What Is a Rent Increase Notice Mexico (Aviso de Aumento de Renta)?

A Rent Increase Notice Mexico (Aviso de Aumento de Renta) is a formal written communication from a landlord (arrendador) to a tenant (arrendatario) notifying the tenant of an upcoming increase in the monthly rent (renta mensual) payable under an existing arrendamiento contract, governed by the Código Civil Federal (CCF) and specifically by Article 2448-D applicable to residential leases in Mexico City and provisions of equivalent state civil codes that restrict or regulate rent increases in residential tenancies across the Mexican republic.

Article 2448-D of the Código Civil Federal — which applies as the Código Civil para la Ciudad de México following the constitutional transformation of the Distrito Federal — provides that residential rents (rentas de inmuebles destinados a habitación) may only be increased once per year, and that any increase must not exceed the percentage increase in the Índice Nacional de Precios al Consumidor (INPC) published by the Instituto Nacional de Estadística y Geografía (INEGI) for the twelve-month period immediately preceding the increase date. This INPC-indexed cap applies to residential leases in Mexico City and has been adopted in varying forms by multiple state civil codes.

For residential leases not subject to the Mexico City CDMX restrictions — including leases in states such as Jalisco, Nuevo León, Guanajuato, and Quintana Roo — the CCF Articles 2448 through 2452 provide the general framework for rent increases. In these states, the arrendamiento contract itself typically governs the increase mechanism — whether tied to the INPC published by INEGI, a fixed annual percentage agreed by the parties, or subject to renegotiation upon each annual renewal. The Aviso de Aumento de Renta documents the agreed or statutory increase calculation and provides the tenant with the required advance notice period.

For commercial leases (arrendamiento de locales comerciales) in Mexico, rent increases are governed exclusively by the contractual terms — the CCF Article 2448-D restrictions on annual INPC-indexed increases apply only to residential leases (casa habitación). Commercial rents may therefore be increased by any amount agreed in the arrendamiento comercial contract, provided the landlord gives the contractually stipulated advance notice. In practice, commercial leases in Mexico commonly include a clause providing for annual rent adjustments equal to the INPC variation plus a fixed premium (prima) negotiated between the parties.

The Aviso de Aumento de Renta must be served in advance of the effective date of the increase — the minimum advance notice period is generally the rent payment period (for monthly leases, 30 calendar days before the new rent takes effect). Best practice among Mexican landlords and real estate professionals affiliated with the Asociación Mexicana de Profesionales Inmobiliarios (AMPI) is to serve the notice 60 days in advance to allow the tenant time to accept the new rent, negotiate, or provide notice of termination if the increase is unacceptable.

From the SAT (Servicio de Administración Tributaria) perspective, a rent increase requires the landlord to update their CFDI (Comprobante Fiscal Digital por Internet) billing records to reflect the new rent amount. Each monthly rent payment under the new amount requires a new CFDI issued at the higher figure — failure to issue CFDIs for the increased amount constitutes a tax infraction under Article 83 of the Código Fiscal de la Federación (CFF). The landlord's provisional ISR payments under the Ley del Impuesto sobre la Renta Article 114 must also be recalculated to reflect the higher rental income.

When Do You Need a Rent Increase Notice Mexico (Aviso de Aumento de Renta)?

An Aviso de Aumento de Renta Mexico is required whenever a landlord wishes to adjust the monthly rent payable by a tenant — whether the increase is mandated by the terms of the existing arrendamiento contract, linked to the INPC published by INEGI, or agreed between the parties at annual renewal.

The notice is required when the lease agreement includes an annual rent adjustment clause (cláusula de ajuste anual) linked to the INPC or a fixed percentage. Even where the contract specifies the increase mechanism, Mexican courts have held that the landlord must still serve a written Aviso de Aumento de Renta stating the specific new amount before the new rent becomes payable — the tenant cannot be required to pay a higher rent without explicit written notification of the exact figure.

The Aviso is needed when a fixed-term lease (plazo forzoso) expires and the parties are renewing for a new period at a higher rent. At lease renewal, the new rent must be agreed in writing — the Aviso de Aumento de Renta serves as the landlord's written proposal which, if accepted by the tenant continuing in occupation, constitutes the agreed new rent for the renewal term.

For residential leases in Mexico City, the notice is required to document compliance with the CCF Article 2448-D annual increase cap. The landlord must calculate the INPC variation published by INEGI for the relevant 12-month period and must show in the notice that the proposed increase does not exceed this statutory ceiling. If the landlord proposes an increase exceeding the INPC cap for a CDMX residential lease, the tenant may legally refuse to pay the excess above the statutory limit.

The Aviso is also required for SAT compliance — updating CFDI billing to reflect the new rent amount requires documentation of the increase and its effective date. Landlords reporting rental income under LISR Article 114 to the SAT must ensure their monthly provisional ISR payments reflect the new higher income figure from the effective date of the increase.

Landlords renting through real estate platforms or professional property managers (administradores de inmuebles) must ensure rent increase notices comply with both the contractual terms and any applicable state restrictions before adjusting rent. A properly documented Aviso de Aumento de Renta protects the landlord by establishing the date and amount of the increase in the event of a subsequent dispute about unpaid differential rent.

What to Include in Your Rent Increase Notice Mexico (Aviso de Aumento de Renta)

A valid Aviso de Aumento de Renta Mexico under the Código Civil Federal and applicable state civil codes must contain the following elements to provide legally sufficient notice of a rent increase and to support enforcement in the event the tenant disputes the new amount.

Party Identification: Full name and RFC of both the arrendador and arrendatario, plus the address of the leased property and a reference to the original arrendamiento contract (date, term, and notarial folio if applicable) to connect the notice to the specific tenancy.

Current Rent Amount: The existing monthly rent in MXN (Mexican pesos), as specified in the current arrendamiento contract or the last Aviso de Aumento de Renta, together with the effective date from which that amount has been payable.

Increase Calculation Basis: A clear statement of the legal or contractual basis for the increase — for INPC-indexed increases, the specific INPC figure published by INEGI for the reference twelve-month period, the percentage variation calculated, and the resulting new rent amount. For fixed-percentage increases, the agreed rate and the resulting new rent. This transparency is required under CCF Article 2448-D for residential leases in Mexico City.

New Monthly Rent Amount: The new monthly rent expressed in MXN — the precise figure the tenant must pay from the effective date. Mexican law prohibits denominating residential rents in foreign currency for principal residences under CCF Article 2431, so the new amount must be stated in pesos.

Effective Date of Increase: The specific calendar date from which the new rent applies — typically the first day of the month following the required advance notice period. The effective date must be at least 30 days after the date the notice is served, or such longer period as specified in the arrendamiento contract.

Payment Instructions: Confirmation of the accepted payment method (SPEI transfer, OXXO reference, deposit) and banking or payment details for remitting the new rent amount. If the payment account has changed, the new bank account CLABE (Clave Bancaria Estandarizada) and beneficiary name must be provided.

CFDI Billing Confirmation: A statement confirming that the landlord will continue to issue CFDI electronic invoices for each rent payment at the new amount, in compliance with SAT requirements under the Código Fiscal de la Federación.

Statutory Compliance Statement: For Mexico City residential leases, a declaration that the proposed increase does not exceed the INPC variation published by INEGI for the applicable 12-month reference period, confirming compliance with CCF Article 2448-D. For other states, reference to the applicable state civil code provision or contract clause authorising the increase.

Tenant Acceptance or Objection Period: A stated period — typically 15 calendar days from receipt of the notice — within which the tenant may accept the new rent in writing, propose a counter-adjustment, or serve notice of intent to terminate the lease if the increase is unacceptable. After this period, continued occupation and payment of rent constitutes implied acceptance.

Forms-legal.com provides this Aviso de Aumento de Renta Mexico template to help landlords document rent increases in compliance with the CCF and applicable state civil codes. Landlords with residential property in Mexico City must verify the current INPC figure published by INEGI before calculating increases to comply with Article 2448-D. Consultation with a Licenciado en Derecho familiar with the applicable state's arrendamiento provisions is recommended for commercial lease increase notices where contractual terms may be more complex.
