What Is a Union Leave Application Mexico (Solicitud de Licencia Sindical)?

A Union Leave Application Mexico (Solicitud de Licencia Sindical) is a formal written request submitted by a union official, representative, or delegate (dirigente o representante sindical) to their employer seeking paid or unpaid leave from their regular duties to perform union-related activities (actividades sindicales). The document is grounded in Article 132, Fracción X of the Ley Federal del Trabajo (LFT), which obligates employers to permit workers who are union representatives or officials to perform union functions during working hours, and in the broader framework of freedom of association (libertad sindical) protected by Article 123, Apartado A, Fracción XVI of the Constitución Política de los Estados Unidos Mexicanos of 5 February 1917.

A Union Leave Application Mexico is needed whenever a worker who holds a recognized union position — whether as a member of the union's comité ejecutivo (executive committee), as a delegado sindical (shop steward or delegate), as a union representative (representante sindical) in a specific department or shift, or as a member of a union commission (comisión sindical, comisión mixta, or comisión de seguridad e higiene) — requests time away from their assigned job duties to perform union-related activities during the employer's working hours.

The application is needed when a union official must attend collective bargaining negotiations (negociaciones del contrato colectivo de trabajo) with the employer's management. Under Articles 387 and 388 LFT, both parties to a CCT are obligated to participate in good faith in the collective bargaining process — employers must allow union negotiators sufficient time away from their regular duties to participate in these sessions, and the Solicitud de Licencia Sindical is the mechanism for formally requesting and documenting that time.

Since the 2019 reforma laboral, all unions must be registered with the CFCRL, which maintains a public registry of all unions and their CCTs. Union registration numbers should be verifiable on the CFCRL public registry portal (cfcrl.gob.mx). Employer Identification: Full legal name or business name (razón social) of the employer (patrón), RFC, Registro Patronal IMSS, and the name and title of the HR manager or director (gerente o director de Recursos Humanos) to whom the application is addressed. The application should reference the applicable CCT by its CFCRL registration number and revision date, since the CCT typically governs the specific conditions (duration, compensation, advance notice requirements) for union leave.

Advance notice requirements — typically 24 to 72 hours under applicable CCTs — must be respected. Emergency union leave (licencia sindical de urgencia) for unexpected events such as a sudden wildcat strike or emergency assembly may be requested with shorter notice, but this should be acknowledged in the request.

Compensation During Leave: Explicit statement of whether the leave is requested as paid union leave (licencia sindical con goce de sueldo) under the applicable CCT provision, or unpaid leave (licencia sindical sin goce de sueldo). The CCT registered with the CFCRL typically specifies the number of paid union leave hours per week or month that the employer must grant to recognized union representatives — common arrangements in Mexican CCTs include 8 to 40 hours of paid union leave per week for the Secretario General and 4 to 20 hours for other executive committee members.
