SOLAR PANEL INSTALLATION AGREEMENT (ACUERDO DE INSTALACIÓN DE PANELES SOLARES)

El presente Acuerdo de Instalación de Paneles Solares (el «Acuerdo») se celebra con fecha [Effective Date], al amparo del artículo 9 de la Ley 24/2013 del Sector Eléctrico y del Real Decreto 244/2019 de autoconsumo, entre:

CLIENTE: [Client Name], NIF/DNI/NIE [Client NIF], domicilio en [Client Address] (en adelante, el «Cliente»).

INSTALADOR: [Installer Name], NIF [Installer NIF], domicilio social en [Installer Address], número de habilitado como instalador [Habilitado Number], seguro de responsabilidad civil profesional [Installer Insurance] (en adelante, el «Instalador» / «Empresa Instaladora»).

1. SCOPE OF WORKS

1.1 El Instalador se compromete a diseñar, suministrar, instalar, poner en marcha y registrar un sistema fotovoltaico de autoconsumo en [Installation Address], Referencia Catastral [Referencia Catastral], con las siguientes especificaciones:

1.2 Los trabajos cumplirán el Reglamento Electrotécnico para Baja Tensión (REBT, Real Decreto 842/2002) ITC-BT-40, el Código Técnico de la Edificación CTE HE 5, y las normas UNE aplicables a las instalaciones fotovoltaicas.

2. ADMINISTRATIVE PROCEDURES

2.1 El Instalador será responsable de: (i) obtener las licencias municipales de obras que corresponda ante el Ayuntamiento; (ii) emitir y presentar el Certificado de Instalación Eléctrica (CIE) ante la consejería de industria de la Comunidad Autónoma conforme al REBT; (iii) inscribir la instalación en el Registro Administrativo de Autoconsumo de Energía Eléctrica (RAAE) conforme al artículo 19 del RD 244/2019; y (iv) notificar a la distribuidora para activar el mecanismo de compensación aplicable.

2.2 El Cliente facilitará el acceso oportuno al lugar de la instalación y suscribirá cuantos documentos sean necesarios para las solicitudes de permisos y la inscripción en el RAAE.

3. PRICE AND PAYMENT

3.1 El precio total de la instalación es [Total Price], IVA incluido conforme a la Ley 37/1992 del IVA al tipo aplicable.

3.2 Calendario de pagos: (i) anticipo de [Deposit Amount] a la firma del presente Acuerdo; (ii) resto a abonar en la puesta en marcha y entrega del CIE al Cliente.

3.3 Fecha prevista de finalización de la instalación: [Completion Date].

4. WARRANTIES

4.1 Garantía de la instalación: mínimo 2 años desde la fecha de instalación conforme al Real Decreto Legislativo 1/2007 (LGDCU) para contratos con consumidores.

4.2 Garantía del fabricante de los paneles: garantía del producto según las especificaciones del fabricante (habitualmente 10-12 años de garantía de producto y 25 años de garantía lineal de rendimiento).

4.3 Garantía del inversor: según las especificaciones del fabricante, mínimo 5 años.

5. GENERAL PROVISIONS

5.1 Ley aplicable: El presente Acuerdo se rige por la legislación española, incluyendo la Ley 24/2013 del Sector Eléctrico, el Real Decreto 244/2019, el Real Decreto 842/2002 (REBT) y los artículos 1544 a 1546 del Código Civil.

5.2 Resolución de conflictos: Las controversias se someterán a los Juzgados de Primera Instancia de la ciudad donde se ubique la instalación, conforme a la Ley de Enjuiciamiento Civil (Ley 1/2000). Los consumidores también podrán acudir a la Oficina Municipal de Información al Consumidor (OMIC) para una mediación previa.

5.3 Protección de datos: Los datos personales se tratan de conformidad con el Reglamento (UE) 2016/679 (RGPD) y la Ley Orgánica 3/2018 (LOPDGDD), bajo la supervisión de la Agencia Española de Protección de Datos (AEPD).
