IV. SEGURIDAD E HIGIENE — OBLIGACIONES ESPECIALES

V. PRESTACIONES MÍNIMAS DE LEY

a) Aguinaldo: Mínimo 15 días de salario, pagadero antes del 20 de diciembre (Artículo 87 LFT).

b) Vacaciones: Mínimo 12 días hábiles por el primer año, aumentando 2 días por año adicional (Artículo 76 LFT, reforma 2022).

c) Prima Vacacional: 25% sobre el salario de los días de vacaciones (Artículo 80 LFT).

d) PTU: 10% de las utilidades fiscales anuales, distribuido dentro de los 60 días siguientes a la presentación de la declaración anual ISR (Artículos 117–131 LFT).

e) IMSS: Alta patronal antes del inicio de labores conforme al Artículo 15 LSS, bajo la clase de riesgo de trabajo correspondiente.

El presente contrato se rige por la Ley Federal del Trabajo (en especial los Artículos 343-A al 343-I), la Ley Minera, la Ley del Seguro Social, y las Normas Oficiales Mexicanas aplicables al sector minero. Las controversias se someterán a conciliación ante el Centro Federal de Conciliación y Registro Laboral (CFCRL) conforme al Artículo 684-A LFT, y en caso de no resolverse, al Tribunal Laboral competente.

What Is a Mining Worker Contract Mexico (Contrato de Trabajo Minero)?

A Mining Worker Contract Mexico (Contrato de Trabajo Minero) is a written employment agreement between a mining company (empresa minera) and a worker engaged in mineral extraction, underground operations, surface mining, or metallurgical processing — governed by Chapter XIII Bis of the Ley Federal del Trabajo, comprising Articles 343-A through 343-I, added by the Decreto published in the Diario Oficial de la Federación on 30 November 2012. This chapter establishes a special labour regime for the mining and extractive industries, recognizing the exceptional hazards of underground and surface mining operations and imposing heightened employer obligations for safety, health monitoring, accident prevention, and worker protection.

Mexico is one of the world's leading mining nations — ranked among the top global producers of silver (first), fluorite (first), bismuth (second), and significant producer of gold, copper, zinc, lead, and iron ore. The mining sector employs approximately 380,000 direct workers across states including Sonora, Zacatecas, Chihuahua, Durango, Coahuila, and San Luis Potosí, organized primarily under the Sindicato Nacional de Trabajadores Mineros, Metalúrgicos, Siderúrgicos y Similares de la República Mexicana (Sindicato Minero), one of Mexico's most powerful sectoral unions with collective bargaining agreements (contratos colectivos de trabajo) covering the majority of formal mining enterprises.

Article 343-A LFT defines the scope of the special regime: it applies to workers employed in mining (minería), metallurgy (metalurgia), and smelting (fundición) operations involving underground extraction, open-pit surface extraction (tajo abierto), or industrial processing of extracted minerals. Article 343-B LFT requires mining employers to maintain a complete and updated personnel register (padrón de trabajadores) with each worker's RFC, CURP, NSS, blood type, emergency contact, and medical history relevant to occupational exposure.

Article 343-C LFT establishes the employer's obligation to provide adequate personal protective equipment (equipo de protección personal — EPP) at no cost to the worker, including respiratory protection, hard hats (cascos de seguridad), steel-toed footwear, and specialized equipment appropriate to the specific mining operation. This obligation extends to ensuring that EPP meets the standards established by Normas Oficiales Mexicanas issued by the STPS — particularly NOM-023-STPS-2012 (underground and surface mining safety conditions) and NOM-032-STPS-2008 (safety in underground coal mining operations).

Article 343-D LFT mandates that mining employers conduct medical examinations (exámenes médicos) for all workers before hiring (examen preempleo), annually during the employment relationship (examen periódico), and at the termination of the employment relationship (examen de egreso). These examinations must be performed by an authorized occupational physician (médico del trabajo) and the results recorded in the worker's expediente médico — a file that the employer must maintain for at least 30 years after the employment ends given the long latency periods of occupational diseases prevalent in mining, including silicosis, pneumoconiosis, and hearing loss from prolonged noise exposure.

Article 343-E LFT requires mining companies to have a Comisión Mixta de Seguridad e Higiene (joint safety and health committee) composed of equal numbers of employer and worker representatives under Articles 509 and 510 LFT, responsible for inspecting workplaces, investigating accidents, and proposing preventive measures. The committee must meet at least once per month and its minutes must be filed with the STPS Inspección del Trabajo.

Article 343-F LFT creates a special obligation for mining employers related to accidents and emergencies: they must have emergency action plans (planes de acción de emergencia), rescue teams (brigadas de rescate), first aid stations (puestos de socorro), and communication systems capable of operating underground. Article 343-G LFT addresses the rights of workers trapped underground — the employer must immediately notify STPS, IMSS, and local civil protection authorities, activate rescue operations, and continue paying full salary and benefits to trapped workers and their families during rescue operations.

The Contrato de Trabajo Minero under LFT arts. 343-A–343-I operates within the broader framework of the Ley Minera (published in the DOF on 26 June 1992 and substantially reformed in 2022), the Reglamento de la Ley Minera, and the Reglamento Interior de Trabajo of each mining company filed with the STPS under Article 424 LFT.

When Do You Need a Mining Worker Contract Mexico (Contrato de Trabajo Minero)?

A Mining Worker Contract Mexico is required whenever a mining company, metallurgical plant, or extractive industry employer engages a worker in any activity covered by Ley Federal del Trabajo arts. 343-A through 343-I — including underground drilling, blasting, ore extraction, ore processing, surface hauling, open-pit operations, metallurgical refining, smelting, and ancillary maintenance or support roles performed at mining sites.

The contract is needed before the worker begins operations at any mining facility, as Article 343-D LFT requires the pre-employment medical examination to be completed and documented before the first day of work — and the written employment contract is the foundational document that triggers this examination obligation. Mining companies that allow workers to begin operations without a written contract and documented pre-employment medical clearance face STPS Inspección del Trabajo sanctions and potential criminal liability under Article 343-I LFT, which establishes specific offences for mining employers who knowingly expose workers to dangers exceeding established NOM safety thresholds.

The written contract is required for IMSS registration under Article 15 of the Ley del Seguro Social. Mining workers are subject to an elevated occupational risk classification (clase de riesgo) under the IMSS risk premium system — this classification increases the employer's occupational risk (riesgos de trabajo) IMSS contribution rate and must be accurately reflected in the SUA (Sistema Único de Autodeterminación) filings. Misclassifying mining workers under a lower risk category to reduce IMSS quotas constitutes fraud under Article 304-A of the Ley del Seguro Social.

A Contrato de Trabajo Minero is also required when engaging workers who will be covered by an existing contrato colectivo de trabajo negotiated with the Sindicato Minero or another recognized union — the individual contract must be consistent with and cannot fall below the collective agreement's minimum conditions under Article 396 LFT.

Mining companies operating under a Reglamento Interior de Trabajo filed with the STPS under Article 424 LFT must ensure all individual employment contracts reference and incorporate the work regulations by name — workers cannot be bound by internal regulations they were not made aware of at the time of contracting.

The contract is needed when engaging contract workers (subcontratistas) assigned to mining operations. Following the 2021 outsourcing reform (Decreto published in the DOF on 23 April 2021), mining companies that use specialized contractor services must register with the Registro de Prestadoras de Servicios Especializados u Obras Especializadas (REPSE) maintained by the STPS, and all individual employment contracts with workers assigned to mining sites must identify the REPSE-registered contractor as the employer of record.

Identification of Parties: Full legal name, RFC, CURP, and domicilio fiscal of the mining company (empresa minera), including its Registro Minero Concesión number issued by the Servicio Geológico Mexicano (SGM) under the Ley Minera. The worker's full legal name, RFC, CURP, NSS, blood type (grupo sanguíneo), emergency contact, and domicilio particular must appear — Article 343-B LFT specifically requires this expanded personnel information in the padrón de trabajadores that the employer must maintain.

Mining Operation and Work Location: The specific mining unit (unidad minera), mine name, and geographic location of operations. Where the work involves underground extraction, the contract must specify the shaft (tiro), level (nivel), or section (frente de trabajo) where the worker will be assigned. Position and Mining Functions: The specific job category (categoría de trabajo) and precise functions — underground driller (perforista), blaster (tronador/barretero), ore loader (palero/paleo de mineral), maintenance mechanic (mecánico de mantenimiento), plant operator (operador de planta), metallurgical technician (técnico metalúrgico), or surface haul truck operator (operador de camión de acarreo), among others. Article 343-B LFT requires that each worker's record identify their specific role for emergency evacuation purposes.

Occupational Risk Classification: The IMSS occupational risk class (clase de riesgo) applicable to the specific mining position, consistent with the employer's registered prima de riesgo de trabajo under the Reglamento de la Ley del Seguro Social en Materia de Afiliación, Clasificación de Empresas, Recaudación y Fiscalización. Mining operations are typically classified in Class IV or Class V (highest risk premium) under the IMSS risk premium system.
