What Is a Community Property Settlement Mexico (Acuerdo de Liquidación de Bienes de la Comunidad)?

A Community Property Settlement Mexico (Acuerdo de Liquidación de Bienes de la Comunidad) is the formal legal instrument by which spouses or former spouses — whose marriage was contracted under the sociedad conyugal (community of property) regime — identify, value, and divide the jointly accumulated assets and liabilities upon the dissolution of the marital community. Governed by the Código Civil Federal (CCF) Articles 197 through 207 and corresponding state civil codes (Códigos Civiles de los Estados), the agreement converts undivided co-ownership interests (copropiedad de la masa conyugal) into individually titled assets assigned to each former spouse.

The sociedad conyugal is one of two principal matrimonial property regimes available under Mexican law — the other being separación de bienes (separate property). Under CCF Article 183, spouses who contract marriage without expressly choosing their property regime default to the rules established by the applicable state civil code, which in many Mexican states defaults to separación de bienes; however, where sociedad conyugal is chosen or presumed, all property acquired during the marriage through onerous title (bienes adquiridos a título oneroso) forms part of the communal mass (masa conyugal), while property inherited or received by gift (bienes recibidos a título gratuito) may remain separate unless expressly included.

The Acuerdo de Liquidación de Bienes de la Comunidad is distinct from, but closely related to, the procedimiento de divorcio (divorce proceedings). In a mutual consent divorce (divorcio por mutuo consentimiento) before a Juzgado Familiar or Notario Público (in states that allow notarial divorce), the liquidation agreement may be filed simultaneously as part of the convenio de divorcio. In a contested divorce proceeding before a Juzgado Familiar, the liquidation of the sociedad conyugal may be resolved in a separate fase de liquidación after the divorce decree is issued. In either case, real property assets assigned to one spouse through the liquidation agreement must be formalised in a escritura pública (notarial deed) and registered with the Registro Público de la Propiedad of the relevant state.

When Do You Need a Community Property Settlement Mexico (Acuerdo de Liquidación de Bienes de la Comunidad)?
