What Is a Declaration of Source of Funds Mexico?

A Declaration of Source of Funds Mexico (Declaración de Origen de Recursos) is a formal sworn statement (declaración bajo protesta de decir verdad) by which an individual (persona física) or legal entity (persona moral) certifies the lawful origin of resources (recursos de procedencia lícita) used in financial transactions, real estate operations, and other regulated activities in Mexico, as required by the Ley Federal para la Prevención e Identificación de Operaciones con Recursos de Procedencia Ilícita (LFPIORPI), published in the Diario Oficial de la Federación on 17 October 2012, specifically Article 18 which establishes the obligation of Actividades Vulnerables subjects to collect and maintain source of funds declarations from their clients.

LFPIORPI Article 18 mandates that obligated entities — known as sujetos obligados — who carry out Actividades Vulnerables (vulnerable activities) defined in LFPIORPI Article 17 must identify the beneficial owner (propietario real), the economic activity, and the source of resources of their clients or counterparties when transactions exceed the monetary thresholds established in LFPIORPI Article 17. Actividades Vulnerables include real estate transactions, financial services, notarial services, accounting and legal advisory services, gaming and lottery, and luxury goods trade — each with specific peso-denominated thresholds above which source of funds documentation is mandatory.

The Unidad de Inteligencia Financiera (UIF), a specialized unit within the Secretaría de Hacienda y Crédito Público (SHCP), is the competent authority responsible for receiving, analyzing, and disseminating financial intelligence on money laundering and terrorism financing under the LFPIORPI and its Reglamento published on 16 August 2013. The UIF maintains the Sistema de Portal en Línea (SIPOAL) through which sujetos obligados file Avisos de Actividades Vulnerables and Reportes de Operaciones Inusuales (ROIs) when they detect suspicious transactions or unusual source of funds declarations.

Mexico's anti-money laundering (PLD — Prevención de Lavado de Dinero) framework was designed to comply with the Financial Action Task Force (FATF) Forty Recommendations, as Mexico is a member of FATF and the Grupo de Acción Financiera de Latinoamérica (GAFILAT). The FATF conducts periodic mutual evaluations of Mexico's PLD framework — the most recent comprehensive evaluation was published in 2018 and assessed Mexico's compliance with all 40 FATF Recommendations.

Financial institutions regulated by the CNBV (Comisión Nacional Bancaria y de Valores), the CNSF (Comisión Nacional de Seguros y Fianzas), and the CONSAR (Comisión Nacional del Sistema de Ahorro para el Retiro) operate under separate, sector-specific PLD disposiciones de carácter general that incorporate LFPIORPI Article 18 requirements but add additional due diligence obligations specific to banking, insurance, and pension fund sectors. Banks (instituciones de crédito) governed by the Ley de Instituciones de Crédito must collect source of funds declarations for cash deposits above $7,500 USD equivalent and for all international wire transfers (transferencias internacionales) under CNBV's PLD disposiciones.

False declarations of source of funds in Mexico constitute the crime of operaciones con recursos de procedencia ilícita under Código Penal Federal Articles 400 Bis through 400 Bis-2, which carry prison sentences of 5 to 15 years and fines of up to 50,000 days of the general minimum wage (salario mínimo general) for individuals, and for legal entities, dissolution, suspension, or disqualification from regulated activities under LFPIORPI Article 55.

When Do You Need a Declaration of Source of Funds Mexico?

A Declaration of Source of Funds Mexico is required whenever a person or entity engages in transactions with obligated sujetos obligados under LFPIORPI Article 17 that exceed the established monetary thresholds, or whenever a financial institution, notary, or regulated professional requests documentary evidence of the lawful origin of funds.

The declaration is required in real estate transactions (operaciones inmobiliarias) where the purchase price or rental amount exceeds LFPIORPI threshold levels — currently equivalent to 805 times the UMA (Unidad de Medida y Actualización) for real estate transfers. Notarios Públicos (notaries) who formalise real estate transactions are sujetos obligados under LFPIORPI Article 17 fraction VI and must collect source of funds declarations from buyers before executing the escritura pública.

The document is needed when opening a bank account (cuenta bancaria) at an institución de crédito regulated under the Ley de Instituciones de Crédito — banks in Mexico are required to conduct enhanced due diligence and obtain source of funds declarations for accounts with high transaction volumes or for accounts held by non-resident foreigners (personas físicas extranjeras no residentes).

Corporate restructuring transactions including mergers (fusiones), spin-offs (escisiones), capital increases (aumentos de capital), and asset transfers between related parties require source of funds declarations when values exceed LFPIORPI thresholds, because Notarios Publicos and abogados assisting with these transactions are sujetos obligados under LFPIORPI Article 17 fraction XI. The declaration ensures that capital contributions and asset transfers are documented as originating from lawful commercial or investment activities rather than undisclosed third-party sources, satisfying the due diligence obligations imposed by the Unidad de Inteligencia Financiera on all participating professionals.

What to Include in Your Declaration of Source of Funds Mexico

A complete Declaration of Source of Funds Mexico under LFPIORPI Article 18 must contain the following essential elements to satisfy the due diligence obligations of sujetos obligados:

Declarant Identification: Full legal name of the declarant (persona física or representante legal of a persona moral), RFC (Registro Federal de Contribuyentes), CURP (for individuals), INE credential number or passport number, domicilio fiscal, nationality, and date of birth. For legal entities (personas morales), the acta constitutiva registration data (folio mercantil, Registro Público de Comercio) and RFC must be included.

Nature of Resources: A clear description of the funds being declared — cash (efectivo), wire transfer (transferencia electrónica), check (cheque), or non-monetary consideration — and the total amount in MXN or foreign currency at the applicable Banco de México exchange rate (tipo de cambio FIX).

Source of Funds Categories: The declaration must specify the economic origin of the resources, selecting from recognized categories: salary or employment income (ingresos por sueldos y salarios); business income (ingresos por actividad empresarial o profesional); sale of assets (enajenación de bienes); inheritance or donation (herencia o donativo); investment returns (rendimientos de inversiones); foreign remittances (remesas del extranjero); retirement or pension income (pensión o jubilación); or other documented sources.

Supporting Documentation: Reference to the specific documents evidencing the declared source — tax returns (declaraciones fiscales), salary receipts (recibos de nómina), bank statements (estados de cuenta bancarios no mayores a 3 meses), property sale deeds (escrituras de enajenación), corporate financial statements (estados financieros), or wire transfer records. The sujeto obligado must retain copies of these documents for a minimum of 5 years under LFPIORPI Article 18.

Beneficial Owner Disclosure: If the declarant is acting on behalf of a third party (tercero), the beneficial owner's (propietario real) identity, RFC, and relationship to the declarant must be disclosed. LFPIORPI Article 18 requires identification of all individuals who ultimately own or control 25% or more of a legal entity, aligned with FATF Recommendation 10 on beneficial ownership transparency.

Politically Exposed Person (PEP) Status: A declaration of whether the declarant or any related beneficial owner is a Persona Políticamente Expuesta (PEP) — including current or former holders of public positions in Mexico (federal, state, or municipal level) or in foreign governments, or close family members of PEPs. PEP status triggers enhanced due diligence obligations for the receiving sujeto obligado.

Declaration Under Oath: The statement must be made bajo protesta de decir verdad (under oath to tell the truth) — the declarant acknowledges that providing false information constitutes a federal crime under Código Penal Federal Article 400 Bis (operaciones con recursos de procedencia ilícita) and may result in criminal prosecution and referral to the UIF.

Signature and Date: The declarant's handwritten signature (firma autógrafa) and the date of the declaration. For legal entities, the authorized representative's signature and the notarized power of attorney (poder notarial) reference. Electronic signatures under the e.firma (formerly FIEL) system issued by the SAT are accepted for digital declarations filed through SIPOAL.
