What Is a Social Security Registration Form Spain (Alta Seguridad Social)?

A Social Security Registration Form (Alta en la Seguridad Social) in Spain is an official administrative procedure by which an employer (empresario) notifies the Tesorería General de la Seguridad Social (TGSS) of the commencement of an employment relationship, so that the worker (trabajador) is enrolled in the Spanish social security system and entitled to benefits including healthcare (asistencia sanitaria), temporary incapacity (incapacidad temporal), permanent disability (incapacidad permanente), maternity and paternity benefits (prestaciones por maternidad y paternidad), unemployment benefits (desempleo), and retirement pension (jubilación). The obligation to register workers is established in Article 139 of the Ley General de la Seguridad Social (Real Decreto Legislativo 8/2015, de 30 de octubre — LGSS) and developed by Real Decreto 84/1996, de 26 de enero, por el que se aprueba el Reglamento General sobre inscripción de empresas y afiliación, altas, bajas y variaciones de datos de trabajadores en la Seguridad Social.

The Alta en la Seguridad Social must be filed with the TGSS through the Sistema RED (Remisión Electrónica de Documentos) — the online platform for authorised social security agents (gestores, asesores laborales, and directly authorised employers) — or through the TGSS's online portal (Sede Electrónica de la Seguridad Social, accessible via importass.seg-social.es) using a digital certificate, DNI electrónico, or Cl@ve PIN authentication. The employer must file the Alta before the worker begins work (previamente al inicio de la actividad laboral) — Article 139.2 of the LGSS is explicit that registration must precede the start of employment, not merely be filed within a subsequent period. Late registration exposes the employer to administrative penalties under the Ley sobre Infracciones y Sanciones en el Orden Social (Real Decreto Legislativo 5/2000 — LISOS).

Every worker in Spain must have a Número de Seguridad Social (NSS) — a unique identifier assigned by the TGSS upon first affiliation (afiliación). For workers being registered for the first time, the employer must simultaneously file an application for afiliación (affiliation), which the TGSS processes to assign an NSS. Workers who already have an NSS from previous employment in Spain need only to be registered as Alta (active) under the employer's Código de Cuenta de Cotización (CCC) — the social security contribution account number assigned to the employer for each province where workers are employed.

Spain's social security system covers multiple contribution regimes (regímenes): the Régimen General (general regime) covers most employed workers; the Régimen Especial de Trabajadores Autónomos (RETA) covers self-employed workers; the Régimen Especial del Mar covers maritime workers; the Régimen Especial de la Minería del Carbón covers coal miners; and the Sistema Especial para Trabajadores del Hogar (SETH) covers domestic workers, with specific Alta procedures under Ley 27/2011 and the Estatuto de los Trabajadores. Each regime has different contribution bases (bases de cotización) and rates published annually in the Ley de Presupuestos Generales del Estado and administered through the TGSS's official contribution tables.

The employer must also communicate the employment contract to the Servicio Público de Empleo Estatal (SEPE) within 10 working days of execution under Article 16.1 of the Estatuto de los Trabajadores (RDL 2/2015) — this obligation is separate from the TGSS Alta and must be fulfilled through the SEPE's Contrat@ electronic platform or the local Oficina de Empleo. Failure to register a worker before they begin work is one of the most frequently detected infractions by the Inspección de Trabajo y Seguridad Social (ITSS) — inspectors conduct regular checks of workplaces and may issue actas de infracción leading to fines and surcharges on unpaid social security contributions.

When Do You Need a Social Security Registration Form Spain (Alta Seguridad Social)?

A Social Security Registration (Alta en la Seguridad Social) in Spain is required every time an employer commences an employment relationship with a new worker — regardless of the type of contract (indefinite, temporary, part-time, full-time, or apprenticeship) and regardless of the worker's nationality.

An Alta is required when a company (sociedad limitada, sociedad anónima, or other legal entity) or a self-employed professional (autónomo) hires an employee for the first time. The Alta must be filed before the worker's first day of work — there is no grace period under Article 139.2 of the LGSS, and commencing work before the Alta is processed is an infraction regardless of whether the worker was registered the same day.

An Alta is needed when a temporary contract worker returns from a period off the payroll — including seasonal workers (trabajadores fijos-discontinuos) under Article 16 of the Estatuto de los Trabajadores who are called back for a new working period, even if they were previously registered under the same employer's CCC.

An Alta in the Sistema Especial para Trabajadores del Hogar (SETH) is required when a private individual employs a domestic worker (empleada de hogar) for more than 60 hours per month under Ley 27/2011 and Real Decreto 1620/2011. The household employer must register with the TGSS as an employer (inscripción empresarial) before filing the domestic worker's Alta. Domestic workers employed for fewer than 60 hours per month by a single household may register themselves.

An Alta in the Régimen Especial de Trabajadores Autónomos (RETA) is required when a person starts self-employed activity (actividad por cuenta propia) in Spain — the autónomo must file the Alta within 30 days of commencing the activity through the TGSS's Sede Electrónica or at a TGSS office. Self-employed workers must also register the economic activity with the AEAT through Modelo 036 or Modelo 037.

An Alta is required following a period of suspension of the employment contract — for example, after maternity or paternity leave, illness, or a temporary layoff (ERTE — Expediente de Regulación Temporal de Empleo). At the end of the suspension period, the employer files an Alta (or a re-alta) to resume social security contributions for the worker.
