What Is a Closed Will Colombia (Testamento Cerrado ante Notario)?

A Closed Will Colombia (Testamento Cerrado ante Notario) is a solemn testamentary instrument through which a natural person (testador) declares their last will regarding the disposition of assets after death in a sealed document presented to a Notario Público and five witnesses, governed by the Código Civil (CC) — Ley 57 de 1887 — Articles 1074 through 1082 for the specific requirements of the closed will, the general testamentary provisions of CC Articles 1055 through 1094, the succession regime of CC Articles 1008 through 1442, and the Decreto Ley 960 de 1970 (Estatuto del Notariado) which establishes the notarial formalities for testamentary acts.

The Constitución Política de 1991 protects the right to private property under Article 58 and the right to intimidad (privacy) under Article 15 — the testamento cerrado combines both constitutional guarantees by allowing a testador to exercise testamentary freedom while maintaining the confidentiality of their dispositions during their lifetime. Unlike the testamento abierto where the notario and witnesses know the contents, in the testamento cerrado nobody other than the testador knows the specific provisions until the judicial opening after death.

Under CC Article 1074, the testador must write the will or have it written on their behalf, then place the document in a closed and sealed envelope (sobre cerrado y sellado), present it personally before the Notario Público and five testigos instrumentales (instrumental witnesses), and declare in their presence that the envelope contains their testament. The notario records the act of presentation in a protocolización acta (notarial record) that is incorporated into the notaría's Libro de Protocolo — the acta states the date, the testador's identity and declaration, the names and identification of the five witnesses, and the condition of the sealed envelope, but does not describe the contents of the will.

The Corte Suprema de Justicia — Sala de Casación Civil — has established through jurisprudence that the testamento cerrado offers heightened privacy but carries elevated formal risks. Under CC Article 1078, the sealed envelope must remain inviolate (the seal must not be broken) until the judicial opening proceeding. Any evidence that the seal was broken or the document tampered with may result in nullity of the will under the acción de nulidad de testamento (CC Article 1117). The five witnesses must be legally capable under CC Article 1068 — persons under 18, those with mental incapacity under Ley 1306 de 2009, and persons convicted of perjury or falsehood are disqualified.

After the testador's death, the testamento cerrado must be opened through a judicial proceeding known as apertura del testamento cerrado before the Juzgado de Familia, regulated by the Código General del Proceso (CGP) — Ley 1564 de 2012 — Article 473. The petitioner (any interested heir, legatee, or the albacea) presents a solicitud de apertura to the Juzgado de Familia, accompanied by the death certificate (registro civil de defunción), the sealed will retrieved from the notaría, and proof of the petitioner's interest. The judge verifies the integrity of the seal, opens the document in the presence of the petitioners and witnesses, reads the contents aloud, and issues an auto de apertura authorizing the succession to proceed according to the testamentary provisions.

Colombian succession law applies the same forced heirship rules (asignaciones forzosas under CC Article 1226) to the testamento cerrado as to the testamento abierto — the testador must respect the legítima rigurosa (50% for legitimarios), the cuarta de mejoras (25% for descendants only), and may freely dispose of only the cuarta de libre disposición (25%). The impuesto sobre ganancia ocasional on inherited assets under Estatuto Tributario Article 302 applies equally regardless of the testamentary form.

When Do You Need a Closed Will Colombia (Testamento Cerrado ante Notario)?

A Closed Will (Testamento Cerrado) Colombia is needed whenever a testador prioritises confidentiality over convenience in their estate planning. The primary advantage over the testamento abierto is privacy — the contents of the will remain unknown to the notario, witnesses, and all other persons until the judicial opening after the testador's death.

The testamento cerrado is needed when a testador wishes to make dispositions that could generate family conflict during their lifetime — for example, allocating the cuarta de mejoras (improvement quarter under CC Article 1242) to favour one child over others, leaving the cuarta de libre disposición to a non-family beneficiary, or including conditions (condiciones testamentarias under CC Articles 1132 through 1137) that might provoke disputes among potential heirs.

A testamento cerrado is needed when the testador wishes to designate a compañero/a permanente (under Ley 54 de 1990) as a beneficiary without the knowledge of other family members during the testador's lifetime. Under Sentencia C-238 de 2012 of the Corte Constitucional, the compañero/a permanente has equal succession rights to a married spouse, but the testador may wish to avoid premature disclosure of the allocation.

The closed will is needed when a testador with significant business interests wishes to maintain confidentiality about succession plans for empresas familiares (family businesses) — including the designation of which heir will receive controlling interests in a Sociedad por Acciones Simplificada (SAS under Ley 1258 de 2008) or other corporate structures — to prevent shareholder instability during the testador's lifetime.

A testamento cerrado is needed when the testador includes charitable bequests (legados a entidades de beneficencia) or donations to religious, educational, or cultural institutions under the cuarta de libre disposición, and prefers that these decisions remain private until death. Under CC Article 1133, legados may include conditional provisions that the testador may wish to keep confidential.

The closed will is appropriate when a testador who is deaf or mute (sordo/a or mudo/a) wishes to make a will — CC Article 1076 specifically provides that persons who cannot speak may execute a testamento cerrado, writing the will themselves and presenting the sealed document to the notario. For persons who can hear but cannot speak, the testamento cerrado is sometimes the preferred form because the testamento abierto requires the notario to read the will aloud, while the cerrado only requires the sealed presentation.

A testamento cerrado is needed when a foreign national residing in Colombia wishes to maintain privacy about their testamentary dispositions for Colombian assets while potentially having separate estate plans in other jurisdictions. Under CC Article 1054, Colombian succession law governs immovable property in Colombia regardless of the testador's nationality.

What to Include in Your Closed Will Colombia (Testamento Cerrado ante Notario)

A valid Closed Will (Testamento Cerrado) Colombia under Código Civil Articles 1074 through 1082 and Decreto Ley 960 de 1970 must contain two distinct components: the sealed testamentary document (documento testamentario) and the notarial presentation record (acta de presentación). Both must comply with specific formal requirements to be enforceable.

Testador identification — full legal name, cédula de ciudadanía number, date of birth, marital status, and domicile. Forced heirship compliance — the dispositions must respect the asignaciones forzosas under CC Article 1226: legítima rigurosa (50%), cuarta de mejoras (25% allocable only among descendants under CC Article 1242), cuarta de libre disposición (25%), porción conyugal (CC Article 1230), and alimentos forzosos (CC Article 411). Specific bequests (legados) — each bequest should identify the asset precisely (real property by matrícula inmobiliaria, vehicles by placa, bank accounts by institution and number), the beneficiary, and the estate portion against which it is charged. Residual estate clause — designation of herederos for the residual estate. Executor appointment — optional designation of an albacea under CC Articles 1271 through 1317. Writing Requirements: Under CC Article 1074, the testamentary document must be written. The testador may write the will personally (manuscrito) or have it written by another person — including typewritten or printed text. Unlike some jurisdictions, Colombian law does not require the testamento cerrado to be entirely in the testador's handwriting (hológrafo). However, the testador must sign every page of the document (CC Article 1075). Persons who cannot read must have two witnesses read the will before it is sealed — but this partially defeats the privacy purpose.

Sealing Requirements: The testamentary document must be placed in a closed envelope (sobre cerrado) that is sealed in a manner that prevents opening without visible evidence of tampering (CC Article 1078). The testador seals the envelope in the presence of the notario and witnesses, or presents it already sealed, declaring that the seal has not been compromised.
