LÍMITE DE DEDUCIBILIDAD ISR (ARTÍCULO 36 LISR):

El monto deducible para efectos del Impuesto sobre la Renta (ISR) por concepto de rentas del vehículo arrendado se limita a $285.00 MXN por día por vehículo, equivalente a [ISR Deductible Cap] mensual, conforme al Artículo 36 Fracción II de la Ley del Impuesto sobre la Renta. Cualquier renta que exceda dicho límite constituye un gasto no deducible para el ARRENDATARIO. El IVA acreditable se limita proporcionalmente al monto deducible conforme a las reglas de acreditamiento de LIVA.

RETENCIÓN DE ISR: El ARRENDATARIO (persona moral) retendrá el 10% de ISR sobre cada pago de renta conforme al Artículo 116 LISR y lo enterará al SAT a más tardar el día 17 del mes siguiente. El ARRENDADOR emitirá CFDI factura electrónica por cada pago, incluyendo el desglose de renta e IVA.

IV. USO DEL VEHÍCULO Y SEGURO

Uso Autorizado: [Permitted Use]. Queda expresamente prohibido: utilizar el vehículo como transporte de pasajeros mediante plataformas tecnológicas (Uber, DiDi u otras); subarrendar el vehículo; utilizarlo fuera del territorio nacional sin consentimiento escrito previo; modificar el vehículo; y utilizarlo para actividades ilícitas.

Seguro Obligatorio: [Insurance Requirement]. El ARRENDATARIO deberá mantener vigente la póliza de seguro durante toda la vigencia del contrato y proporcionar copia al ARRENDADOR al inicio y en cada renovación anual.

V. DEVOLUCIÓN DEL VEHÍCULO

Al término del contrato, el ARRENDATARIO devolverá el vehículo en las mismas condiciones en que lo recibió conforme al Acta de Entrega-Recepción, salvo el deterioro natural por uso normal (desgaste normal). Los daños más allá del desgaste normal serán liquidados por el ARRENDATARIO a precio de mercado de reparación en talleres autorizados. Se levantará el Acta de Devolución en presencia de ambas partes. El ARRENDADOR conserva la titularidad del vehículo en todo momento.

VI. LEY APLICABLE Y JURISDICCIÓN

Este contrato se rige por el Código Civil Federal, la Ley del Impuesto sobre la Renta (Artículo 36), la Ley del IVA, la Ley del Registro Público Vehicular (REPUVE), y demás disposiciones aplicables. Las controversias serán resueltas por el Juzgado Civil y Mercantil competente del domicilio fiscal del ARRENDATARIO.

What Is a Company Vehicle Lease Agreement Mexico?

A Company Vehicle Lease Agreement Mexico (Contrato de Arrendamiento de Vehículo de Empresa) is a legal contract under which an arrendador (lessor) grants an arrendatario empresa (business lessee — a persona moral or persona física with business activity) the right to use and enjoy a motor vehicle for commercial purposes during a specified term in exchange for periodic rental payments (rentas), governed by the Código Civil Federal (CCF) Article 2398 and subject to the deductibility limitations of the Ley del Impuesto sobre la Renta (LISR) Article 36.
