What Is a Educational Services Contract Mexico (Contrato de Servicios Educativos)?

An Educational Services Contract Mexico (Contrato de Servicios Educativos) is a written agreement between a private educational institution (institución educativa particular) — operating with Reconocimiento de Validez Oficial de Estudios (RVOE) or Acuerdo de Incorporación granted by the Secretaría de Educación Pública (SEP) or state educational authority (autoridad educativa estatal) — and a student (alumno) or the student's parents or legal guardians (padres de familia o tutores legales), by which the institution agrees to provide educational services (servicios educativos) in exchange for tuition payments (colegiaturas) and other specified fees. In Mexico, private educational institutions are regulated by the Ley General de Educación (LGE, DOF 30 September 2019, as amended) Article 57, which grants private schools the right to charge for services while imposing obligations regarding curriculum compliance, qualified teaching staff, and student rights.

The Ley General de Educación (LGE) Article 57 establishes the legal framework for private educational providers (particulares que impartan educación) — they must comply with the plans and programmes of study (planes y programas de estudio) authorised by the SEP, employ qualified teachers (maestros con perfil profesional adecuado), and comply with the conditions imposed by the educational authority in the RVOE or incorporation agreement. Private schools that operate without a valid RVOE or Acuerdo de Incorporación risk closure by the SEP and administrative sanctions under LGE Article 67. The validity (validez oficial) of certificates (certificados), diplomas, and degrees issued by private institutions depends on maintenance of their RVOE status.

Acuerdo Secretarial 279 issued by the SEP on 10 July 2000 (as amended) establishes the procedures for obtaining and maintaining an RVOE for private higher education institutions (instituciones de educación superior particulares). Acuerdo 279 requires that the educational services contract (contrato de prestación de servicios educativos) be provided to students before enrolment (inscripción), specify the total cost of the programme, and clearly describe the conditions for graduation (requisitos de titulación), academic promotion (criterios de acreditación y regularización), and withdrawal (baja). The Acuerdo also prohibits retention of academic certificates (retención de documentos académicos) by the institution as a means of collecting unpaid fees — a practice that the LGE and LFPC explicitly prohibit.

The Ley Federal de Protección al Consumidor (LFPC) applies to private educational services as a consumer transaction — students and parents are considered consumers (consumidores) under LFPC Article 2, and educational institutions are subject to LFPC consumer protection obligations including accurate advertising (publicidad veraz), written contracts (contratos escritos), and PROFECO complaint jurisdiction. LFPC Article 74 specifically prohibits educational institutions from conditioning the delivery of certificates, diplomas, transcripts (kardex), or other academic documents on payment of unjustified fees or unsatisfied alleged debts beyond those expressly agreed in the educational services contract.

For student personal data (datos personales) including academic records, health information, and family data, private educational institutions must comply with the Ley Federal de Protección de Datos Personales en Posesión de los Particulares (LFPDPPP) and its Reglamento, providing students and parents with a complete aviso de privacidad specifying the purposes for which personal data is collected, stored, and shared — including sharing with SEP for RVOE compliance reporting and with third-party platforms used for remote learning (educación a distancia).

When Do You Need a Educational Services Contract Mexico (Contrato de Servicios Educativos)?

An Educational Services Contract Mexico is required whenever a private educational institution enrolls a student — whether at preschool (preescolar), primary (primaria), secondary (secundaria), upper secondary (bachillerato or preparatoria), or higher education (educación superior) level. The contract documents the terms of the educational relationship, protects both parties' rights, and is mandated by both the SEP regulatory framework and LFPC consumer protection law.

The contract is needed at the time of initial enrolment (inscripción) and at each annual re-enrolment (reinscripción) — PROFECO and SEP guidelines recommend that the institution provide the full contract to the student or parent before any payment is made, allowing adequate time for review. Under LFPC Article 33 on consumer service contracts, the institution must provide the student with a signed copy of the contract at the time of enrolment.

The document is required when an educational institution charges tuition or fees above the amounts registered with the SEP or state educational authority — any increase in colegiaturas (monthly tuition fees) must be communicated to enrolled students at least 30 days in advance, per SEP and PROFECO guidelines. The contract should reference the colegiatura amount valid for the current school year and specify the procedure for annual increases.

An educational services contract is essential for clarifying the conditions under which a student may be excluded (baja disciplinaria) from the institution — the contract must specify the causes for academic exclusion (bajo rendimiento académico insuperable), disciplinary exclusion (conducta grave), and voluntary withdrawal (baja voluntaria), and the procedures for each, in compliance with LGE Article 57 and the institution's Reglamento Interno.

The contract is required when a student transfers between educational institutions — the receiving institution needs documentation of the student's prior enrolment, courses completed, and credits (créditos académicos) earned under the departing institution's RVOE programme, and the educational services contract is part of this documentation package.

The document is also required when private universities (universidades particulares) or technical institutes (institutos tecnológicos particulares) enrol foreign students who require a student visa (visa de estudiante) from the Instituto Nacional de Migración (INM) — the INM requires a letter of acceptance and the signed educational services contract as supporting documents for the FM3 student residency card application. For postgraduate programmes (programas de posgrado) recognised by the Consejo Nacional de Ciencia y Tecnología (CONACYT), the educational services contract must reference the programme's CONACYT recognition number to allow students to access CONACYT scholarship (beca CONACYT) funding that is disbursed directly to the institution.

What to Include in Your Educational Services Contract Mexico (Contrato de Servicios Educativos)

A valid Educational Services Contract Mexico under LGE Article 57, Acuerdo Secretarial 279, and the Ley Federal de Protección al Consumidor must contain the following essential elements:

Identification of Parties: Full legal name, RFC, RVOE number (número de RVOE or número de Acuerdo de Incorporación), and address of the educational institution. Full name, CURP, date of birth, and contact information of the student (alumno) — and, for minors, the full name, RFC, and contact information of the parent or legal guardian (padre de familia o tutor legal) executing the contract.

Educational Programme Description: Name of the educational programme (nombre del programa educativo), level of study (nivel educativo — preescolar, primaria, secundaria, bachillerato, licenciatura, posgrado), RVOE number and issuing authority, duration of the programme (duración del programa en ciclos escolares o semestres), and the official curriculum (plan de estudios oficial) governing the programme. Reference to the SEP or state authority that granted the RVOE.

Tuition and Fee Schedule (Cuotas y Colegiaturas): The annual enrolment fee (cuota de inscripción o reinscripción), monthly tuition (colegiatura mensual), any additional charges for laboratory fees (cuotas de laboratorio), materials (materiales didácticos), extracurricular activities (actividades extraescolares), or technology platform fees (cuotas de plataforma tecnológica) — all amounts must be stated inclusive of IVA (16%) where applicable. The procedure and advance notice period for annual colegiatura increases.

Academic Promotion and Graduation Requirements: The criteria for passing each academic period (criterios de acreditación de materias y ciclos escolares), conditions for academic probation (condición de alerta académica o regularización), and the requirements for graduation and degree award (titulación y expedición de documentos académicos) — including residency, service, examination, and thesis requirements where applicable.

Student Conduct and Disciplinary Procedures: Reference to the institution's Reglamento Interno governing student conduct, attendance requirements, use of technology, and grounds for disciplinary action — including the procedures for notification, hearing, and appeal of disciplinary decisions in compliance with the right to due process (garantía de audiencia) under Constitución Política Article 14.

Document Retention Prohibition: Express statement that the institution will not retain (retener) the student's academic certificates, kardex, transcripts, or official identity documents as a means of collecting unpaid fees, in compliance with LGE and LFPC Article 74 — which makes such retention a prohibited commercial practice subject to PROFECO sanction.

Personal Data Processing: LFPDPPP aviso de privacidad summary specifying the purposes for which student and family personal data is collected, the parties with whom it may be shared (SEP, RVOE compliance, learning management systems), and the student's or parent's rights to access, rectification, cancellation, and opposition (derechos ARCO) before the institution's privacy officer.

Scholarship and Financial Aid Terms: Where the institution offers becas (scholarships), descuentos por convenio (institutional discount agreements), or financiamiento educativo (education payment plans) — the conditions for maintaining scholarship eligibility, the procedure for annual renewal, and the consequences of academic underperformance on continued financial support must be clearly documented. Scholarships revoked without prior written notice and a hearing opportunity may constitute a LFPC violation subject to PROFECO sanction.

Governing Law and Dispute Resolution: An express statement that the contract is governed by the Ley General de Educación, the applicable state education law, and the Ley Federal de Protección al Consumidor. For disputes not resolved through the institution's internal procedure, the student or parent may file a complaint with PROFECO or the SEP or state education secretariat (Secretaría de Educación del Estado) with supervisory jurisdiction over the RVOE.
