What Is a Disability Subsidy Claim EPS Colombia?

The Disability Subsidy Claim EPS Colombia (Reclamación de Incapacidad ante la EPS) is the formal written request a worker submits to their Entidad Promotora de Salud (EPS) to obtain payment of the disability subsidy (subsidio por incapacidad temporal) for days of certified medical leave due to common illness (enfermedad general) or non-occupational accident (accidente no laboral). The disability subsidy — called prestación económica por incapacidad temporal — is a cash benefit distinct from healthcare services, governed primarily by Article 206 of Ley 100 de 1993 and Articles 227–228 of the Código Sustantivo del Trabajo (CST).

In Colombia's social security system, when a worker is certified as temporarily incapacitated (incapacitado temporalmente) by their treating physician through an incapacidad médica (medical leave certificate), two separate obligations are triggered: (1) the healthcare obligation — the EPS must continue providing all necessary medical treatment at no additional cost to the worker; and (2) the economic obligation — the worker is entitled to a daily cash subsidy replacing their lost salary during the incapacity period. The economic obligation is shared between the employer (for the first two days) and the EPS (from day 3 onward), as established by Article 227 of the CST and Article 206 of Ley 100 de 1993.

Article 206 of Ley 100 de 1993 establishes that the EPS pays the subsidio por incapacidad temporal at 66.67% (two-thirds) of the worker's IBC (Ingreso Base de Cotización) from the third day of incapacity, for a maximum of 180 days. For the first two days, Article 227 of the CST requires the employer to pay the worker's full salary (100% of the ordinary salary). After 180 days of EPS-paid incapacity, if the worker has not recovered, the Sistema General de Riesgos Laborales (SGRL) through the ARL (for occupational incapacities) or the pension system through Colpensiones or the AFP (for non-occupational disabilities leading to pension claims) takes over. The EPS's obligation to pay the subsidy exists regardless of whether the employer has made timely PILA contributions — if the employer defaulted, the EPS still pays and pursues recovery from the employer through the UGPP.

Decreto 780 de 2016, the consolidated health sector regulatory decree, establishes in Article 2.1.3.4 the specific procedures for disability subsidy payment: the EPS must pay within 5 business days of receiving the valid incapacidad certificate; the worker may authorize the EPS to pay directly to their bank account or through the employer's payroll; and the EPS must issue a written payment confirmation (comprobante de pago) to the worker. Resolución 2266 de 1998 of the Ministerio de Salud established the standard incapacidad médica form used by all IPS and independent physicians in Colombia.

The legal framework governing the Disability Subsidy Claim EPS Colombia in Colombia draws on several key statutes and regulatory bodies. Under the Codigo Sustantivo del Trabajo (CST), Colombian employment law governs individual and collective labour relations. The Ministerio del Trabajo enforces compliance and issues regulations. The Sistema General de Seguridad Social (EPS, ARL, Fondo de Pensiones) provides health, occupational risk, and pension coverage. The Unidad de Gestion Pensional y Parafiscales (UGPP) audits employer contributions. The Caja de Compensacion Familiar administers family subsidy benefits. Parties executing a Disability Subsidy Claim EPS Colombia in Colombia should confirm the document reflects current law, including any amendments enacted since the original drafting date. The CST art. 227–228; Ley 100 de 1993 art. 206; Decreto 780 de 2016 art. 2.1.3.4 sets the foundational requirements.

When Do You Need a Disability Subsidy Claim EPS Colombia?

The Disability Subsidy Claim EPS Colombia must be filed in the following circumstances under Ley 100 de 1993, CST Articles 227–228, and Decreto 780 de 2016.

Medical Leave of 3 or More Days: When a treating physician at an EPS-affiliated IPS (clinic or hospital) has issued an incapacidad médica certificate for 3 or more calendar days due to common illness or non-occupational accident, and the employer has not automatically processed the subsidy payment through payroll, the worker must file this claim directly with the EPS.

EPS Non-Payment or Delayed Payment: When the EPS has not paid the disability subsidy within 5 business days after receiving a valid incapacidad médica certificate — in violation of Decreto 780 de 2016 Article 2.1.3.4 — the worker must file a formal claim to trigger the EPS's payment obligation and document the delay for a potential complaint to the Superintendencia Nacional de Salud.

Employer PILA Default: When the worker's employer has failed to pay PILA contributions and the EPS is initially refusing to pay the disability subsidy on grounds of contribution default, the worker must file this claim citing Article 206 of Ley 100 de 1993, under which the EPS is obligated to pay the worker and recover the amount from the defaulting employer through UGPP enforcement.

Extended Incapacity Beyond 90 Days: When the worker's incapacity has extended beyond 90 days and the EPS claims a PILA Certification of Contribution History is needed, or disputes the continuation of payment — the worker must formally document their claim to maintain the continuous subsidy payment chain up to the 180-day maximum.

Disagreement with Subsidy Calculation: When the EPS calculates the subsidy based on an incorrect IBC — for example, using a monthly IBC lower than the worker's actual salary — the worker must file a correction claim with evidence of the correct IBC from recent PILA records or employer salary certificates.

Parties in Colombia should prepare a Disability Subsidy Claim EPS Colombia proactively rather than waiting for a dispute to arise. Courts interpret agreements based on the written terms rather than oral representations. Under the Codigo Sustantivo del Trabajo (CST), Colombian employment law governs individual and collective labour relations. The Ministerio del Trabajo enforces compliance and issues regulations. The Sistema General de Seguridad Social (EPS, ARL, Fondo de Pensiones) provides health, occupational risk, and pension coverage. The Unidad de Gestion Pensional y Parafiscales (UGPP) audits employer contributions. The Caja de Compensacion Familiar administers family subsidy benefits. Where the transaction involves regulated activities, prior approval from the relevant authority may be required before execution.

What to Include in Your Disability Subsidy Claim EPS Colombia

A complete Disability Subsidy Claim EPS Colombia under Ley 100 de 1993, CST Articles 227–228, and Decreto 780 de 2016 must include the following essential elements.

Worker Identification: Full legal name; cédula de ciudadanía number; EPS name and affiliation number; employer name and NIT; employment start date; and current monthly salary (salario mensual) and IBC (Ingreso Base de Cotización) as reported in the most recent PILA.

Incapacidad Certificate Details: The original or certified copy of the incapacidad médica certificate issued by the treating physician or IPS, showing: the worker's name and document number; the treating physician's name, medical license number (registro médico), and IPS name; the diagnosis (ICD-10 code and plain-language description); the incapacity start date and end date; the total number of incapacity days; and the physician's signature and IPS stamp.

Subsidy Calculation: The worker's calculation of the expected subsidy amount — showing: the IBC (monthly), divided by 30 to obtain the daily rate, multiplied by 66.67%, multiplied by the number of days of EPS-responsible incapacity (from day 3 onward). Example: IBC COP 2,000,000 ÷ 30 = COP 66,667/day × 66.67% = COP 44,445/day × 30 days of EPS responsibility = COP 1,333,350 for a 32-day incapacity (with 2 days employer-paid).

PILA Contribution History: A summary of PILA contributions for the last 6 months confirming the worker has met the minimum contribution requirements — under Article 156 of Ley 100 de 1993, at least 4 weeks of contribution are required before the incapacity starts to trigger EPS payment obligation.

Bank Account or Payment Method: The worker's preferred payment method — direct bank transfer (consignación bancaria) to a specified account number and bank; or payment through the employer's payroll (nómina) for forwarding to the worker. The EPS is required to pay within 5 business days of receiving the claim under Decreto 780 de 2016.

Request for Continuation: If the incapacity has been extended by a second medical certificate (prórroga de incapacidad), the claim should include all sequential certificates and request continuous uninterrupted payment through the extended period, up to the 180-day maximum.

Documentation for Claims Beyond 180 Days: If the incapacity is approaching or exceeding 180 days and recovery is uncertain, the claim should include a request for: referral to the Junta de Calificación de Invalidez for PCL assessment; and notification to Colpensiones or the AFP to begin the disability pension evaluation process under Article 38 of Ley 100 de 1993.
