What Is a Building Technical Inspection Agreement Spain (ITE)?

A Building Technical Inspection Agreement Spain (Acuerdo de Inspección Técnica de Edificio — ITE) is a formal written contract between a building owner or owners' community (comunidad de propietarios) and a qualified technical professional — typically an arquitecto, arquitecto técnico, or ingeniero de edificación — commissioning a periodic inspection of the building's structural condition, safety systems, habitability, and maintenance status. The Inspección Técnica de Edificios (ITE) is a mandatory administrative obligation established by regional legislation of each Comunidad Autónoma of Spain, implementing the general framework of the Ley 38/1999 de Ordenación de la Edificación (LOE), Article 9, which establishes the duties of building owners to maintain edificios in adequate conditions of safety (seguridad), salubrity (salubridad), ornamental maintenance (ornato), and habitability (habitabilidad).

The ITE system — also referred to as the Informe de Evaluación de Edificios (IEE) at the national level under the Ley 8/2013 de Rehabilitación, Regeneración y Renovación Urbanas — requires that buildings over a certain age (typically 45 to 50 years, varying by Comunidad Autónoma) be inspected by a competent professional and a certificate (certificado ITE or informe IEE) be submitted to the local Ayuntamiento. In the Comunidad de Madrid, the obligation is governed by Decree 168/1994 and local Ordenanzas Municipales. In Cataluña, the Inspecció Tècnica dels Edificis (ITE) is regulated by Decreto 187/2010 and affects buildings over 45 years old. In the Comunitat Valenciana, Decreto 66/2009 establishes the ITE regime for residential buildings over 50 years of age.

The LOE Article 9 explicitly assigns to building owners (propietarios) the duty to conserve the building in adequate conditions for proper use and to order the execution of conservation works (obras de conservación) required by public administrations or needed to maintain the building in satisfactory technical conditions. Failure to comply with an ITE obligation can result in administrative sanctions from the Ayuntamiento, including fines (multas) under the applicable Ley de Disciplina Urbanística and enforcement of conservation orders (órdenes de ejecución).

The ITE inspection itself evaluates four principal areas: (i) cimentación y estructura (foundations and structure) — verifying absence of settlement, cracking, or reinforcement corrosion; (ii) fachadas y cubiertas (facades and roofs) — checking for falling risks, waterproofing failures, and cladding deterioration; (iii) instalaciones comunes (common installations) — including electricity, water, gas, elevators (ascensores) certified under the Reglamento de Aparatos de Elevación y Manutención, and fire protection systems; and (iv) condiciones de accesibilidad (accessibility conditions) — compliance with Ley 26/2011 de Accesibilidad, Real Decreto 505/2007, and the CTE DB-SUA (Código Técnico de la Edificación, Documento Básico de Seguridad de Utilización y Accesibilidad).

The Código Técnico de la Edificación (CTE), approved by Real Decreto 314/2006 and amended by Real Decreto 732/2019, sets the minimum technical requirements that buildings in Spain must satisfy — the ITE assesses compliance with relevant CTE Documentos Básicos, including DB-SE (Structural Safety), DB-SI (Fire Safety), and DB-HS (Health). When deficiencies are found, the inspector classifies them by severity — muy grave, grave, importante, or leve — and specifies required remedial works and timescales.

The agreement between the building owner and the technical professional is governed by the general law of contracts in the Código Civil Articles 1544–1546 (contrato de obra and contrato de servicios), and the LOE Articles 9–12, which define the responsibilities of the different agentes de la edificación. The professional's liability for errors in the inspection report is governed by LOE Article 17, which establishes a 10-year decennial liability period for structural defects, 3 years for habitability defects, and 1 year for finishing defects.

When Do You Need a Building Technical Inspection Agreement Spain (ITE)?

A Building Technical Inspection Agreement Spain is needed whenever a building owner, owners' community (comunidad de propietarios), or property manager commissions an ITE inspection to comply with statutory obligations or voluntary maintenance programs.

The agreement is required when a residential building reaches the age threshold established by the applicable Comunidad Autónoma legislation — typically 45 to 50 years of age — triggering the mandatory ITE obligation enforced by the local Ayuntamiento through its Oficina de Atención al Ciudadano or Área de Urbanismo.

An ITE agreement is needed when the Ayuntamiento issues a formal ITE requirement notice (requerimiento de ITE) to a comunidad de propietarios, giving a specified deadline — typically 6 months — to submit the completed inspection report (informe ITE or IEE) issued by a habilitado técnico competente.

The agreement is necessary when a building owner seeks to obtain a mortgage (préstamo hipotecario) from a credit institution regulated by the Banco de España — many lenders require evidence of a recent ITE certificate as a condition for releasing mortgage funds or extending credit secured on the property.

A Building Technical Inspection Agreement is needed when a comunidad de propietarios applies for public subsidies for rehabilitation works (obras de rehabilitación) under the Plan Estatal de Vivienda 2022–2025 (Real Decreto 42/2022) — the IEE report is a mandatory prerequisite for accessing IDAE energy efficiency subsidies or Comunidad Autónoma rehabilitation grants.

The agreement is required when a property is being sold (compraventa inmobiliaria) and the buyer's legal adviser or the Notario requests evidence of the building's technical condition — an up-to-date ITE certificate reduces the buyer's exposure to hidden defects (vicios ocultos) claims under Código Civil Articles 1484–1490.

An ITE agreement is also needed when an insurer conditions property insurance (seguro multirriesgo del hogar) renewal on evidence of a satisfactory ITE result, particularly for older buildings where structural risk premiums are applied by insurers regulated by the Dirección General de Seguros y Fondos de Pensiones (DGSFP).

Parties in Spain should prepare a Building Technical Inspection Agreement Spain (ITE) proactively rather than waiting for a dispute to arise. Courts interpret agreements based on the written terms rather than oral representations. Under the Ley de Arrendamientos Urbanos (LAU) 29/1994, Spanish tenancy law sets minimum duration (5 years individuals, 7 years entities) and deposit requirements. The Código Civil Articles 1445–1541 govern sale of property. The Ley Hipotecaria governs the Registro de la Propiedad. The Ley 5/2019 (LCCI) regulates mortgage lending with mandatory FEIN/FiAE disclosure. The Impuesto sobre Transmisiones Patrimoniales (ITP) applies to property transfers. Where the transaction involves regulated activities, prior approval from the relevant authority may be required before execution.

What to Include in Your Building Technical Inspection Agreement Spain (ITE)

A valid Building Technical Inspection Agreement Spain under the Ley 38/1999 (LOE) and applicable Comunidad Autónoma regulations must include the following essential elements.

Identification of Parties: Full legal name and DNI/NIE or NIF of the building owner (propietario) or the President of the comunidad de propietarios acting under authorisation from the Junta de Propietarios per the Ley de Propiedad Horizontal (Ley 49/1960, LPH). The professional's full name, DNI/NIE, Colegio Profesional membership number (número de colegiado), and professional indemnity insurance (seguro de responsabilidad civil profesional) details — mandatory under LOE Article 14 — must also be stated.

Building Identification: Full address of the building subject to inspection, Referencia Catastral (cadastral reference) assigned by the Dirección General del Catastro, year of construction, total number of dwellings (viviendas), and approximate built area (superficie construida). The Referencia Catastral links the building to the Catastro Inmobiliario records and the Registro de la Propiedad entry.

Scope of Inspection: Detailed description of the four inspection areas — cimentación y estructura, fachadas y cubiertas, instalaciones comunes, and accesibilidad — including which specific elements will be inspected. The scope must comply with the technical requirements of the applicable Comunidad Autónoma's ITE regulation and the national IEE framework under Ley 8/2013. Any elements excluded from inspection should be expressly noted.

Professional Fees and Payment Terms: The agreed professional fee (honorarios profesionales) for the inspection and report, expressed in euros inclusive of IVA (Impuesto sobre el Valor Añadido at the applicable rate under Ley 37/1992 del IVA). Payment schedule — typically a deposit on engagement and the balance on delivery of the report — and the professional's bank account details (IBAN) for transfer.

Delivery Timeline: The date by which the completed ITE/IEE report will be delivered to the owner, consistent with any Ayuntamiento deadline stated in the ITE requirement notice. The agreement should identify the applicable Comunidad Autónoma regulation and local Ordenanza establishing the submission deadline.

Report Format and Submission: Specification of whether the professional will submit the report directly to the Ayuntamiento or Comunidad Autónoma's Consejería de Vivienda on behalf of the owner, and confirmation of the electronic submission system (sede electrónica or ventanilla única) to be used. In communities where the Informe de Evaluación de Edificios (IEE) is required, the report must include the energy efficiency certificate (certificado de eficiencia energética) under Real Decreto 235/2013.

Deficiency Classification: Agreement on how identified deficiencies (deficiencias) will be classified — muy grave (immediate risk to persons), grave (significant structural or safety risk), importante (functional impairment), or leve (minor) — and the timescales for remedial works prescribed by the Comunidad Autónoma regulation.

Professional Liability: Reference to the professional's liability under LOE Article 17 — 10 years for structural defects (defectos estructurales), 3 years for habitability defects, 1 year for finishing defects — and the professional's obligation to maintain professional indemnity insurance. The professional's Colegio Profesional (e.g., Colegio Oficial de Arquitectos, Colegio Oficial de Aparejadores y Arquitectos Técnicos) registration confirms their professional standing and access to the mandatory professional indemnity scheme.

Confidentiality and Data Protection: A RGPD (Reglamento UE 2016/679) and LOPDGDD (Ley Orgánica 3/2018) compliant clause covering the processing of personal data of building residents included in the inspection report, administered through the Agencia Española de Protección de Datos (AEPD).
