IV. PLAZO PARA EJERCER EL DERECHO DEL TANTO

El arrendatario dispone de 30 (treinta) días naturales contados a partir de la fecha de recepción del presente aviso para ejercer su derecho del tanto, es decir, hasta el día [Exercise Deadline].

Para ejercer el derecho, el arrendatario deberá remitir por escrito su aceptación irrevocable al precio y condiciones arriba señalados, enviando dicho escrito al siguiente domicilio o mediante correo certificado con acuse de recibo: [Acceptance Address].

La aceptación debe ser por escrito y recibida dentro del plazo de 30 días — la aceptación verbal no es suficiente. Una aceptación condicional que introduzca nuevas condiciones no constituye ejercicio válido del derecho del tanto.

Si el arrendatario no ejerciere su derecho dentro del plazo indicado, el arrendador quedará en libertad de enajenar el inmueble al comprador propuesto u otro tercero, en los mismos términos y condiciones señalados en este aviso. Cualquier venta a precio inferior o en condiciones más favorables para el tercero requerirá un nuevo aviso al arrendatario conforme al Artículo 2448-J CCF.

La omisión o incumplimiento de este aviso otorga al arrendatario el derecho de retracto contemplado en el Artículo 2448-K CCF, ejercible ante el Juzgado Civil competente dentro de los 30 días naturales siguientes a que el arrendatario tenga conocimiento de la venta no autorizada.

An Aviso de Derecho del Tanto al Arrendatario Mexico is a formal written notice that a landlord (arrendador) of a rented residential property must deliver to the sitting tenant (arrendatario) before selling or transferring the property, informing the tenant of the price, terms, and conditions of the proposed sale and granting the tenant a preferential right to purchase the property on those same terms — a right known in Mexican civil law as the derecho del tanto or tanteo, governed by Artículos 2448-J and 2448-K of the Código Civil Federal (CCF) and the corresponding provisions of state civil codes for federally-applicable residential leases.
