienestar, Secretaría de Salud) or private healthcare facilities — in compliance with Ley General de Salud Article 81 and NOM-004-SSA3-2012.

The authorization is needed for all elective surgical procedures (cirugías electivas) — including orthopaedic surgery, laparoscopic procedures, cosmetic and reconstructive surgery (cirugía plástica y reconstructiva), ophthalmological surgery (LASIK, cataract surgery), gynaecological procedures, dental surgical procedures under general anaesthesia, and bariatric surgery. The hospital or clinic cannot legally proceed with elective surgery without a signed, NOM-004-compliant carta de consentimiento informado.

The document is required for emergency surgical procedures (cirugías de urgencia) whenever the patient has the capacity to consent — even in urgent circumstances, if the patient is conscious, oriented, and capable of understanding information, the LGS requires that informed consent be obtained before surgery begins. Only where obtaining consent is impossible due to the patient's unconscious or critically compromised state may surgery proceed under the emergency exception of LGS Article 81.

The form is necessary for surgical procedures performed on minor patients. The Instituto Mexicano del Seguro Social (IMSS), the Instituto de Seguridad y Servicios Sociales de los Trabajadores del Estado (ISSSTE), and private hospitals require both parents' or the legal guardian's written consent for all surgical procedures on minors under 18 years, with separate assent documentation for adolescents aged 12–17 years capable of understanding the procedure.

Under LGS art. 81, NOM-004-SSA3-2012, and CONAMED standards, any healthcare facility or surgeon who proceeds with a surgical procedure without a properly executed carta de consentimiento informado faces professional sanctions from the Dirección General de Calidad y Educación en Salud (DGCES), COFEPRIS facility licence revocation, and civil malpractice liability — making the surgical authorization an indispensable medico-legal document in every surgical context.

What to Include in Your Surgical Procedure Authorization Mexico (Carta de Consentimiento Informado Quirúrgico)

A valid Surgical Procedure Authorization Mexico under Ley General de Salud Article 81 and NOM-004-SSA3-2012 must contain the following mandatory elements to constitute valid informed consent:

Healthcare Facility Identification: Full name and official address of the hospital, clinic, or surgical centre (establecimiento de atención médica), the COFEPRIS operating licence number, and the facility's Clave Única de Establecimientos de Salud (CLUES) assigned by the Secretaría de Salud — required by NOM-004-SSA3-2012 for all clinical record documents.

Patient Identification: Full legal name, date of birth, age, sex, CURP, and official identity document (Credencial del INE or CURP card) of the patient. For minor patients: parent or guardian name, CURP, relationship to patient, and identity document. For patients with legal incapacity: legal guardian name, court appointment reference, and identity document.

Diagnosis and Clinical Indication: Written statement of the patient's diagnosis (diagnóstico) and the clinical indication (indicación clínica) for the proposed surgical procedure — the medical reason why surgery is recommended over non-surgical treatment alternatives.

Procedure Description: Plain-language description of the proposed surgical procedure (procedimiento quirúrgico propuesto) — what will be done, how it will be done, the expected duration, the type of anaesthesia (anestesia general, regional, o local) to be used, and where the procedure will take place (quirófano, sala de procedimientos).

Risks and Complications Disclosure: Specific disclosure of the significant risks (riesgos significativos) and potential complications (complicaciones potenciales) associated with the procedure — both procedure-specific risks and anaesthesia risks — expressed in language comprehensible to a layperson. NOM-004-SSA3-2012 requires that risks be disclosed honestly and completely, including the risk of death where applicable.

Alternatives to Surgery: Description of the available non-surgical alternatives (alternativas terapéuticas) and the consequences of refusing surgery (consecuencias de no aceptar el procedimiento) — enabling the patient to make a truly informed decision about whether to proceed.

Treating Physician and Witnesses: Printed name, professional licence number (cédula profesional), and signature of the treating surgeon (médico cirujano tratante) responsible for obtaining consent; printed name and signature of two witnesses (testigos) — typically a family member and a healthcare facility staff member, both unrelated to the treating team.

Forms-legal.com provides this Surgical Procedure Authorization Mexico template as a practical starting point. Healthcare facilities using this form must ensure it complies with their facility-specific COFEPRIS-approved protocols, the applicable NOM requirements, and the current jurisprudencia of CONAMED before implementing it in clinical practice. Complex or high-risk surgical procedures should use the specific informed consent protocols developed by the relevant medical specialty society (Colegio Mexicano de Ortopedia, Sociedad Mexicana de Cirugía General, etc.).
