III. FUNDAMENTOS DE DERECHO

La presente solicitud se fundamenta en los artículos 700 al 710 del Código Civil colombiano, el artículo 586 del Código General del Proceso (Ley 1564 de 2012) sobre procesos de jurisdicción voluntaria, y las disposiciones del Decreto 1736 de 2012 sobre bienes sin propietario aparente.

IV. PRETENSIONES

Con fundamento en los hechos y el derecho expuesto, solicito respetuosamente al Despacho:

DECLARAR que el bien descrito en el numeral 1 de los hechos constituye un bien mostrenco conforme al artículo 700 del Código Civil.

2.

ORDENAR la publicación de los edictos de rigor para convocar a quienes puedan acreditar derechos sobre el bien.

3.

En caso de no presentarse reclamantes, DECLARAR la adquisición del bien por quien corresponda conforme a la ley.

The Declaration of Ownerless Property Petition Colombia (Solicitud de Declaración de Bien Mostrenco) is the legal document by which any person or entity brings to the attention of the competent authorities the existence of an immovable or movable property that apparently lacks a known owner, has been abandoned by its owner, or over which no one exercises possession or claims title. The legal basis for this figure is found in Articles 706 to 720 of the Colombian Código Civil, which regulate bienes vacantes and mostrencos — a designation grouping properties without apparent owner whose title may vest in the Colombian State.

Under Colombian law, bienes mostrencos are movable properties whose ownership no one claims or justifies, while bienes vacantes are immovable properties in the identical situation.
