What Is a Retirement Pension Application Spain (Solicitud de Pensión de Jubilación)?

A Retirement Pension Application Spain (Solicitud de Pensión de Jubilación) is a formal administrative petition submitted to the Instituto Nacional de la Seguridad Social (INSS) by a worker approaching or having reached the statutory retirement age, requesting recognition of their entitlement to the pensión de jubilación — a monthly contributory social security benefit replacing employment income upon cessation of work due to age. The primary statutory framework is the Ley General de la Seguridad Social (LGSS — Real Decreto Legislativo 8/2015, de 30 de octubre), Articles 204–213, which define the retirement pension eligibility conditions, benefit calculation, early retirement provisions, and compatibility with employment.

Spain's pensión de jubilación is a contributory social insurance benefit within the Régimen General de la Seguridad Social (and equivalent special regimes — RETA for autónomos, SETA for sea workers, and others), financed through employers' and employees' social security contributions (cotizaciones sociales) to the Tesorería General de la Seguridad Social (TGSS) throughout their working lives. The pensión de jubilación is Spain's largest social expenditure item — approximately 9.5 million pensioners receive a jubilación pension, representing approximately 60% of total INSS pension expenditure, financed through the intergenerational solidarity principle established in the Constitución Española 1978 Article 50.

Forced early retirement (jubilación anticipada forzosa) is permitted from 60 years for workers displaced by involuntary unemployment, collective redundancy, or company closure under Article 207 LGSS with less severe reduction coefficients.

The minimum contribution period (período mínimo de cotización) for the ordinary retirement pension is 15 years (5,475 days), of which at least 2 years must have been contributed within the 15 years immediately preceding the retirement date, under Article 205.1 LGSS. Workers with less than 15 years of contributions are not entitled to a contributory jubilación pension — they may be entitled to a non-contributory jubilación pension (pensión no contributiva de jubilación) under Articles 369–372 LGSS if they meet the means-tested eligibility conditions.

The pension reform of 2021–2023 (primarily through Ley 21/2021 de garantía del poder adquisitivo de las pensiones — the so-called 'pensiones reform' implementing the recommendations of the 2020 Toledo Pact renewal) introduced annual pension reindexation linked to CPI (Índice de Precios al Consumo) to preserve the purchasing power of pensions, replacing the sustainability factor (factor de sostenibilidad) previously introduced by the PP government in 2013 but never actually applied. When Do You Need a Retirement Pension Application Spain (Solicitud de Pensión de Jubilación)?

A Retirement Pension Application Spain is required when a worker approaches or reaches the ordinary retirement age or the applicable early retirement age and wishes to cease work and begin receiving their monthly pensión de jubilación from the INSS.

The application is needed when a worker reaches the ordinary retirement age (65 years with 38+ years of contributions, or 65 years and 10 months with less, increasing gradually toward 67 by 2027) and has accumulated at least 15 years of social security contributions — the minimum required by Article 205.1 LGSS.

The solicitud is required for early retirement (jubilación anticipada) at age 63 (or 2 years before ordinary retirement age from 2027) for workers who choose to retire voluntarily before the ordinary retirement age — accepting the reduction coefficients applied to the pension percentage for each month of early retirement under Article 208 LGSS.

The application is needed for involuntary early retirement (jubilación anticipada forzosa) under Article 207 LGSS for workers aged 60–64 (4 years before ordinary retirement age) who have been made redundant through collective dismissal (despido colectivo), company dissolution, or force majeure — who receive less severe reduction coefficients than voluntary early retirees.

A new or modified pension application is needed when a pensioner who has taken partial retirement (jubilación parcial) under Article 215 LGSS — working reduced hours alongside a replacement worker (contrato de relevo) — subsequently reaches full retirement age and wishes to transition to full retirement with the corresponding full pension.

The application is required for the deferred retirement bonus (pensión incrementada por jubilación tardía) under Article 210 LGSS — workers who continue working beyond ordinary retirement age are entitled to a bonus of 4%–4% per year worked after retirement age (depending on total years of contribution), increasing the pension percentage above 100%.

The solicitud must be submitted at least 3 months before the intended retirement date to allow the INSS sufficient processing time — the INSS formally recommends applying 90 days in advance under its pension application guidance, as retroactive pension payments (retroactividad) are limited to 3 months before the application date under Article 53 LGSS.

For Forced Early Retirement (Article 207): Proof of involuntary employment cessation — the redundancy notice (carta de despido), ERE (Expediente de Regulación de Empleo) resolution, or certificate of company dissolution, establishing that the worker's retirement was triggered by circumstances beyond their control.

Civil Status (for Minimum Pension Supplement): Where the applicant may be entitled to the complemento por mínimos (minimum pension supplement to bring the pension up to the statutory minimum) — their family situation affects the supplement amount. A single person receives a different minimum than a person with a dependent spouse. Marriage certificate (certificado de matrimonio) or registered partnership certificate (certificado de pareja de hecho) from the Registro Civil is required.

Bank Account Details: IBAN of the applicant's Spanish bank account for pension direct debit (domiciliación del pago de la pensión). The account must be held with a financial institution registered with the Banco de España.
