What Is a Healthcare Power of Attorney Chile (Mandato de Cuidados Médicos)?

Mandato de Cuidados Médicos Chile is a legal document governed by Articles 14 through 16 of Ley N° 20.584 — the Ley sobre Derechos y Deberes que tienen las Personas en Relación con Acciones Vinculadas a su Atención en Salud (2012) — and by the general mandato (agency) rules of the Código Civil de Chile Articles 2116 to 2173, through which a principal (mandante) grants specific authority to a designated agent (mandatario) to make healthcare and medical decisions on the principal's behalf when the principal lacks the capacity to do so personally.

Article 14 of Ley N° 20.584 establishes that every person has the right to be treated with dignity (trato digno) and to have their autonomy respected throughout medical care. Article 16 recognizes the right to designate, in advance, a person to act as the patient's representative for healthcare decisions when the patient cannot communicate their own wishes. The Reglamento de la Ley N° 20.584 (Decreto Supremo N° 31 de 2012 del MINSAL) details the procedural requirements for designating such a representative.

The mandato de cuidados médicos differs from a simple voluntades anticipadas declaration: while the voluntades anticipadas records the patient's own stated preferences, the mandato de cuidados médicos grants the mandatario legal authority (poder legal) to interpret, supplement, and act upon those preferences in real-time clinical situations that may not have been specifically anticipated. The mandatario can consult with treating physicians, review the ficha clínica (medical record), authorize or refuse specific procedures, and communicate with insurance entities (FONASA or ISAPRE) on the patient's behalf.

The mandato is governed by the Código Civil provisions on mandato (Arts. 2116–2173), which establish the scope of authority, duties of care and loyalty (diligencia y fidelidad), and the circumstances under which the mandato terminates — including the death of the mandante, revocation (revocación) by the mandante while competent, and the mandatario's inability or unwillingness to act (renuncia). For healthcare mandatos, the courts and MINSAL apply Article 14 of Ley N° 20.584 to limit the mandatario's authority to actions consistent with the patient's best interests and documented values.

Hospitals and clínicas within the Red Asistencial del SNSS, as well as private healthcare facilities accredited by the Superintendencia de Salud, are required to recognize and act upon a validly executed mandato de cuidados médicos. The Colegio Médico de Chile's clinical ethics guidelines and the Comités de Ética Clínica of major health institutions (Hospital Clínico Universidad de Chile, Pontificia Universidad Católica, Hospital del Salvador, and others) treat the mandatario as the legitimate spokesperson for the incapacitated patient.

When Do You Need a Healthcare Power of Attorney Chile (Mandato de Cuidados Médicos)?

A mandato de cuidados médicos is needed whenever a person wishes to designate a specific individual — rather than leaving medical decisions to default legal next-of-kin rules or institutional committees — to make healthcare decisions on their behalf during incapacity.

Adults undergoing elective surgery (cirugía electiva) with significant complication risks — cardiac bypass, organ transplant, neurosurgery, or complex oncological procedures at hospitals like Hospital Clínico de la Pontificia Universidad Católica, Hospital del Salvador, or Clínica Las Condes — should execute a mandato de cuidados médicos before admission to ensure their designated person can communicate with the surgical team and authorize emergency interventions without delay.

Persons in committed relationships who are not legally married and not in a registered Acuerdo de Unión Civil (AUC) under Ley N° 20.830 lack automatic next-of-kin rights under Chilean law — their partner has no legal standing to make medical decisions without a mandato. Same-sex couples and cohabiting partners (convivientes de hecho) are particularly vulnerable to exclusion from medical decision-making without this document.

Elderly persons with early-stage cognitive decline or a family history of Alzheimer's disease, vascular dementia, or Parkinson's disease should execute the mandato while they have full legal capacity, designating a trusted family member or professional caregiver to handle medical decisions in the future without the need for judicial incapacitation proceedings (juicio de interdicción) before the Juzgado de Letras en lo Civil.

Frequent travelers or expatriate Chileans who spend extended periods abroad should execute a mandato de cuidados médicos, particularly for elderly relatives remaining in Chile, to ensure a Chilean-resident agent can act immediately in a medical emergency without waiting for the traveler's return or international power of attorney certification through the Chilean consular network.

Parents of adult children with intellectual disabilities, chronic mental illness, or severe physical conditions who are legally competent but may lack practical capacity to navigate the FONASA/ISAPRE system, hospital admission procedures, or complex treatment decisions should facilitate the execution of a mandato designating the parent or another trusted person as the agent for healthcare purposes.

What to Include in Your Healthcare Power of Attorney Chile (Mandato de Cuidados Médicos)

A valid mandato de cuidados médicos under Ley N° 20.584 Arts. 14–16 and CC Arts. 2116–2173 must contain the following essential components:

Identification of the Principal (Mandante): Full legal name, RUT, nationality, date of birth, domicile, and marital status of the mandante. The mandante must be a legally competent adult (mayor de edad con plena capacidad legal) at the time of execution. The notary certifies this capacity.

Identification of the Agent (Mandatario): Full legal name, RUT, domicile, relationship to the principal, and contact details (phone, email) of the mandatario. The mandatario should be a person who can realistically be present in Chile when needed — a close family member, trusted friend, or professional (abogado, asistente social).

Alternate Agent (Mandatario Sustituto): Designation of a substitute agent (mandatario sustituto) in case the primary mandatario is unavailable, unable, or unwilling to act. The substitute's full identity and contact details must be included.

Scope of Authority (Alcance del Mandato): An express and specific enumeration of the healthcare decisions the mandatario is authorized to make. Standard authorities include: (a) Access to medical records (ficha clínica) under Ley N° 20.584 Art. 12; (b) Authorization of surgical procedures (autorización de intervenciones quirúrgicas); (c) Authorization or refusal of life-sustaining treatments including mechanical ventilation, CPR, dialysis, and artificial nutrition; (d) Selection of attending physicians (médicos tratantes), hospitals (establecimientos de salud), and specialists; (e) Consent to or refusal of clinical trials (ensayos clínicos) conducted under MINSAL and ISP oversight; (f) Coordination with FONASA or ISAPRE regarding coverage, benefits, and authorizations (bonos, autorizaciones de prestaciones); (g) Transfer between healthcare facilities (traslados entre establecimientos de salud).

Limitations on Authority (Limitaciones del Mandato): Specific acts the mandatario is NOT authorized to perform — such as consenting to experimental procedures not approved by the ISP, authorizing euthanasia, or making financial decisions unrelated to healthcare. The Código Civil Article 2167 requires that special powers be express for acts beyond ordinary administration.

Durability of the Mandate (Vigencia del Mandato): Whether the mandato takes effect immediately upon execution or only upon certified medical incapacity (incapacidad médicamente certificada) — typically by two independent physicians or by the treating physician in writing in the ficha clínica. A durable mandate (mandato durable) remains effective through incapacity; a springing mandate activates only upon incapacity.

Link to Voluntades Anticipadas: Reference to any existing voluntades anticipadas declaration the mandatario must respect and implement — the mandatario's authority to make decisions must be exercised consistently with the principal's documented wishes, not as a substitute for them.

Notarial Authentication: Execution before a notario público under CC Article 1699, which creates an instrumento público with full evidentiary force before all Chilean authorities, hospitals, and healthcare institutions. The notary's certificate of identity and capacity of the mandante is essential for the document's recognition by healthcare providers.

Revocation Mechanism (Mecanismo de Revocación): An express statement that the mandante may revoke the mandato at any time while competent, by written notice (notificación escrita) to the mandatario and to any healthcare institution with a copy on file. Revocation may be executed before a notary for maximum enforceability under CC Article 2164.
