What Is a Family Reunification Application Spain?

A Family Reunification Application Spain (Solicitud de Autorización de Residencia por Reagrupación Familiar) is the formal request submitted by a lawfully resident foreign national (reagrupante) to the competent immigration authority — the Oficina de Extranjería of the relevant province, under the supervision of the Subdelegación del Gobierno or Delegación del Gobierno — to obtain a residence authorisation for qualifying family members who currently reside abroad, enabling them to join the reagrupante in Spain. The right to family reunification in Spain is established under Articles 16 to 19 of the Ley Orgánica 4/2000, de 11 de enero, sobre derechos y libertades de los extranjeros en España y su integración social (LOEx), as substantially reformed by the Ley Orgánica 2/2009 and developed by the Real Decreto 557/2011, de 20 de abril, by which the Reglamento de Extranjería is approved.

The LOEx Article 16 establishes the right to family life (derecho a la vida en familia) for foreign nationals lawfully residing in Spain — a right grounded in Article 8 of the European Convention on Human Rights (ECHR), Article 7 of the EU Charter of Fundamental Rights, and the Constitución Española Article 39 (protection of the family). Article 16 LOEx provides that foreign nationals holding a valid residence permit have the right to live in family, subject to the requirements and procedures established in the LOEx and its Reglamento.

Family members eligible for reagrupación familiar under Articles 17 and 53 LOEx include: the spouse (cónyuge) or registered partner (pareja de hecho inscrita) of the reagrupante, provided the marriage or partnership is not contracted merely for immigration purposes; minor children (hijos menores) of the reagrupante or their spouse, whether biological or legally adopted, who are unmarried; adult children (hijos mayores) who are objectively unable to provide for their own needs due to disability (discapacidad) certified by the competent authority; and dependent ascendants (ascendientes dependientes) — parents or grandparents — of the reagrupante or their spouse, over 65 years of age or with demonstrated dependency (dependencia), provided the reagrupante is the principal source of support and the reagrupación is justified by humanitarian reasons.

The reagrupante must meet certain conditions under Article 18 LOEx to sponsor family members: a minimum of one year of lawful residence in Spain and a valid residence authorisation of at least one more year; adequate housing (vivienda adecuada) sufficient for the family members to be reunified, certified by a municipal housing inspection (informe municipal de vivienda); and sufficient economic resources (medios económicos suficientes) to support the family members — typically a monthly income of at least 150% of the IPREM per person to be reunified beyond the first (100% IPREM for the reagrupante alone).

Upon approval of the reagrupación, the family member must apply for the corresponding family reunification visa (visado de reagrupación familiar) at the Spanish consulate in their country of residence, and upon entry into Spain, apply for the residence card (tarjeta de identidad de extranjero — TIE) within one month under Article 25 bis LOEx.

The legal framework governing the Family Reunification Application Spain in Spain draws on several key statutes and regulatory bodies. Under Spanish law, the Código Civil governs marriage (Article 66), divorce (Article 81), custody (Article 92), and maintenance (Article 142). The Ley Orgánica 1/1996 (LOPJM) protects minors. The Registro Civil records births, marriages, and deaths. The Ley 15/2015 de Jurisdicción Voluntaria governs non-contentious proceedings. The Ley Orgánica 1/1982 protects fundamental rights including image and privacy. Parties executing a Family Reunification Application Spain in Spain should confirm the document reflects current law, including any amendments enacted since the original drafting date. The Ley Orgánica 4/2000 de Extranjería (LOEx) art. 16 sets the foundational requirements.

When Do You Need a Family Reunification Application Spain?

A Family Reunification Application Spain is needed when a foreign national lawfully residing in Spain for at least one year — holding a temporary or long-term residence permit — wishes to bring their spouse, registered partner, minor children, disabled adult children, or dependent parents or grandparents to live with them in Spain.

The solicitud must be submitted by the reagrupante in Spain to the Oficina de Extranjería of their province of residence — not by the family member abroad. The reagrupante initiates the process, and once the authorisation is granted, the family member applies for the visa at the Spanish consulate.

The application is required when the reagrupante has a residence permit of at least one year's duration remaining at the time of application and can demonstrate the housing and income requirements. Applications submitted before completing one year of lawful residence will be refused.

The Spain Family Reunification Application Spain document is needed when a family member's tourist visa or short-stay authorisation is about to expire or has expired, making it necessary to regularise their situation through the official reagrupación process — attempting to stay in Spain irregularly is inadvisable as it may lead to expulsion proceedings under Article 53 LOEx.

The solicitud is required for registered partners (parejas de hecho) as well as spouses — the reagrupante must provide evidence of the official registration of the partnership, either in a Spanish Registro Civil or through an equivalent official register in the country of origin.

Family members of EU citizens residing in Spain are subject to a different, more favourable legal regime — the Real Decreto 240/2007, de 16 de febrero, implementing EU Directive 2004/38/EC — and do not use the LOEx reagrupación procedure. They apply directly for the EU citizen's family member residence card (tarjeta de residencia de familiar de ciudadano de la UE) at the Oficina de Extranjería.

Parties in Spain should prepare a Family Reunification Application Spain proactively rather than waiting for a dispute to arise. Courts interpret agreements based on the written terms rather than oral representations. Under Spanish law, the Código Civil governs marriage (Article 66), divorce (Article 81), custody (Article 92), and maintenance (Article 142). The Ley Orgánica 1/1996 (LOPJM) protects minors. The Registro Civil records births, marriages, and deaths. The Ley 15/2015 de Jurisdicción Voluntaria governs non-contentious proceedings. The Ley Orgánica 1/1982 protects fundamental rights including image and privacy. Where the transaction involves regulated activities, prior approval from the relevant authority may be required before execution.

What to Include in Your Family Reunification Application Spain

A valid Family Reunification Application Spain under Articles 16 to 19 of the Ley Orgánica 4/2000 (LOEx) and the Real Decreto 557/2011 (Reglamento de Extranjería) must include the following elements.

Reagrupante Identification: Full name, NIE (Número de Identidad de Extranjero), nationality, and current residence address of the applicant (reagrupante) in Spain. A copy of the reagrupante's valid TIE (tarjeta de identidad de extranjero) or residence authorisation stamp in the passport must be attached.

Residence Duration: Evidence that the reagrupante has resided lawfully in Spain for at least one year — typically provided by the TIE showing the residence permit issuance date and the padrón municipal (census registration) certificate from the Ayuntamiento confirming continuous residence.

Family Member Details: Full name, nationality, date of birth, passport number, and current address abroad of each family member to be reunified. The family relationship must be documented — marriage certificate (certificado de matrimonio) or pareja de hecho registration for spouses/partners; birth certificate (certificado de nacimiento) for children; documentary evidence of dependency for ascendants and disabled adult children. All foreign documents must be apostilled (Apostilla de la Haya under the Hague Convention 1961) and officially translated into Spanish by a sworn translator (traductor jurado).

Housing Evidence: An informe municipal de habitabilidad (municipal housing inspection report) or informe de adecuación de la vivienda issued by the Ayuntamiento of the reagrupante's municipality, certifying that the dwelling is adequate in terms of surface area, rooms, and habitability conditions for the number of occupants after reunification. This report is typically requested separately at the Ayuntamiento and takes several weeks — it must be obtained before submitting the reagrupación application.

Economic Resources Evidence: Documentary evidence of sufficient income to support the family members — typically the most recent IRPF tax return (declaración de la renta), employment contract (contrato de trabajo) and recent payslips (nóminas), or for self-employed reagrupantes, the autónomo registration certificate and AEAT income certificates. The minimum income threshold is 100% of the IPREM for the reagrupante alone, plus 50% of the IPREM for each additional family member to be reunified (approximately €600 per month base + €300 per additional person in 2024).

Official Application Form: The official Formulario EX-02 (Solicitud de autorización de residencia por reagrupación familiar) available from the Ministerio del Interior (extranjeros.inclusion.gob.es) — this must be completed and submitted with the supporting documents.

Payment of Fees: Payment of the applicable immigration fee (tasa de extranjería) — Modelo 790 Código 052 — for the reagrupación authorisation. Current fees are approximately €65 to €100 depending on the type of authorisation requested.
