What Is a AFORE Beneficiary Designation Mexico (Designación de Beneficiarios AFORE)?

An AFORE Beneficiary Designation Mexico (Designación de Beneficiarios AFORE) is the formal document by which a worker (trabajador) registered in Mexico's Sistema de Ahorro para el Retiro (SAR) designates the person or persons who will receive the balance of their cuenta individual (individual retirement account) upon death — without the need for succession proceedings (juicio sucesorio). The AFORE system was established by the Ley del Sistema de Ahorro para el Retiro (Ley del SAR) and the Ley del Seguro Social (LSS) reform of 1997, which replaced the defined-benefit IMSS pension scheme with individual defined-contribution accounts administered by private fund managers called Administradoras de Fondos para el Retiro (AFOREs).

Under Ley del SAR Articles 54 through 56, the cuenta individual consists of four sub-accounts: the retiro, cesantía en edad avanzada y vejez (RCV) sub-account funded by IMSS employer-employee-government tripartite contributions under LSS Article 168; the vivienda sub-account managed by INFONAVIT under the Ley del INFONAVIT; the aportaciones voluntarias (voluntary contributions) sub-account; and the aportaciones complementarias (complementary contributions) sub-account. Upon the worker's death, the beneficiary designation determines who receives the RCV sub-account balance and voluntary contributions — the vivienda sub-account follows separate INFONAVIT rules under Ley del INFONAVIT Article 43-Bis.

The beneficiary designation under Ley del SAR Article 55 is completely independent from the worker's will (testamento) or intestate succession rules. The designated beneficiaries receive the AFORE funds directly from the AFORE administrator without requiring a court order or notarial succession proceeding, through the proceso de entrega de recursos por fallecimiento (resource delivery on death process) regulated by CONSAR Circular CONSAR 15-19. This extra-succession nature makes the designation a critical component of retirement and estate planning in Mexico — the AFORE balance, which for many workers constitutes their most significant financial asset, does not form part of the estate for succession purposes.

The Comisión Nacional del Sistema de Ahorro para el Retiro (CONSAR), established under the Ley del SAR as the supervisory authority, regulates both AFORE operations and the beneficiary designation process. CONSAR's Circular 15-19 establishes the requirements for beneficiary designations: the designation must be made in person or through the AFORE's digital platform (portal or app); the worker must present valid official identification; the designation must be notarised or certified by the AFORE's compliance officer; and any modification (actualización) or revocation of the designation must follow the same formal process.

Mexico's AFORE system manages approximately 65 million individual accounts through 10 AFORE administrators including AFORE XXI Banorte (the largest), Citibanamex AFORE, Principal AFORE, Sura AFORE, Coppel AFORE, Azteca AFORE, Profuturo AFORE, Pensionissste (for ISSSTE workers), Invercap AFORE, and Inbursa AFORE. Workers may designate any person as beneficiary — family relationship is not required — and may designate multiple beneficiaries with specified percentage allocations. Failure to designate beneficiaries results in the AFORE balance being delivered to the legal heirs through the succession proceeding (procedimiento sucesorio ante notario), significantly delaying access.

The SAR system's investment framework divides each cuenta individual's balance across multiple SIEFOREs (Sociedades de Inversión Especializadas de Fondos para el Retiro) — investment funds differentiated by age-based risk profiles, with younger workers' accounts allocated to higher-growth instruments and those approaching retirement shifted toward capital-preservation strategies. CONSAR publishes quarterly performance tables (Tabla Comparativa de AFORE) showing net return (rendimiento neto) for each AFORE across all SIEFOREs, enabling workers to compare fund performance and make informed transfer decisions. The beneficiary designation must be maintained as current as the SAR account — mismatched or outdated designations are one of the principal causes of delayed AFORE fund delivery to surviving family members.

When Do You Need a AFORE Beneficiary Designation Mexico (Designación de Beneficiarios AFORE)?

An AFORE Beneficiary Designation is needed by every worker registered in the SAR system, ideally from the moment of formal employment registration with IMSS — and updated whenever there are changes in personal circumstances that affect beneficiary preferences.

The designation is immediately necessary when a worker starts formal employment covered by IMSS. Under Ley del SAR Article 54, the employer is required to register the worker with an AFORE within 90 days of the first IMSS contribution, and the AFORE provides the worker with the cuadernillo de afiliación (enrollment booklet) requesting beneficiary designation. Without a designation on file, the worker's AFORE savings will require succession proceedings to access upon death — creating delays of 12 to 36 months and legal costs that reduce the funds ultimately available to the worker's family.

The designation requires updating when the worker marries (matrimonio) or enters a concubinato relationship — the spouse or concubino/a has legal rights as beneficiary under LSS Article 64 regardless of the AFORE designation, but designating them in the AFORE form ensures expedited delivery of funds. Divorce (divorcio) is a critical event requiring designation update — a divorced ex-spouse who remains on the AFORE beneficiary form will receive the account balance regardless of the divorce decree, as the AFORE designation supersedes testamentary or court orders unless specifically modified.

The designation needs updating upon the birth of children (nacimiento de hijos) — minor children are the primary beneficiaries under LSS Article 64 pension succession rules, and their designation in the AFORE form prevents disputes over percentage allocations. When a designated beneficiary dies (fallecimiento de un beneficiario designado), the designation must be updated to avoid the deceased beneficiary's share reverting to legal heirs through succession rather than passing to the worker's other designees.

The designation is also relevant for workers with voluntary contribution sub-accounts (subcuenta de aportaciones voluntarias) who have made significant additional retirement savings — these funds are particularly important to designate, as they represent the worker's discretionary retirement savings beyond mandatory contributions.

Under Ley del SAR Article 56 and CONSAR Circular 15-19, workers may update their beneficiary designation at any time free of charge through their AFORE's branch offices, certified AFORE agents (promotores certificados), or digital platforms — providing flexibility to reflect changing family circumstances.

What to Include in Your AFORE Beneficiary Designation Mexico (Designación de Beneficiarios AFORE)

A valid AFORE Beneficiary Designation under Ley del SAR Articles 54–56 and CONSAR Circular 15-19 must contain the following elements to be accepted by the AFORE administrator and effective upon the worker's death.

Account Holder Identification (Datos del Trabajador): Full legal name, CURP (18-character Clave Única de Registro de Población — mandatory as the primary SAR system identifier), NSS (Número de Seguridad Social — the 11-digit IMSS registration number), RFC, date of birth, official identity document number (INE/IFE or valid passport), AFORE name and account number. The CURP and NSS must exactly match IMSS records — discrepancies cause processing delays and may require IMSS record correction through módulos de actualización del IMSS.

Beneficiary Identification (Datos del Beneficiario): Full legal name of each beneficiary, CURP, relationship to the worker (parentesco — spouse/cónyuge, child/hijo-a, parent/padre-madre, sibling/hermano-a, or other), date of birth, and contact address. For minor children, the name of the legal guardian (tutor legal) who will manage the funds until the child reaches legal age (18 years) must be specified. For concubinos/concubinas, the designation should note the duration of the relationship to establish the 2-year cohabitation threshold under LSS Article 64.

Percentage Allocation (Porcentaje de Participación): The percentage of the account balance designated to each beneficiary — total must equal 100%. The allocation percentages apply to all sub-accounts jointly unless specified otherwise. CONSAR allows different percentage allocations for the RCV sub-account versus the aportaciones voluntarias sub-account upon specific request, which may be useful when the worker wishes to direct mandatory retirement savings to legal heirs and voluntary savings to a different beneficiary.

Order of Precedence (Orden de Prelación): For multiple beneficiaries, specify whether they receive simultaneously (en el mismo grado) or sequentially — first beneficiaries (beneficiarios primarios) receive upon the worker's death; secondary beneficiaries (beneficiarios sustitutos) receive only if all primary beneficiaries have predeceased the worker. This prevents the designated share from reverting to succession proceedings if a primary beneficiary dies.

Notarisation or AFORE Certification: Under CONSAR Circular 15-19, the designation must be certified by the AFORE's official (funcionario autorizado) or by a Notario Público. The AFORE retains the original certified designation in the worker's expediente de afiliación. The worker receives a folio or confirmation number as evidence of the registered designation.

Date and Signature: Date of execution, worker's signature or fingerprint (huella digital) if the worker is unable to sign, and the AFORE official's certification signature with the institution's official seal. The designation takes effect from the date of certification and supersedes all prior beneficiary designations.

The formal designation must be executed directly with the AFORE administrator or through an authorised AFORE agent (promotor certificado por CONSAR). For workers approaching retirement age (60 years for early retirement/cesantía or 65 for regular vejez pension under LSS Article 154), consulting a financial planner (asesor financiero certificado) alongside the beneficiary designation process is advisable to optimise retirement income and legacy planning.

Revocation and Update Process: The designation may be updated at any time free of charge through the AFORE's branch offices, authorised promotores certificados por CONSAR, or digital platforms. Workers should verify their designation annually through the e-SAR portal (www.e-sar.com.mx) to confirm the recorded beneficiaries match their current intent — particularly after marriage, divorce, birth of children, or death of a previously designated beneficiary.
