What Is a Disability Pension Application Spain (Solicitud de Pensión de Incapacidad Permanente)?

A Disability Pension Application Spain (Solicitud de Pensión de Incapacidad Permanente) is a formal administrative petition submitted to the Instituto Nacional de la Seguridad Social (INSS) — Spain's national social security benefit authority — requesting the recognition of permanent disability (incapacidad permanente) and the resulting monthly contributory pension for a worker whose functional capacity has been permanently reduced by illness or injury to the point of limiting their ability to work. The primary statutory framework is the Ley General de la Seguridad Social (LGSS — Real Decreto Legislativo 8/2015, de 30 de octubre), Articles 193–200, which define the categories of permanent disability, eligibility conditions, benefit calculation, and management by the INSS through its Medical Assessment Teams (Equipos de Valoración de Incapacidades — EVI).

Spain's incapacidad permanente system distinguishes four degrees of permanent disability based on the worker's residual work capacity following the functional impairment. Incapacidad Permanente Parcial (IPP — Partial Permanent Disability) under Article 194 LGSS: the worker retains sufficient capacity to perform their habitual occupation but with a reduction of at least 33% in their normal working performance. The benefit is a lump sum of 24 months of the regulatory base rather than a monthly pension. Incapacidad Permanente Total (IPT — Total Permanent Disability) under Article 194 LGSS: the worker is incapacitated to perform all tasks of their habitual occupation (profesión habitual) but may be able to perform a different occupation. The monthly pension is 55% of the regulatory base, increased to 75% for workers over 55 years old (IPT cualificada) under Article 198 LGSS if re-employment prospects are limited. Incapacidad Permanente Absoluta (IPA — Absolute Permanent Disability) under Article 194 LGSS: the worker is incapacitated for all professional activity — no occupation can be performed. The monthly pension is 100% of the regulatory base. Gran Invalidez (GI — Great Disability) under Article 194 LGSS: the worker, in addition to being totally incapacitated for work, requires the permanent assistance of another person for basic daily life activities (eating, moving, personal hygiene). The monthly pension is 100% of the regulatory base plus a supplement (complemento de gran invalidez) of 45% of the worker's minimum pension base plus 30% of their last salary, to cover the costs of a carer.

The medical assessment procedure for incapacidad permanente is initiated either automatically upon exhaustion of temporary disability (incapacidad temporal — IT) after 545 days of sick leave under Article 169 LGSS, or upon the worker's or their doctor's initiative before the 545-day limit where the condition is clearly permanent. The INSS's EVI (Equipo de Valoración de Incapacidades) — a multidisciplinary medical team consisting of doctors, social workers, and INSS officials — examines all medical evidence and issues a propuesta motivada (reasoned proposal) for or against recognition of disability and its degree. The INSS Director Provincial issues the final resolution (resolución de reconocimiento or denegación de la incapacidad permanente).

The regulatory base (base reguladora) for the disability pension is calculated under Article 197 LGSS by reference to the worker's actual social security contribution bases over a defined look-back period — for common illness (enfermedad común) and non-work accident (accidente no laboral), the base reguladora is calculated from contributions over 96 months (8 years) out of the 120 months (10 years) preceding the qualifying event; for work accidents (accidente de trabajo) and occupational disease (enfermedad profesional), the base reguladora is calculated from contributions in the 24 months immediately before the accident, regardless of prior contribution history.

When Do You Need a Disability Pension Application Spain (Solicitud de Pensión de Incapacidad Permanente)?

A Disability Pension Application Spain is appropriate when a worker who has been on temporary sick leave (incapacidad temporal) or who has sustained a serious injury has functional limitations that are likely to be permanent and significantly affect their ability to work, and wishes to initiate the INSS evaluation procedure for recognition of incapacidad permanente.

The application is required when a worker has been on continuous temporary sick leave (incapacidad temporal) for 545 days — at this point, the INSS is required by law to initiate the permanent disability assessment procedure automatically, but the worker or their representative may also apply proactively.

The solicitud is needed when a worker suffers a work accident (accidente de trabajo) or is diagnosed with an occupational disease (enfermedad profesional) that results in permanent functional sequelae — these contingencias profesionales have no minimum prior contribution requirement for disability pension eligibility, making it important to apply as soon as permanence of the impairment is established.

The application is appropriate when a worker under 65 suffering from a serious progressive illness — including multiple sclerosis, Parkinson's disease, ALS, severe cardiac or respiratory conditions, or cancer with significant functional impairment — receives medical confirmation that the condition's impact on work capacity is permanent and not expected to improve sufficiently to allow return to their habitual occupation.

A disability pension application is needed when a worker who previously received a temporary incapacity temporary benefit and attempted a return to work finds that their functional limitations prevent them from performing their habitual occupation (profesión habitual) reliably and safely, and medical evidence supports the permanence of the work-limiting condition.

The application is required when a worker aged 55–64 who has been recognised with Incapacidad Permanente Total wishes to apply for the IPT cualificada (enhanced rate of 75% instead of 55%) on the basis of age, insufficient alternative employment prospects, and the nature of their habitual occupation — a determination that also requires INSS assessment.

The solicitud is needed when the INSS initiates the permanent disability procedure automatically at month 18 of continuous incapacidad temporal — the worker's active participation in the procedure, through timely submission of medical reports (informes médicos), surgical records, diagnostic tests, and a detailed description of functional limitations, is essential to obtaining the correct disability recognition.

Under Spanish law, the Constitución Española 1978 is the supreme law. The Código Civil governs contractual obligations under Article 1255 (libertad de pactos). The AEAT administers taxation. The Juzgados de Primera Instancia have general civil jurisdiction. The Ley 39/2015 governs administrative procedure. The LOPDGDD (LO 3/2018) and RGPD govern data protection through the Agencia Española de Protección de Datos (AEPD).

What to Include in Your Disability Pension Application Spain (Solicitud de Pensión de Incapacidad Permanente)

A valid Disability Pension Application Spain under LGSS Article 195 must contain the following essential elements to be processed by the INSS and its Equipo de Valoración de Incapacidades (EVI).

Applicant Identification: Full name, DNI or NIE, Número de Afiliación a la Seguridad Social (NASS) assigned by the TGSS, date of birth, current residential address, telephone, and email. The NASS is essential — it links the applicant's contribution history in the TGSS's Fichero General de Afiliación to the disability assessment procedure.

Occupational History: Description of the applicant's habitual occupation (profesión habitual) as defined by LGSS Article 194 — the work performed in the 12 months prior to the disabling event, or the last stable occupation if the worker was unemployed at the time of the disabling event. The professional group (grupo de cotización) under the applicable social security contribution category (grupos 1–11 under Real Decreto 2064/1995) determines the regulatory base calculation and the IPT assessment (whether the worker can perform any other occupation within their professional qualification level).

Medical Evidence: Thorough medical documentation of the condition causing the disability, including: specialist medical reports (informes médicos de especialistas — traumatólogo, cardiólogo, oncólogo, neurólogo, psiquiatra, etc.) describing the diagnosis, treatment received, treatment outcome, current functional status, and medical prognosis; hospital discharge reports (informes de alta hospitalaria) for any relevant hospitalisations; diagnostic test results (TAC, resonancia magnética, electromiografía, espirometría, etc.); and the Informe Médico de Síntesis from the worker's treating doctor (médico de cabecera or médico especialista del Sistema Nacional de Salud — SNS) summarising the overall functional impact of the condition.

Incapacidad Temporal History: Documentation of the prior incapacidad temporal (IT) process — the IT declaration (parte de baja) and evolution reports (partes de confirmación de baja) from the mutua or INSS, confirming the diagnosis code (CIE-10 code), start date of IT, and duration. The IT history establishes the causative link between the medical condition and the work absence, which is essential for the EVI assessment.

Functional Limitations Description: A detailed written description by the applicant (or their doctor) of the specific functional limitations — physical movements impaired, activities of daily life affected, working postures that cannot be maintained, cognitive or psychological limitations, and how these limitations prevent performance of the habitual occupation or, for IPA/GI applications, all professional activity.

Bank Account: IBAN of the bank account for pension payment. The account must be held with a Spanish financial institution (entidad de crédito registrada en el Banco de España) and the applicant must be the account holder or a joint holder.

Application Form: Completed INSS Solicitud de Incapacidad Permanente (Modelo IP/1), available from any CAISS (Centro de Atención e Información de la Seguridad Social) or downloadable from the INSS website (www.seg-social.es). Electronic submission is available through the INSS Sede Electrónica (sede.seg-social.gob.es) with a certificado digital or Cl@ve.

Forms-legal.com provides this Disability Pension Application Spain template as a practical starting point. INSS disability assessments are complex medical-legal procedures — the EVI's decision frequently hinges on the quality and completeness of the medical evidence presented. Workers are strongly advised to prepare a thorough and well-organised medical dossier with the assistance of their treating specialists and, where possible, an abogado especialista en Seguridad Social or a sindical asesor de prestaciones before submitting the application.
