IV. FUNCIONES Y OBLIGACIONES

La Comisión Mixta de Seguridad e Higiene ejercerá las siguientes funciones conforme a los Artículos 509–514 LFT y NOM-019-STPS-2011:

a) Realizar recorridos mensuales de verificación de las condiciones de seguridad e higiene en todas las áreas del centro de trabajo, documentando hallazgos en Actas del Recorrido de Verificación firmadas por todos los miembros presentes.

b) Investigar las causas de todos los accidentes y enfermedades de trabajo para identificar causas raíz y proponer medidas correctivas, en coordinación con el responsable de seguridad e higiene del patrón.

c) Verificar el cumplimiento de las Normas Oficiales Mexicanas aplicables en materia de seguridad y salud en el trabajo, incluyendo la NOM-030-STPS-2009 (Programa de Seguridad y Salud en el Trabajo) y NOM-035-STPS-2018 (factores de riesgo psicosocial).

d) Participar en la elaboración y monitoreo del Programa Anual de Seguridad y Salud en el Trabajo (NOM-030-STPS-2009).

e) Promover una cultura de seguridad e higiene entre los trabajadores mediante campañas de información y capacitación.

f) Colaborar con los Inspectores del Trabajo de la STPS durante las visitas de inspección al centro de trabajo.

V. REUNIONES ORDINARIAS Y EXTRAORDINARIAS

La Comisión celebrará al menos una reunión ordinaria mensual conforme a la NOM-019-STPS-2011. El quórum válido requiere la presencia de al menos un representante de cada parte. El Secretario elaborará el Acta de Reunión correspondiente dentro de los 5 días hábiles siguientes a cada sesión, firmada por todos los miembros presentes. Las Actas de Reunión se conservarán en el expediente administrativo de la Comisión por un mínimo de 12 meses.

VI. REGISTRO EN EL SIRCE

Las partes acuerdan registrar la presente Comisión en el SIRCE (Sistema de Registro de Comisiones de Seguridad e Higiene) de la STPS en línea (www.stps.gob.mx), dentro del plazo previsto por la NOM-019-STPS-2011. El certificado de registro emitido por la STPS a través del SIRCE constituye la prueba oficial de existencia de la Comisión. Ante cualquier cambio en la composición de la Comisión, deberá actualizarse el registro en el SIRCE dentro del plazo correspondiente.

What Is a Joint Safety and Hygiene Commission Mexico (Comisión Mixta de Seguridad e Higiene)?

A Joint Safety and Hygiene Commission Mexico (Comisión Mixta de Seguridad e Higiene) constitution document is the formal instrument through which an employer and its workers jointly establish, compose, and formally register the bipartite occupational safety body mandated by Articles 509 through 514 of the Ley Federal del Trabajo (LFT) and governed in detail by NOM-019-STPS-2011 — the Norma Oficial Mexicana titulada 'Constitución, Integración, Organización y Funcionamiento de las Comisiones de Seguridad e Higiene,' published in the Diario Oficial de la Federación on 13 April 2011.

Article 509 of the Ley Federal del Trabajo establishes a clear mandatory obligation: in every enterprise or establishment, a Commission composed of equal numbers of worker and employer representatives must be constituted to investigate the causes of accidents and diseases, propose preventive measures, and monitor compliance. The statutory obligation applies to every employer in Mexico regardless of size, economic sector, legal form, or workforce composition — from micro-enterprises with fewer than 10 workers to multinational corporations with thousands of employees. There is no minimum employee threshold exempting any employer from the Article 509 LFT obligation.

NOM-019-STPS-2011 provides the complete operational framework for the Commission: its constitution procedure, required composition (minimum one employer representative and one worker representative for workplaces with up to 20 workers; additional members for larger workplaces based on specified ratios), STPS registration requirements, monthly meeting obligation, workplace inspection (recorrido de verificación) frequency, accident investigation duties, and documentation requirements. The Commission must be registered with the STPS through the SIRCE (Sistema de Registro de Comisiones de Seguridad e Higiene) online platform, and the registration must be renewed whenever the Commission's composition changes.

The Commission is one of three mandatory bipartite bodies that Mexican labour law requires in every enterprise — alongside the Comisión Mixta de Capacitación y Adiestramiento (training commission, Article 153-F LFT) and the Comisión Mixta de Escalafón (promotion commission, Article 159 LFT). Among these, the Comisión Mixta de Seguridad e Higiene is the most extensively regulated and the most frequently inspected by the STPS Inspección del Trabajo.

The Commission's legal mandate under NOM-019-STPS-2011 encompasses: monthly workplace inspection rounds (recorridos mensuales de verificación) to identify hazards and unsafe conditions; investigation of all workplace accidents and occupational diseases to identify root causes and recommend corrective measures; verification that the employer is complying with all applicable Normas Oficiales Mexicanas on occupational safety — currently more than 80 NOMs are in force; participation in the development and monitoring of the annual Occupational Safety and Health Program (Programa de Seguridad y Salud en el Trabajo) under NOM-030-STPS-2009; and verification of NOM-035-STPS-2018 psychosocial risk assessment implementation and action plan execution.

Articles 510 and 511 LFT establish two fundamental principles governing Commission operations: Article 510 prohibits the employer from obstructing the Commission's operations; Article 511 requires that workers cooperate with the Commission and comply with its recommendations. These provisions give the Commission a degree of institutional independence — its findings and recommendations, documented in signed Actas de Reunión, are reviewed by STPS inspectors and may be introduced as evidence in Tribunal Laboral proceedings concerning occupational safety violations.

When Do You Need a Joint Safety and Hygiene Commission Mexico (Comisión Mixta de Seguridad e Higiene)?

A Joint Safety and Hygiene Commission constitution document is needed by every employer in Mexico — from the first day of operations — because the obligation under Article 509 of the Ley Federal del Trabajo to constitute the Commission is immediate and unconditional, applying without any minimum employee threshold or sector limitation.

The constitution document is urgently needed when the employer receives an STPS inspection notice (acta de inspección) citing the absence or improper constitution of the Commission as a violation — this is one of the most frequently cited deficiencies in STPS workplace inspections. Presenting a complete constitution document, signed by employer and worker representatives, with the STPS registration receipt, is the primary corrective action required by the STPS.

A Commission constitution document is required when the employer is applying for STPS employer registration (registro patronal ante la STPS) or when updating the employer's profile in the STPS SIREL (Sistema de Registro de Establecimientos Laborales) system — the Commission's existence and current registration is a prerequisite for many STPS administrative processes.

The document is needed when the composition of the Commission changes — when a member resigns, is transferred, or their employment ends, the Commission must be reconstituted or updated, a new constitution document prepared, and the updated registration submitted to the STPS through the SIRCE system under NOM-019-STPS-2011 requirements. The NOM requires that changes be registered within a specified period to maintain the Commission's legal status.

A Joint Safety and Hygiene Commission constitution document is essential when the company is implementing NOM-035-STPS-2018 psychosocial risk compliance — the Commission is the primary institutional actor responsible for verifying the psychosocial risk assessment, reviewing results, approving the action plan, and monitoring its implementation. Without a properly constituted and registered Commission, the NOM-035 implementation lacks its required governance structure.

Employer Identification and Establishment Data: Full legal name (razón social) of the employer, RFC (Registro Federal de Contribuyentes), IMSS Registro Patronal, STPS employer registration number, main economic activity (actividad económica principal) aligned with the SCIAN classification used by IMSS for risk class assignment, IMSS risk class (clase de riesgo I–V), workplace address, number of workers at the establishment (by shift if applicable), and the period of constitution. For multi-location employers, a separate Commission must be constituted for each physical establishment — NOM-019-STPS-2011 does not permit a single Commission to cover multiple geographically distinct workplaces.

Commission Composition: Full name, RFC, CURP, job title (puesto), department, and shift of each Commission member. NOM-019-STPS-2011 establishes minimum composition rules by establishment size: 1 employer representative and 1 worker representative for establishments with 1 to 20 workers; 2 employer representatives and 2 worker representatives for 21 to 100 workers; 3 representatives per side for 101 to 500 workers; and 4 or more per side for establishments with more than 500 workers. Each member must be a worker actually employed at the establishment — external consultants or corporate officers not working at the site cannot serve as members. The Commission must have a designated Presidente (employer representative), Secretario (worker representative), and Vocales (additional members by size).

Member Designation Process: Documentation of how employer and worker representatives were designated — the employer appoints its representatives directly; workers elect their representatives through a general worker assembly (asamblea de trabajadores) or through their union (sindicato) where a CCT is in force. The constitution document must record the date of the worker assembly or union designation, the number of workers participating, and the outcome of the designation process. NOM-019-STPS-2011 requires that worker members be designated voluntarily and not under employer pressure.

Functions and Duties: A section explicitly incorporating the Commission's legal functions under NOM-019-STPS-2011: (1) monthly workplace safety inspection rounds (recorridos mensuales de verificación), documenting findings and corrective recommendations; (2) accident and occupational disease investigation, including root-cause analysis and corrective action follow-up; (3) development and monitoring of the annual Occupational Safety and Health Program (Programa de Seguridad y Salud en el Trabajo) under NOM-030-STPS-2009; (4) verification of NOM-035-STPS-2018 psychosocial risk assessment implementation; (5) promotion of a safety and health culture through information campaigns; and (6) coordination with STPS inspectors during workplace inspection visits.

Meeting Calendar and Operating Rules: An annual meeting calendar specifying the date, time, and location of each monthly Commission meeting — NOM-019-STPS-2011 requires at least one formal meeting per month. The operating rules section should specify: quorum requirements (minimum member attendance for valid meeting), meeting chair (Presidente), recording secretary (Secretario), procedure for preparing and signing the Acta de Reunión within the prescribed period, and procedure for distributing Actas to all members and the STPS.
