La presente solicitud se funda en los Artículos 224, 225, 226 y 227 del Código Civil; en el Artículo 48 de la Ley 19.968 de Tribunales de Familia; en el principio del interés superior del niño del Artículo 16 de la Ley 19.968 y el Artículo 3(1) de la Convención de las Naciones Unidas sobre los Derechos del Niño (Decreto N.° 830/1990); y en los Artículos 55–67 de la Ley 19.968 que regulan el procedimiento ordinario ante el Tribunal de Familia.

Article 225 of the Código Civil establishes that when parents live separately, the child's personal care corresponds to the parent with whom the child lives — effectively creating a de facto primary custody arrangement based on residence.
