What Is a Shared Vehicle Use Agreement Spain?

A Shared Vehicle Use Agreement Spain (Acuerdo de Uso Compartido de Vehículo) is a formal written contract, governed by Article 1255 of the Código Civil (CC) and the framework established by Real Decreto Legislativo 6/2015, de 30 de octubre, por el que se aprueba el texto refundido de la Ley sobre Tráfico, Circulación de Vehículos a Motor y Seguridad Vial (LSV), by which two or more persons agree to share the use, maintenance costs, insurance obligations, and civil liability arising from a motor vehicle (vehículo de motor) registered in Spain. The agreement defines each user's access schedule, financial contributions, responsibilities for fuel, insurance, maintenance, and the allocation of liability in the event of an accident, traffic infraction, or damage.

Motor vehicle law in Spain is administered by the Dirección General de Tráfico (DGT), an agency of the Ministerio del Interior, which maintains the Registro de Vehículos. The vehicle's registered owner (titular registral) — recorded in the Permiso de Circulación (vehicle registration certificate) and in the Informe de la DGT — bears primary administrative and civil liability for the vehicle's use under Spanish law. A Shared Vehicle Use Agreement clarifies the internal allocation of costs and liabilities between the registered owner and any authorised co-users — but does not modify the registered owner's liability to third parties or the DGT.

Motor vehicle insurance (seguro del automóvil) in Spain is compulsory under Ley 50/1980 de Contrato de Seguro and Real Decreto Legislativo 8/2004, de 29 de octubre (Ley sobre responsabilidad civil y seguro en la circulación de vehículos a motor — LRCSCVM). The compulsory third-party liability insurance (seguro obligatorio de responsabilidad civil) must cover at minimum €70,000,000 for personal injury and €15,000,000 for property damage per accident under Reglamento (UE) No 2021/2116. The insurance policy must cover all authorised drivers — if a shared user drives without being listed in the insurance policy, the insurer may deny coverage and seek recovery from the vehicle owner under Article 10 LRCSCVM. The Shared Vehicle Use Agreement should clearly address which users are listed as authorised drivers (conductores habituales u ocasionales) in the insurance policy.

In the context of carpooling and ride-sharing platforms (plataformas de uso compartido de vehículo) — such as BlaBlaCar — Spanish law permits cost-sharing arrangements between private individuals under Article 1255 CC, provided the driver does not derive profit beyond the recovery of proportional transport costs. Profit-making ride-sharing by private individuals without a transport licence (autorización de transporte) violates Ley 16/1987 de Ordenación de los Transportes Terrestres (LOTT) and may result in administrative sanctions by the Ministerio de Transportes. The DGT has published guidance on the boundary between lawful cost-sharing (compartición de gastos) and unlicensed commercial passenger transport.

Traffic infractions (infracciones de tráfico) detected by radar, speed cameras, or traffic police generate administrative proceedings against the vehicle's registered holder (titular del vehículo) under LSV Article 69 — the Permiso de Circulación identifies the holder who receives the notification. The registered holder must identify the driver responsible for the infraction within 15 working days under LSV Article 69.bis, or bear the sanction personally. A Shared Vehicle Use Agreement should include provisions for each user to identify themselves as the driver for any infraction occurring during their allocated use period.

When Do You Need a Shared Vehicle Use Agreement Spain?

A Shared Vehicle Use Agreement Spain is needed in a growing range of personal and commercial situations where multiple individuals regularly share access to a single registered vehicle.

The agreement is needed when two family members or flatmates (compañeros de piso) share a single car for commuting to work on different days of the week — allocating fuel costs, insurance premiums, and maintenance expenses proportionally to avoid disputes.

A Shared Vehicle Use Agreement is required when neighbours or colleagues form a carpooling arrangement (plan de movilidad compartida) to reduce commuting costs and environmental impact — increasingly promoted by Spain's Plan de Recuperación, Transformación y Resiliencia under the Agenda Urbana Española.

The agreement is required when a family member is the registered owner of a vehicle but regularly lends it to another family member (child, parent, or sibling) who uses it as their primary vehicle — to document the insurance coverage of the secondary user and the allocation of running costs.

A Shared Vehicle Use Agreement is needed within a company (empresa) that wishes to establish a formal car-sharing (car pooling empresarial) arrangement among employees — the employer vehicle fleet (flota de vehículos de empresa) is increasingly managed through shared-use arrangements under environmental and tax efficiency goals, with implications for the employees' fringe benefit taxation under Ley 35/2006 del IRPF.

The agreement is also required when two business partners (socios) share a company vehicle registered in one partner's name or in the company's name, and wish to formalise the allocation of business versus personal use — relevant for IS and IRPF deductibility of vehicle expenses under Article 94 Ley 27/2014 and the DGT's 50% deductibility rule for dual-use vehicles.

A Shared Vehicle Agreement is also needed when agricultural landowners (propietarios rurales) share a tractor, combine harvester (cosechadora), or other agricultural vehicle registered under the DGT's Registro de Vehículos — particularly relevant in cooperativas agrarias governed by Ley 27/1999 de Cooperativas.

Parties in Spain should prepare a Shared Vehicle Use Agreement Spain proactively rather than waiting for a dispute to arise. Courts interpret agreements based on the written terms rather than oral representations. Under Spanish law, the Código Civil governs marriage (Article 66), divorce (Article 81), custody (Article 92), and maintenance (Article 142). The Ley Orgánica 1/1996 (LOPJM) protects minors. The Registro Civil records births, marriages, and deaths. The Ley 15/2015 de Jurisdicción Voluntaria governs non-contentious proceedings. The Ley Orgánica 1/1982 protects fundamental rights including image and privacy. Where the transaction involves regulated activities, prior approval from the relevant authority may be required before execution.

What to Include in Your Shared Vehicle Use Agreement Spain

A valid Shared Vehicle Use Agreement Spain under Código Civil Article 1255 and LSV must contain the following essential elements to be enforceable and to clearly allocate responsibilities.

Identification of Parties: Full names, DNI/NIE, addresses, and driving licence numbers (número de permiso de conducción — Permiso de Conducir DGT) of all parties to the agreement. The agreement should identify the registered owner (titular registral del vehículo) separately from any co-users who are not registered in the DGT Registro de Vehículos.

Vehicle Identification: Complete details of the shared vehicle — registration plate (matrícula), brand, model, year of manufacture, VIN (Número de Identificación del Vehículo — bastidor), and current mileage at the date of the agreement. A copy of the Permiso de Circulación (vehicle registration certificate) and the Ficha Técnica (ITV technical datasheet) should be annexed.

Use Schedule and Access Allocation: Clear definition of each party's authorised days, hours, and geographic scope of use. The schedule should address: regular weekday allocation; weekend allocation; priority in case of conflicting needs; and procedures for requesting additional use outside the normal schedule.

Insurance Coverage: Express confirmation that all authorised users are listed in the vehicle's compulsory insurance policy (póliza del seguro obligatorio) as conductores habituales or conductores ocasionales under Ley 50/1980 and LRCSCVM. The agreement should address who pays the insurance premium, how additional driver coverage is obtained, and the excess (franquicia) each user bears in the event of an at-fault accident during their use period.

Fuel and Running Costs: The mechanism for sharing fuel costs — proportional to kilometres driven by each user (based on odometer readings at the start and end of each use period), fixed monthly contributions, or a shared fuel card (tarjeta de combustible). Allocation of toll (peaje) costs — motorway tolls (autopistas de peaje) managed by Ministerio de Transportes and autonomous community concessionaires.

Maintenance Obligations: Responsibility for routine maintenance (ITV — Inspección Técnica de Vehículos every 2 years under Real Decreto 920/2017, oil changes, tyre replacement, brake servicing) and extraordinary repairs (averías). Whether costs are shared proportionally or borne by the registered owner and reimbursed by co-users.

Damage and Accident Liability: Internal allocation of liability for damage occurring during each user's use period — including the insurance excess (franquicia), uninsured damage (daños no cubiertos), and administrative fines arising from traffic infractions during that user's period. The obligation of each user to report accidents to the registered owner immediately and to complete the Declaración Amistosa de Accidente (European Accident Statement) form.

Traffic Infractions: Each user's obligation to identify themselves to the DGT as the driver responsible for any traffic infraction notified to the registered owner during their use period, within the 15-day identification period under LSV Article 69.bis — and to bear the sanction, penalty points (puntos del carné — Sistema de Permiso por Puntos, Ley 17/2005), and associated costs personally.

Duration and Termination: The term of the agreement and the notice required to terminate — typically 30 days' written notice. Automatic termination events: sale of the vehicle, withdrawal of registration, total loss (siniestro total) confirmed by an aseguradora or perito de seguros.

Governing Law: Spanish law — Código Civil (CC) and LSV. Disputes resolved by mediation (mediación civil under Ley 5/2012) or before the Juzgado de Primera Instancia with territorial jurisdiction.
