El presente contrato se clasifica como arrendamiento para uso distinto del de vivienda conforme al artículo 3 de la Ley 29/1994 de Arrendamientos Urbanos (salvo que la plaza de garaje se arriende conjuntamente con una vivienda al mismo arrendatario). 6. MANTENIMIENTO Y OBLIGACIONES

El arrendador mantendrá los elementos estructurales comunes, la iluminación, la ventilación y los sistemas de seguridad contra incendios del edificio del garaje en condiciones seguras de uso. El arrendatario mantendrá la plaza de garaje asignada limpia y en buen estado, y comunicará inmediatamente al arrendador cualquier defecto o incidencia de seguridad. El arrendatario no realizará modificaciones en la plaza de garaje sin el consentimiento previo por escrito del arrendador, incluida la instalación de puntos de recarga de vehículo eléctrico, que requiere cumplimiento de la ITC-BT-52 del REBT (RD 842/2002) y, en su caso, notificación a la comunidad de propietarios conforme al artículo 17.5 de la Ley 49/1960 de Propiedad Horizontal.

What Is a Parking Space Rental Agreement Spain (Arrendamiento de Plaza de Garaje)?

A Parking Space Rental Agreement Spain (Contrato de Arrendamiento de Plaza de Garaje) is a formal written contract under which the owner (arrendador) of a parking space (plaza de garaje), garage bay (plaza de aparcamiento), or storage room (trastero) in Spain grants a tenant (arrendatario) the right to use that space for parking a vehicle or storing goods in exchange for a periodic rent (renta), governed by the Ley 29/1994, de 24 de noviembre, de Arrendamientos Urbanos (LAU).

The legal classification of a parking space rental in Spain is determined by Article 2 and Article 3 of the LAU. Where the parking space is rented together with a dwelling (vivienda) — for example, a garage included in the same building as the residential apartment and used by the same tenant as part of their housing — the contract is classified as an arrendamiento de vivienda under Article 2 LAU and benefits from the full residential tenant protections of the LAU, including the minimum three-year term (or five years for landlords who are natural persons under Article 9.1 LAU as amended by Real Decreto-Ley 7/2019). Where the parking space is rented separately — independently of any residential lease, or where the landlord is a legal entity — the contract falls under the arrendamiento para uso distinto del de vivienda category under Article 3 LAU. In the latter case, the LAU's mandatory residential protections do not apply, and the parties have greater freedom of contract under Article 4.3 LAU.

Parking spaces and garages in Spain are often constituted as separate registered properties (fincas registrales independientes) in the Registro de la Propiedad under the horizontal property regime (propiedad horizontal) of the Ley 49/1960 de Propiedad Horizontal (LPH). Each plaza de garaje may have its own separate título de propiedad (property deed) and cadastral reference (referencia catastral). Alternatively, parking spaces may be designated as anejos (annexures) to residential apartments — accessory elements (anejos) registered alongside the main apartment title. The distinction between independent finca and anejo affects the landlord's ability to sell, mortgage, or separately lease the space.

Garage rentals in Spain must comply with the fire safety and construction regulations applicable to the building — Real Decreto 842/2002 (REBT — Reglamento Electrotécnico para Baja Tensión) for electrical installations, and the Código Técnico de la Edificación (Real Decreto 314/2006) Section SI (Seguridad en caso de Incendio) for fire safety in garages and underground car parks. The fianza must be deposited with the competent Comunidad Autónoma housing authority (organismo autonómico de vivienda) within the period established by the relevant autonomous community regulations.
