CONTRATO DE ARRENDAMIENTO DE PARQUEADERO

Contrato de Arrendamiento de Parqueadero regulado por la Ley 820 de 2003, el Artículo 1973 del Código Civil y la Ley 675 de 2001 (Régimen de Propiedad Horizontal)

PRIMERA. — PARTES CONTRATANTES

El presente Contrato de Arrendamiento de Parqueadero se celebra entre:

SEGUNDA. — PARQUEADERO OBJETO DEL CONTRATO

El Arrendador entrega al Arrendatario, a título de arrendamiento, el siguiente parqueadero:

TERCERA. — VEHÍCULO AUTORIZADO

El siguiente vehículo queda autorizado para usar el parqueadero objeto del presente contrato:

El vehículo deberá mantener vigentes el SOAT (Seguro Obligatorio de Accidentes de Tránsito) y la Revisión Técnico-Mecánica conforme a la Ley 769 de 2002 (Código Nacional de Tránsito). Cualquier cambio en el vehículo autorizado requerirá notificación escrita previa al Arrendador.

CUARTA. — PLAZO Y ACCESO

El arrendamiento inicia el [Start Date] por un período de [Rental Duration] mes(es). Los contratos mes a mes podrán ser terminados por cualquiera de las partes con treinta (30) días de aviso escrito previo. Los contratos a plazo fijo se renovarán automáticamente por períodos iguales, salvo que cualquiera de las partes notifique su intención de no renovar con al menos treinta (30) días de anticipación al vencimiento.

Horario de acceso: [Access Hours]. Dispositivo de acceso: [Access Device]. El Arrendatario deberá devolver todos los dispositivos de acceso al terminar el contrato. Los dispositivos perdidos o dañados serán reemplazados a costo del Arrendatario.

QUINTA. — CANON DE ARRENDAMIENTO Y FORMA DE PAGO

El Arrendatario pagará un canon mensual de [Monthly Rent] pesos colombianos (COP), pagadero el [Payment Day] de cada mes calendario.

Forma de Pago: [Payment Method]. El Arrendador expedirá recibo de pago por cada canon recibido.

Los ajustes anuales del canon se indexarán al Índice de Precios al Consumidor (IPC) publicado por el Departamento Administrativo Nacional de Estadística (DANE). El Arrendador notificará con al menos treinta (30) días de anticipación antes de aplicar cualquier ajuste anual.

SEXTA. — CUOTA DE ADMINISTRACIÓN

SÉPTIMA. — RESPONSABILIDAD Y SEGUROS

Responsabilidad por daños al vehículo: [Liability Arrangement].

Seguro todo riesgo del vehículo: [Vehicle Insurance Required]. El Arrendatario deberá mantener vigente el SOAT en todo momento conforme a la Ley 769 de 2002. El Arrendador no responde por los objetos dejados dentro del vehículo.

El Arrendatario responderá por los daños causados al parqueadero, a los espacios adyacentes o a las zonas comunes del edificio como consecuencia del uso del vehículo o de su negligencia, conforme a los Artículos 2341-2360 del Código Civil.

OCTAVA. — REGLAMENTO DE PROPIEDAD HORIZONTAL

El Arrendatario se compromete a cumplir el reglamento de propiedad horizontal del edificio conforme a la Ley 675 de 2001, incluyendo: respetar los límites de velocidad dentro del edificio; abstenerse de realizar mantenimiento, reparaciones o lavado de vehículos en el área del parqueadero; evitar el almacenamiento de materiales inflamables, explosivos o peligrosos; mantener limpio el espacio asignado; y cumplir las normas de seguridad contra incendios de la Resolución 0256 de 2014.

El incumplimiento del reglamento de propiedad horizontal podrá dar lugar a sanciones impuestas por el administrador de propiedad horizontal y constituye causal de terminación del presente contrato.

NOVENA. — TERMINACIÓN DEL CONTRATO

Cualquiera de las partes podrá dar por terminado el presente contrato por las siguientes causales: mora en el pago de dos o más cánones consecutivos; incumplimiento de las restricciones sobre el tipo o uso del vehículo; daños al parqueadero o áreas adyacentes; violación del reglamento de propiedad horizontal; o necesidad del arrendador de utilizar el espacio para su propio vehículo, con treinta (30) días de aviso escrito previo.

Al terminar el contrato, el Arrendatario deberá desocupar el parqueadero, devolver todos los dispositivos de acceso y retirar el vehículo autorizado dentro de los cinco (5) días hábiles siguientes. La terminación por mutuo acuerdo escrito es válida conforme al Artículo 1602 del Código Civil.

DÉCIMA. — SOLUCIÓN DE CONTROVERSIAS

Cualquier controversia derivada del presente contrato se someterá previamente a conciliación extrajudicial ante un Centro de Conciliación autorizado por el Ministerio de Justicia y del Derecho, en cumplimiento de la Ley 640 de 2001. Si la conciliación fracasa, el asunto será resuelto por el Juzgado Civil Municipal del lugar donde se ubica el inmueble, conforme al Código General del Proceso (Ley 1564 de 2012).
