What Is a Life Insurance Beneficiary Designation Colombia?

A Beneficiary Designation for Insurance (Designación de Beneficiario de Seguro) in Colombia is the formal document through which the policyholder or insured person designates one or more natural or legal persons to receive the insurance indemnity payment upon the occurrence of the insured event (death, disability, or other covered risk). In Colombia, beneficiary designation is governed by Articles 1140 to 1143 of the Commercial Code (Código de Comercio, Decree 410 of 1971) for life insurance, and by the specific conditions of each insurance contract for other lines. The designation must be communicated to the insurer in writing and takes effect from the moment the insurer acknowledges it. The policyholder can freely designate beneficiaries and modify or revoke the designation at any time during the policy's validity, unless an irrevocable beneficiary has been designated, in which case the insurer's consent is required for any modification. The Superintendencia Financiera de Colombia (Superfinanciera) supervises insurance companies and the proper handling of beneficiary designations under Decree 2555 of 2010.
