CUARTA. — DERECHOS MORALES

De conformidad con el Artículo 30 de la Ley 23 de 1982 y el Artículo 11 de la Decisión Andina 351 de 1993, los derechos morales del autor son inalienables, imprescriptibles, irrenunciables y perpetuos. La presente cesión no incluye ni puede incluir los derechos morales, los cuales permanecen con el autor persona natural.

EL CESIONARIO se obliga a respetar el derecho de paternidad (atribución al autor) y el derecho de integridad (no realizar modificaciones que perjudiquen el honor o la reputación del autor) en toda explotación de la obra.

c) Los derechos no han sido previamente cedidos ni gravados a favor de terceros.

d) No existen reclamaciones de terceros pendientes contra la obra.

e) Mantendrá indemne al CESIONARIO frente a cualquier reclamación derivada del incumplimiento de estas garantías.

SÉPTIMA. — REGISTRO ANTE LA DNDA

Las partes acuerdan registrar la presente cesión ante la Dirección Nacional de Derecho de Autor (DNDA) del Ministerio del Interior, para efectos probatorios y de oponibilidad frente a terceros. Los costos de registro serán asumidos por EL CESIONARIO.

OCTAVA. — LEY APLICABLE Y JURISDICCIÓN

El presente contrato se rige por la Ley 23 de 1982, la Decisión Andina 351 de 1993, el Código Civil (Ley 57 de 1887), y demás normas aplicables de la República de Colombia. Las controversias se someterán a los Juzgados Civiles del Circuito competentes, previa conciliación ante centro autorizado conforme a la Ley 640 de 2001.

What Is a Copyright Assignment Colombia (Contrato de Cesion de Derechos de Autor)?

A Copyright Assignment Colombia (Contrato de Cesion de Derechos de Autor) is a legal instrument through which the author or copyright holder (cedente or assignor) transfers economic rights (derechos patrimoniales) over a creative work to another party (cesionario or assignee), governed by Ley 23 de 1982 (Ley de Derechos de Autor) Article 77 and Decision Andina 351 de 1993 (Regimen Comun sobre Derecho de Autor y Derechos Conexos of the Comunidad Andina), while moral rights (derechos morales) remain inalienably with the natural person author.
