CLÁUSULA PRIMERA — CUENTA INDIVIDUAL Y SUBCUENTAS

La Administradora abre y administra la Cuenta Individual del trabajador, compuesta por las siguientes subcuentas conforme a la Ley SAR:

Subcuenta de Retiro, Cesantía en Edad Avanzada y Vejez (RCV): recibe aportaciones obligatorias del trabajador (1.125%), patrón (3.150%) y cuota social gubernamental variable.

Subcuenta de Vivienda (INFONAVIT/FOVISSSTE): administrada en coordinación con INFONAVIT o FOVISSSTE, correspondiente al 5% del salario base aportado por el patrón.

3.

Subcuenta de Aportaciones Voluntarias: [Voluntary Contribution Type], monto mensual: [Voluntary Amount].

CLÁUSULA SEGUNDA — FONDO DE INVERSIÓN (SIEFORE)

Los recursos de la Subcuenta RCV serán invertidos en [SIEFORE Assignment], conforme a la Disposición CONSAR 15-19 y al perfil de riesgo generacional del trabajador. La AFORE aplica una comisión anual sobre saldo de [Commission Rate].

La AFORE publicará mensualmente el Indicador de Rendimiento Neto (IRN) en el portal de CONSAR (www.consar.gob.mx), permitiendo al trabajador comparar el desempeño de la administradora.

CLÁUSULA TERCERA — DERECHOS DEL TRABAJADOR

Conforme a la Ley SAR Artículos 18 a 24, el trabajador tiene derecho a:

a)

Traspasar su cuenta individual a otra AFORE, sin costo, después de 1 año de permanencia mínima (Artículo 20 Ley SAR).

b)

Recibir estados de cuenta trimestrales y proyección de retiro anual conforme a Circular CONSAR 01-22.

c)

Realizar retiros parciales por desempleo (hasta 90 días de salario tras 45 días sin empleo) y por matrimonio.

d)

Presentar quejas ante la UNE de la AFORE y, en segunda instancia, ante CONSAR (800-500-0747).

CLÁUSULA CUARTA — DESIGNACIÓN DE BENEFICIARIOS

El trabajador designa como beneficiarios de su Cuenta Individual conforme al Artículo 79 Ley SAR:

What Is a AFORE Fund Management Contract Mexico?

An AFORE Fund Management Contract Mexico is the foundational legal agreement between a registered worker (trabajador afiliado) and an Administradora de Fondos para el Retiro (AFORE) — a specialised private financial institution authorised by the Comisión Nacional del Sistema de Ahorro para el Retiro (CONSAR) to administer mandatory individual retirement savings accounts (cuentas individuales de retiro) under Mexico's defined-contribution pension system, established by the Ley del Sistema de Ahorro para el Retiro (Ley SAR), published in the Diario Oficial de la Federación on 23 May 1996 and in force since 1 July 1997.

The Ley SAR Articles 18 through 24 define the rights and obligations of both the AFORE (administradora) and the worker (trabajador/afiliado) within the contractual relationship governing the cuenta individual. Article 18 Ley SAR establishes that every worker subject to the IMSS (Instituto Mexicano del Seguro Social) pension regime under the 1997 Ley del Seguro Social, or the ISSSTE (Instituto de Seguridad y Servicios Sociales de los Trabajadores del Estado) regime under the Ley del ISSSTE, must have a cuenta individual held by one AFORE of their choice. Article 20 Ley SAR grants the worker the unilateral right to transfer (traspasar) their account from one AFORE to another without charge, subject to a minimum one-year waiting period between transfers.

The cuenta individual managed under an AFORE contract consists of three principal sub-accounts (subcuentas): the Subcuenta de Retiro, Cesantía en Edad Avanzada y Vejez (RCV), which receives mandatory contributions from the worker (1% of base salary), the employer (3.150% of base salary), and the federal government (cuota social); the Subcuenta de Vivienda (SHF/INFONAVIT), which receives the employer's mandatory 5% housing fund contribution administered separately by INFONAVIT or FOVISSSTE; and the Subcuenta de Aportaciones Voluntarias, which allows additional voluntary contributions by the worker and employer beyond the statutory minimums, with special tax treatment under LISR Articles 151 and 152 as deducible personal deductions (deducciones personales) up to 10% of gross income or five times the annual value of the Unidad de Medida y Actualización (UMA).

AFOREs invest the accumulated funds through Sociedades de Inversión Especializadas en Fondos para el Retiro (SIEFOREs) — specialised investment funds regulated by CONSAR and Banco de México through the Circular CONSAR 15-19 investment regime. SIEFOREs are classified by worker age cohort (generacionales) into five funds (Básicos 0 through 4), with Básico 4 (for workers under 36 years old) having the highest equity allocation and Básico 0 (for workers over 60) having the most conservative fixed-income allocation. CONSAR monitors AFORE investment returns through the indicador de rendimiento neto (IRN), published on its website, allowing workers to compare AFORE performance before choosing or transferring.

The AFORE contract also governs the conditions for withdrawal (retiro) of accumulated funds upon retirement (jubilación), permanent disability (invalidez), death (fallecimiento), or unemployment (desempleo), as established by Ley SAR Articles 68 through 85. Upon reaching retirement age and qualifying under the IMSS or ISSSTE pension eligibility rules, the worker may choose to receive the accumulated balance as a monthly annuity (renta vitalicia) through a licensed insurance company (aseguradora) or as programmed withdrawals (retiros programados) directly from the AFORE. CONSAR's Sistema Único de Registro de Trabajadores (SUR) maintains the official record of all AFORE affiliations and transfers throughout Mexico's pension system.

When Do You Need a AFORE Fund Management Contract Mexico?

An AFORE Fund Management Contract Mexico is needed whenever a Mexican worker seeks to formally affiliate with an AFORE of their choice, transfer from one AFORE to another, or document the terms governing their existing individual retirement account within the Sistema de Ahorro para el Retiro.

The contract is required when a worker newly entering the formal labour market in Mexico — whether as an employee (trabajador subordinado) subject to IMSS affiliation under Ley del Seguro Social Article 12, or as a public sector employee subject to ISSSTE affiliation — chooses a specific AFORE to manage their mandatory contributions. Workers who fail to choose an AFORE within their first 90 days of employment are automatically assigned to an AFORE through CONSAR's asignación system under Ley SAR Article 76 bis, based on the AFORE's highest net return indicator (IRN) for the worker's age cohort.

The contract documentation is essential when a worker exercises the traspaso (transfer) right under Ley SAR Article 20 to move their accumulated balance from one AFORE to another. The worker must sign a new contract with the receiving AFORE, which then initiates the formal transfer process through CONSAR's Sistema de Transferencias y Retiros (STAR). CONSAR regulations require that the AFORE provide the worker with a pre-transfer disclosure statement (estado de cuenta proyectado) showing the estimated retirement balance under the current vs. proposed AFORE, based on a standardised 30-year projection model.

These voluntary contributions qualify as personal deductions (deducciones personales) under LISR Article 151 Section V, reducing the worker's ISR liability, but only if made to a CONSAR-registered AFORE and properly documented in the tax year's SAT annual return.

Under Ley SAR Articles 18–24, CONSAR Circular 01-22, and Ley del Seguro Social Articles 159–168, every AFORE must provide affiliated workers with quarterly account statements (estados de cuenta trimestrales), an annual projected retirement calculation, and access to their account information through CONSAR's portal web (www.consar.gob.mx) and the AFORE's own digital platform.

What to Include in Your AFORE Fund Management Contract Mexico

A valid AFORE Fund Management Contract Mexico under Ley SAR Articles 18–24 and CONSAR regulatory requirements must include the following essential elements:

Worker Identification and CURP: The full name, CURP (Clave Única de Registro de Población), NSS (Número de Seguro Social assigned by IMSS), RFC (Registro Federal de Contribuyentes), and date of birth of the affiliated worker (trabajador afiliado). The CURP is the primary identifier in the SAR system under RENAPO registration. As of 2025, authorised AFOREs include AFORE SURA, AFORE Citibanamex, AFORE XXI Banorte, AFORE Profuturo, AFORE Principal, AFORE Coppel, AFORE Invercap, and AFORE Inbursa, among others.

SIEFORE Selection (Fondo Generacional): The assignment of the worker to the appropriate SIEFORE Básico (Básico 0 through 4) based on their birth year, pursuant to CONSAR's generational fund structure established by Disposición 15-19. The contract must specify which SIEFORE manages the worker's RCV sub-account balance and the investment policy of that fund, including the permissible asset classes (renta variable nacional e internacional, deuda gubernamental, deuda corporativa, materias primas, FIBRAS, REITs) and the maximum exposure limits for each.

Commission Rate (Comisión sobre Flujo): The AFORE's applicable commission rate (comisión), which under the Ley SAR reform of 2020 is charged exclusively on the accumulated balance (saldo) rather than on cash flows — expressed as an annual percentage of managed assets. CONSAR publishes a comparative commission table for all AFOREs on its website, and the contract must state the specific rate applicable to the worker's account. Commission rates for 2025 range from approximately 0.57% to 0.92% annually depending on the AFORE.

Contribution Structure (Estructura de Aportaciones): A clear statement of the mandatory contribution percentages for each sub-account: RCV sub-account (worker: 1.125%, employer: 3.150%, federal government: cuota social variable); Vivienda sub-account (employer: 5% via INFONAVIT); and the framework for voluntary contributions. The contract must disclose the total integrated contribution rate under Ley del Seguro Social Articles 168 and 168 bis.
