What Is a Early Retirement Application Colombia (Solicitud de Pensión Anticipada)?

An Early Retirement Application Colombia (Solicitud de Pensión Anticipada) is the formal document through which a Colombian worker requests recognition of a pensión anticipada de vejez — an early old-age pension — from their pension administrator before reaching the standard statutory retirement ages established by Ley 797 de 2003: 62 years for men and 57 years for women. The Colombian pension system operates through two parallel regimes under Ley 100 de 1993: the Régimen de Ahorro Individual con Solidaridad (RAIS), managed by private AFPs (Protección, Porvenir, Colfondos, and Old Mutual), and the Régimen de Prima Media con Prestación Definida (RPM), managed exclusively by Colpensiones (formerly ISS — Instituto de Seguros Sociales, restructured by Ley 1151 de 2007 and Decreto Ley 4121 de 2011).

The early retirement mechanisms available in Colombia derive from multiple statutory sources. Under Ley 100 de 1993 Article 64 (RAIS), a worker enrolled in the private AFP regime may access early retirement when the balance in their individual savings account — the cuenta de ahorro individual con solidaridad — is sufficient to finance a monthly pension equal to at least 110% of the SMMLV (Salario Mínimo Mensual Legal Vigente) and at least 110% of what the Garantía de Pensión Mínima (GPM) would provide. The GPM under Ley 100 de 1993 Article 65 guarantees that workers in the RAIS who have contributed for 1,150 weeks (approximately 23 years) but have insufficient account balances receive a pension topped up by the Fondo de Garantía de Pensión Mínima (FGPM), funded by the solidarity component of AFP contributions.

Under the Régimen de Prima Media (Colpensiones), Ley 100 de 1993 Article 33 as modified by Ley 797 de 2003 establishes the standard pension requirements: 62 years for men (57 for women) and 1,300 weeks of contributions (Ley 797 de 2003 — increased from 1,000 weeks progressively). There is no general early pension in the RPM — however, Ley 100 de 1993 establishes specific early pension regimes for: workers in high-risk occupations (actividades de alto riesgo) under Decreto 2090 de 2003, which permits pension at 55 years for men and 50 for women with 1,000 weeks in high-risk activities (mining, oil extraction, civil aviation crews, firefighting, and prison guards); workers with permanent and total disability (pensión de invalidez) under Ley 100 de 1993 Articles 38 through 45; and surviving spouses and dependents (pensión de sobrevivientes) under Articles 46 through 49.

Acuerdo Legislativo 01 de 2005 — a constitutional reform — eliminated all special transition and exception regimes (regímenes especiales) for new workers from July 2010, with limited exceptions for workers with 750 or more weeks of contributions as of July 29, 2005, who could remain in the Régimen de Transición established by Ley 100 de 1993 Article 36. The Corte Constitucional in Sentencia C-823 de 2006 confirmed the validity of this elimination, closing the door to most special early retirement regimes that had existed under Ley 33 de 1985, Ley 71 de 1988, and sector-specific decrees.

For workers in the AFP regime, the early pension application process involves three stages: first, requesting a saldo proyectado (projected account balance) from the AFP showing the expected monthly pension achievable with the current balance; second, comparing the projected pension against the 110% SMMLV threshold; and third, submitting the formal pensión anticipada application with the supporting documentation package. The AFP has 30 business days (días hábiles) from receipt of a complete application to issue a resolution recognizing or denying the pension under Código de Procedimiento Administrativo y de lo Contencioso Administrativo (CPACA — Ley 1437 de 2011).

The Superintendencia Financiera de Colombia (SuperFinanciera) supervises private AFPs under Decreto 663 de 1993 (Estatuto Orgánico del Sistema Financiero) and issues Circulares Básicas Jurídicas and Financieras regulating pension recognition procedures.
