What Is a Construction Permit Application Mexico (Solicitud de Permiso de Construcción)?

A Construction Permit Application Mexico (Solicitud de Permiso de Construcción o Licencia de Construcción) is the formal administrative request filed by a property owner (propietario), developer (desarrollador), or their authorized representative with the Dirección de Obras Públicas, Dirección de Desarrollo Urbano, or equivalent municipal or alcaldía-level authority to obtain legal authorization to build, expand, remodel, demolish, or change the use of a structure or land within a Mexican municipality. The overarching federal legal framework is established by the Ley General de Asentamientos Humanos, Ordenamiento Territorial y Desarrollo Urbano (LGAHOTDU), published in the Diario Oficial de la Federación on 28 November 2016 and replacing the previous Ley General de Asentamientos Humanos of 1993. Article 65 LGAHOTDU establishes that development and construction activities that modify the territory, change land use classifications, or alter existing structures require prior authorization from the competent municipal authority in accordance with applicable urban development plans (planes de desarrollo urbano) and local construction regulations.

The constitutional foundation for land use regulation and construction permitting in Mexico is Article 27 of the Constitución Política de los Estados Unidos Mexicanos, which vests original ownership of all national territory in the Mexican nation and authorizes the state to impose the conditions and requirements (modalidades) on private property necessary to protect the public interest (utilidad pública). Article 73 Constitucional grants Congress the power to establish a national framework for human settlements — exercised through the LGAHOTDU — while Article 115 Constitucional grants municipalities (municipios libres) constitutional autonomy to administer land use within their territory, collect development fees (derechos urbanísticos), and issue construction permits in accordance with state and federal law.

Each of Mexico's 2,469 municipalities has its own Reglamento de Construcción (construction regulations) or Reglamento de Edificaciones specifying the technical and administrative requirements for construction permits within its jurisdiction. The most comprehensive and widely referenced is the Reglamento de Construcciones para el Distrito Federal (RCDF), now applicable to Mexico City's 16 alcaldías and maintained by the Secretaría de Obras e Infraestructura (SOBSE), which establishes detailed structural, safety, accessibility, and environmental standards for construction in Mexico City. Many municipalities in Mexico State, Jalisco, Nuevo León, and other states have adopted regulations modeled on the RCDF or on the Modelo de Reglamento de Construcción for Municipalities published by SEDATU (Secretaría de Desarrollo Agrario, Territorial y Urbano).

A construction permit (licencia de construcción or permiso de construcción) is distinct from, and often preceded by, a certificado de uso de suelo (land use certificate) — the official document confirming that the intended construction type is consistent with the applicable urban zoning plan (plan parcial de desarrollo urbano) for the specific plot. LGAHOTDU Article 65 prohibits the issuance of construction permits for uses inconsistent with the designated land use, making the uso de suelo certificate the legal prerequisite for the construction permit application. Major developments also require an Manifestación de Impacto Ambiental (MIA) under the Ley General del Equilibrio Ecológico y la Protección al Ambiente (LGEEPA) before the Secretaría de Medio Ambiente y Recursos Naturales (SEMARNAT) when projects exceed thresholds for environmental impact assessment.

When Do You Need a Construction Permit Application Mexico (Solicitud de Permiso de Construcción)?

A Construction Permit Application Mexico is required under LGAHOTDU Article 65 and applicable municipal construction regulations before commencing any construction, expansion, remodeling, demolition, or change of use affecting a structure or parcel of land in any Mexican municipality. Proceeding without a valid licencia de construcción exposes the owner and contractor to significant legal, financial, and safety consequences.

The permit is needed for new construction (obra nueva) — building a new structure of any type: residential house (casa habitación), commercial building, industrial warehouse (bodega industrial), or multi-unit development (conjunto habitacional or condominio). Regardless of structure size or cost, new construction requires a permit; some municipalities allow simplified permit procedures (permiso simplificado or aviso de construcción) for small residential extensions below specified floor area thresholds, but even these require official notification.

The application is required for ampliación (expansion) — adding floor area to an existing structure, constructing additional rooms, enclosing a terrace, or extending a building footprint. All ampliación work must comply with current construction regulations even if the original structure was built under older rules, which can require structural upgrades (refuerzo estructural) to meet current seismic design standards under the updated RCDF seismic design norms.

Remodelación (remodeling) that involves structural changes — such as removing or adding load-bearing walls (muros de carga), modifying foundations, changing the structural system, or altering the building's façade — requires a permit. Cosmetic interior finishes (pintura, recubrimientos) typically do not require permits in most municipalities, but electrical and plumbing modifications that affect the building's technical installations do in most cases.

Demolición (demolition), whether full or partial, requires an advance permit (licencia de demolición) separate from the construction permit, to ensure structural safety during the process, protect adjacent properties, and comply with waste disposal regulations under NOM-161-SEMARNAT-2011.

Cambio de uso de suelo (change of land use) — converting a residential property to commercial, or a commercial space to industrial — requires a new permit and, in most cases, a favorable dictamen de uso de suelo from the municipal Dirección de Desarrollo Urbano confirming the intended use is compatible with the applicable zoning plan. This process can be lengthy and may require a public hearing (audiencia pública) under LGAHOTDU Article 69 when the proposed change affects the character of the neighborhood.

What to Include in Your Construction Permit Application Mexico (Solicitud de Permiso de Construcción)

A valid Construction Permit Application Mexico under LGAHOTDU art. 65 and the applicable municipal Reglamento de Construcción must contain the following essential elements for the Dirección de Obras Públicas to conduct the technical review and issue the licencia de construcción.

The Notario Público–certified identity of the property owner must match the name in the Registro Público de la Propiedad.

Property Identification: Complete property address (calle, número exterior e interior, colonia, municipio or alcaldía, estado, código postal); cadastral key (clave catastral) assigned by the municipal Catastro office; property lot area (superficie del terreno in square metres); and current land use designation (uso de suelo vigente) as shown in the certificado de uso de suelo. For properties in condominiums (régimen de propiedad en condominio), the percentage of undivided common area ownership (porcentaje de indiviso) must be stated.

Proof of Ownership: Original or notarized copy of the escritura pública (notarized deed) or titulo de propiedad registered at the Registro Público de la Propiedad, with the up-to-date folio real number showing no encumbrances (certificado de libertad de gravamen issued within the previous 90 days). Where ownership is in dispute or multiple owners exist, a copy of the agreement authorizing construction signed by all co-owners may be required.

Certificado de Uso de Suelo: The official land use certificate (certificado de uso de suelo or constancia de zonificación) confirming that the proposed construction type and use are compatible with the applicable plan parcial de desarrollo urbano or plan de desarrollo urbano municipal. This document must be current (typically no more than 6–12 months old depending on the municipality).

Project Description and Technical Specifications: Complete architectural and structural project plans (planos arquitectónicos, estructurales, instalaciones hidrosanitarias, instalaciones eléctricas) prepared and signed by a licensed architect (arquitecto) or civil engineer (ingeniero civil) with Cédula Profesional issued by the Secretaría de Educación Pública (SEP) — professional license registration with the Dirección General de Profesiones is mandatory. Plans must comply with the applicable Reglamento de Construcción technical norms and, for seismically active zones, with the seismic design regulations (Normas Técnicas Complementarias para Diseño por Sismo — NTCDCS for Mexico City or equivalent state norms). Director Responsable de Obra (DRO): Identification and professional license number of the Director Responsable de Obra — the licensed professional (architect or engineer with cédula profesional) who assumes technical and legal responsibility for the construction project under RCDF Article 27 and equivalent state regulations. The DRO certifies compliance with all applicable norms, supervises the work, and is personally liable for construction defects under Código Civil Federal Articles 2616–2637 (obra a precio alzado). In Mexico City, the DRO must be registered on the RCDF DRO registry maintained by SOBSE; other municipalities maintain equivalent registries.

Payment of Construction Rights (Derechos de Construcción): Receipt of payment of the derechos de construcción — fees calculated by the municipal Tesorería based on total floor area and construction type. Fee schedules are established in each municipality's Ley de Ingresos or equivalent fiscal regulations.
