II. AUTORIZACIÓN DE DESCUENTO (ARTÍCULO 58 CÓDIGO DEL TRABAJO)

El/la Trabajador/a, en virtud del Artículo 58 inciso 2 del Código del Trabajo de Chile, autoriza voluntariamente al Empleador a descontar de su remuneración mensual los montos señalados a continuación, para ser remitidos al Beneficiario identificado en la sección I.

El/la Trabajador/a y el Empleador declaran que el monto total de los descuentos obligatorios (cotizaciones previsionales AFP reguladas por la Superintendencia de Pensiones, cotización de salud FONASA o ISAPRE regulada por la Superintendencia de Salud, impuesto único a la renta) más los descuentos voluntarios autorizados no excede el 45% de la remuneración bruta mensual del/de la Trabajador/a, conforme al Artículo 58 inciso 3 del Código del Trabajo.

El/la Trabajador/a declara que esta autorización es otorgada voluntariamente, sin presión ni coacción del Empleador, conforme al Artículo 5 del Código del Trabajo (derechos irrenunciables) y al Ordinario DT N.° 3.148/054 de la Dirección del Trabajo.

REVOCACIÓN: El/la Trabajador/a podrá revocar la presente autorización en cualquier momento mediante notificación escrita al Empleador. El Empleador cesará el descuento en el período de nómina siguiente a la recepción del aviso de revocación. La revocación de esta autorización no extingue la obligación subyacente con el Beneficiario, la que deberá ser solucionada por otros medios.

El Empleador se compromete a remitir los montos descontados al Beneficiario dentro de los plazos establecidos en el Artículo 19 del Código del Trabajo y las instrucciones del Beneficiario, y a conservar la presente autorización en la carpeta laboral del/de la Trabajador/a.

What Is a Payroll Deduction Authorization Chile?

Payroll Deduction Authorization Chile (Autorización de Descuento por Planilla) is a written authorization document governed by Código del Trabajo (CT) Article 58, by which a dependent worker (trabajador dependiente) voluntarily authorizes their employer (empleador) to deduct a specified amount or percentage from their monthly salary (remuneración) to be remitted to a named third party or retained for a defined purpose. Article 58 of the Código del Trabajo establishes that employers can only make deductions from workers' salaries in specific circumstances — mandatory legal deductions (cotizaciones previsionales, cotizaciones de salud, impuesto único a la renta) and voluntary deductions authorized in writing by the worker.

Article 58 inciso 2 of the Código del Trabajo allows voluntary salary deductions (descuentos voluntarios) for the following purposes authorized by the worker in writing: payment of quotas owed to cooperatives (cuotas de cooperativas); union membership fees or association dues (cuotas sindicales); housing savings (ahorro habitacional); loan repayments to the employer (pago de mutuos al empleador); and any other purpose that the worker expressly authorizes in writing, subject to the limit established in Article 58 inciso 3 — voluntary deductions together with mandatory deductions cannot exceed 45% of the worker's monthly salary (remuneración bruta), except for exceptional situations authorized by the Dirección del Trabajo (DT).

The Dirección del Trabajo (DT) — Chile's labour inspectorate, operating under the Ministerio del Trabajo y Previsión Social — has issued numerous Ordinances (Ordinarios) clarifying the scope and limits of Article 58 CT. DT Ordinario N.° 3.148/054 of 2000 established that voluntary payroll deduction authorizations must be: in writing (por escrito); specific about the purpose, amount, and beneficiary; signed by the worker; and retained in the worker's file (carpeta del trabajador). The employer cannot change the deduction amount or beneficiary without a new authorization from the worker. A verbal authorization or a general employment contract clause purporting to authorize future unspecified deductions does not satisfy the Article 58 requirement.

The 45% salary deduction limit under Article 58 inciso 3 CT protects workers from excessive salary encumbrance. The Dirección del Trabajo has consistently interpreted this limit to apply to the worker's gross salary (remuneración bruta, before legal deductions) — so if a worker earns CLP 1,000,000 gross, the maximum combined deduction (including cotizaciones previsionales at AFP + cotización de salud at FONASA or ISAPRE + impuesto único where applicable) cannot exceed CLP 450,000. Any voluntary deduction that would cause the total to exceed 45% cannot be made without specific DT authorization. The worker retains the right to revoke any voluntary payroll deduction authorization at any time by written notice to the employer.

Mutual banks and cooperativas de ahorro y crédito (regulated by the División de Cooperativas of the Ministerio de Economía) routinely use Autorización de Descuento por Planilla agreements when granting consumer or mortgage loans to salaried workers — the authorization ensures the lender that loan repayments will be automatically deducted from the borrower's salary and remitted directly, reducing default risk. Cajas de Compensación de Asignación Familiar (CCAF) — regulated by the Superintendencia de Seguridad Social (SUSESO) — also use these authorizations for social benefits loans (créditos sociales) provided to affiliated workers.

When Do You Need a Payroll Deduction Authorization Chile?

A Payroll Deduction Authorization Chile under Código del Trabajo Article 58 is required in several common employment and financial contexts.

Employee loans from the employer: When an employer grants a personal loan (mutuo) to a worker — for example, an emergency advance (anticipo de remuneración) or a company-funded personal loan — Article 58 CT requires the worker's written authorization for the employer to deduct repayment installments from the salary. Without this authorization, the employer cannot make unilateral payroll deductions to recover the loan.

Cooperative savings and credit unions: Cooperativas de ahorro y crédito — such as Coopeuch (Chile's largest credit cooperative, regulated by the División de Cooperativas of the Ministerio de Economía) — routinely require members who take consumer loans to authorize their employer to deduct loan installments from their payroll and remit them directly to the cooperative. This arrangement reduces administrative burden for the cooperative and provides repayment security.

Cajas de Compensación (CCAF) social loans: The four CCAFs operating in Chile — Caja Los Andes, Caja Los Héroes, Caja 18 de Septiembre, and Caja Bio-Bio — provide social benefit loans (créditos sociales) to affiliated workers, and universally require a payroll deduction authorization signed by the worker and acknowledged by the employer as a precondition for loan disbursement. SUSESO (Superintendencia de Seguridad Social) oversees CCAF lending practices.

Union membership fees: Under CT Article 262 and the broader Derecho Sindical framework, union membership fees (cuotas sindicales) can be deducted from a union member's salary at the written request of the worker. The worker must authorize the deduction per Article 58, and the authorization can be revoked by the worker at any time with written notice.

Housing and mortgage savings: Workers saving for housing through Serviu (Servicio de Vivienda y Urbanización) or private savings plans (ahorro habitacional programado at banks regulated by the CMF) may authorize their employer to deduct the monthly savings contribution and remit it directly to the housing savings account.

What to Include in Your Payroll Deduction Authorization Chile

A valid Payroll Deduction Authorization Chile under Código del Trabajo Article 58 must include the following essential elements to be legally effective and accepted by employers, the Dirección del Trabajo (DT), and beneficiary institutions such as CCAFs and cooperativas:

Identification of the Worker (Identificación del Trabajador): Full legal name, RUT, nationality, marital status, and domicile of the employee authorizing the deduction. Include the worker's job title (cargo) and the date they commenced employment (fecha de ingreso) to correctly identify the employment relationship governed by the contrato de trabajo.

Identification of the Employer (Identificación del Empleador): Full legal name or razón social, RUT, legal address, and name and RUT of the legal representative (representante legal) or HR manager (jefe de recursos humanos) who will process the deduction. Include the company's main economic activity (giro comercial) and municipality of the workplace.

Identification of the Beneficiary (Identificación del Beneficiario): Full name and RUT (or legal name and RUT for entities) of the person or institution to whom the deducted amount will be remitted — the lending CCAF, cooperativa, bank, union, employer, or other beneficiary. Include the beneficiary's account number (número de cuenta) or account details to which funds will be transferred (RUT, type of account, bank name regulated by the CMF).

Amount and Nature of Deduction (Monto y Naturaleza del Descuento): The precise peso amount (in Chilean pesos — CLP) or percentage of gross salary to be deducted each pay period. The deduction description must identify the specific obligation being paid — loan installment (cuota de crédito), cooperative quota (cuota cooperativa), union dues (cuota sindical), housing savings (ahorro habitacional), or other. If the amount varies (for loans with variable installments), a schedule or formula must be included.

Duration of Authorization (Vigencia de la Autorización): The start date of the first deduction and either the end date (when the loan will be fully repaid or the authorization expires) or the number of installments (número de cuotas). The DT and courts have held that a permanent open-ended authorization without any termination mechanism is contrary to the worker's right to revoke at any time under Article 58.

Revocation Clause (Cláusula de Revocación): A statement confirming the worker's right to revoke the authorization at any time by written notice to the employer, consistent with DT Ordinario N.° 3.148/054 and Article 58 CT. The notice period for revocation (typically 30 days to allow for payroll processing) should be specified. Upon revocation, the employer must cease the deduction in the next pay period following receipt of the revocation notice.

Capacity Limit Acknowledgment (Reconocimiento del Límite de Capacidad): Acknowledgment by both the worker and employer that the combined voluntary and mandatory deductions do not exceed 45% of the worker's gross monthly salary under Article 58 inciso 3 CT. Both parties should confirm that the deduction level is within the legal limit at the time of signing.

Worker's Voluntary Signature (Firma Voluntaria del Trabajador): The worker's signature confirming that the authorization is voluntary and made without coercion, along with the date and place of signing. The Dirección del Trabajo has consistently held that payroll deduction authorizations signed under pressure or as a condition of employment are void under Article 5 CT (prohibition of employer coercion) and Article 58.

Employer Acknowledgment (Conocimiento del Empleador): The employer's signature (through the legal representative or authorized HR officer) acknowledging receipt of the authorization and committing to process the deductions as specified. Without employer acknowledgment, third-party beneficiaries (CCAFs, cooperativas) may not accept the authorization as sufficient commitment from the employer.
