La Empresa de Catering garantiza que todos los alimentos y bebidas serán preparados y servidos en cumplimiento de la Norma Oficial Mexicana NOM-251-SSA1-2009 sobre prácticas de higiene para el proceso de alimentos y bebidas, y que el personal de servicio cuenta con las tarjetas de salud vigentes requeridas por la autoridad sanitaria.

V. POLÍTICA DE CANCELACIÓN Y CONFIRMACIÓN

VI. RESPONSABILIDAD E INCUMPLIMIENTO

La Empresa de Catering es responsable de la calidad, inocuidad e higiene de todos los alimentos y bebidas servidos en el evento. En caso de incidente de seguridad alimentaria (enfermedad transmitida por alimentos — ETA) atribuible a la negligencia en la preparación o servicio por parte de la Empresa de Catering, ésta responderá por los daños y perjuicios causados conforme a los Artículos 1910 a 1934 del Código Civil Federal, sin posibilidad de limitar contractualmente esta responsabilidad.

El Cliente podrá presentar queja ante la Procuraduría Federal del Consumidor (PROFECO) en caso de incumplimiento de los servicios contratados, conforme a los Artículos 111 a 122 de la Ley Federal de Protección al Consumidor.

VII. LEY APLICABLE Y JURISDICCIÓN

El presente contrato se rige por el Código Civil Federal (Artículo 2606), la Ley Federal de Protección al Consumidor (Artículo 7), y la normatividad sanitaria aplicable (NOM-251-SSA1-2009) de los Estados Unidos Mexicanos. What Is a Event Catering and Venue Contract Mexico (Contrato de Servicios de Catering y Eventos)?

An Event Catering and Venue Contract Mexico (Contrato de Servicios de Catering y Eventos) is a written agreement between a catering and events company (empresa de catering y eventos) and a client (cliente) — which may be an individual, corporation, or organisation — by which the catering company agrees to provide food and beverage services (servicios de alimentos y bebidas), venue coordination, staffing, and event logistics for a specified event on a specified date, in exchange for an agreed fee (contraprestación pactada). In Mexico, event catering contracts are governed principally by Código Civil Federal (CCF) Article 2606, which classifies the provision of professional and specialised services as a contrato de prestación de servicios profesionales creating bilateral obligations between service provider and client, and by the Ley Federal de Protección al Consumidor (LFPC, DOF 24 December 1992, as amended) Article 7, which requires that all consumer-facing service providers supply accurate information about prices, terms, and conditions.

The Código Civil Federal (CCF) Chapter XI on prestación de servicios profesionales (Articles 2606 through 2615) governs the obligations of the service provider — including the duty to perform the service personally or through qualified personnel (Article 2607), the prohibition against delegating the contract without client consent, and the right to fair compensation (remuneración justa) for services rendered. For catering contracts that involve venue hire (arrendamiento de local), the Título Sexto of the CCF on Arrendamiento (Articles 2398 through 2496) may also apply to the venue component of the agreement. The Código de Comercio (CCom) Article 75 applies when both parties are commercial enterprises — in which case the contract is a mercantile act governed additionally by commercial law principles.

The Ley Federal de Protección al Consumidor (LFPC) is administered by the Procuraduría Federal del Consumidor (PROFECO) — the federal consumer protection agency. LFPC Article 7 requires that event services providers display clearly the total price (precio total) including all service charges (cargos por servicio), taxes (impuestos), and surcharges before the consumer commits to the contract. LFPC Article 76 provides that any contract clause that exempts the service provider from liability for failure to perform, or that imposes excessive cancellation penalties on the consumer, may be declared abusive (cláusulas abusivas) and unenforceable by PROFECO.

For events involving alcohol (bebidas alcohólicas), the catering company must comply with the Ley General de Salud (LGS) Articles 216 through 220 governing the sale and service of alcoholic beverages, and must ensure that service staff hold the permits required by the local municipal authority (permiso municipal para expendio de bebidas alcohólicas) and the Secretaría de Salud. The NOM-142-SSA1/SCFI-2014 establishes requirements for the labelling and service of alcoholic beverages. For events involving food preparation and service, compliance with the Norma Oficial Mexicana NOM-251-SSA1-2009 on good hygiene practices (prácticas de higiene) for food establishments is mandatory — the caterer bears primary responsibility for food safety under this NOM and under the Reglamento de Control Sanitario de Productos y Servicios.

The Servicio de Administración Tributaria (SAT) requires that all commercial event catering services be invoiced through a Comprobante Fiscal Digital por Internet (CFDI) under the Resolución Miscelánea Fiscal and the Código Fiscal de la Federación (CFF) Article 29. Both the client and the caterer should ensure that CFDI invoices are issued for all payments — including deposits (anticipos), partial payments (pagos parciales), and the final balance (saldo final) — using the appropriate CFDI use classification (uso de CFDI) applicable to the type of expense.

When Do You Need a Event Catering and Venue Contract Mexico (Contrato de Servicios de Catering y Eventos)?

An Event Catering and Venue Contract Mexico is required whenever a business or individual engages a catering company or event venue to provide food, beverage, or venue services for a specific event — including weddings (bodas), quinceañeras, corporate events (eventos corporativos), product launches (lanzamientos de productos), conferences (conferencias), and private social gatherings.

The contract is essential for wedding and social events where significant deposits (anticipos) are paid months in advance. Under the LFPC, consumers who pay deposits for future services have the right to a written contract specifying exactly what services are included in the agreed price, the cancellation and refund policy (política de cancelaciones y reembolsos), and the consequences of vendor non-performance. A written catering contract protects the client if the caterer fails to appear, delivers insufficient food quantities, or provides services materially inferior to those contracted.
