What Is a Freedom of Information Request Spain (Solicitud de Acceso a Información Pública)?

A Freedom of Information Request Spain (Solicitud de Acceso a Información Pública) is the formal request submitted by any natural or legal person to a public authority (administración pública) under Article 17 of Ley 19/2013, de 9 de diciembre, de transparencia, acceso a la información pública y buen gobierno (LTAIBG — Ley de Transparencia), asserting the constitutional right to access information in the possession or custody of the public sector, which is recognised as a fundamental right in the constitutional framework under Article 20.1(d) of the Constitución Española 1978 and confirmed as a statutory right by the LTAIBG.

Spain enacted the LTAIBG in 2013 after being one of the last major EU member states to enact freedom of information legislation. The law covers all branches and levels of the Spanish public sector — the Administración General del Estado (central government), autonomous communities (comunidades autónomas), local entities (entidades locales), public universities, public corporations (organismos públicos), public law entities, and certain private entities receiving public funds exceeding 100,000 euros annually or deriving more than 75% of their income from public sources (Article 3 LTAIBG).

Article 12 LTAIBG establishes the right of access to public information (derecho de acceso a la información pública) for all persons without needing to state a reason or have a specific interest — Spain adopts the 'no reason required' (sin necesidad de motivación) model for access requests. Any natural or legal person, whether Spanish or foreign, may submit a request regardless of nationality or residency.

The Consejo de Transparencia y Buen Gobierno (CTBG), established by Article 33 LTAIBG, is the independent supervisory body for the central government. The CTBG processes reclamaciones (administrative complaints) against decisions by central government bodies to refuse or restrict access. Autonomous communities have established their own transparency bodies — Comisión de Garantía del Derecho de Acceso (CGDA) in Catalonia, Consejo de Transparencia de Andalucía, Comisionado de Transparencia de Canarias — with competence over their respective administrations.

Article 17.2 LTAIBG requires that requests be submitted to the competent authority, identifying the information requested with sufficient precision. The authority has 20 business days (días hábiles) from receipt to respond under Article 20.1 LTAIBG. When Do You Need a Freedom of Information Request Spain (Solicitud de Acceso a Información Pública)?

A Freedom of Information Request Spain is needed when any person — citizen, journalist, researcher, NGO, or business — wishes to obtain information held by a Spanish public body that is not already published on the authority's transparency portal (portal de transparencia) under the active disclosure (publicidad activa) obligations of Articles 5 through 11 LTAIBG.

The request is required when a journalist or investigative organisation investigates public spending, contracting, or administrative conduct — the LTAIBG gives media outlets and civil society organisations the same access rights as individual citizens, with no special status or priority. Requests by investigative journalists have uncovered significant public interest information including government contract awards, travel expenses, and lobbying contacts.

A Solicitud de Acceso a Información Pública is needed when a business or contractor wishes to access information about procurement decisions (decisiones de contratación pública) under the Ley 9/2017, de 8 de noviembre, de Contratos del Sector Público (LCSP) — for example, to understand why a bid was unsuccessful, to examine evaluation criteria, or to review competitor bids subject to commercial confidentiality limitations.

The request is needed when a citizen seeks access to environmental information held by public authorities — although environmental information in Spain is additionally covered by Ley 27/2006, de 18 de julio, por la que se regulan los derechos de acceso a la información, de participación pública y de acceso a la justicia en materia de medio ambiente (which implements the Aarhus Convention), which provides additional procedural rights for environmental information requests.

The description should identify the subject matter, relevant time period, document type (informes, contratos, actas, comunicaciones), and any reference numbers known.

Preferred Format: The preferred format for receiving the information — electronic document (PDF, XLS, CSV), paper copy, or inspection at the authority's offices. Article 22.2 LTAIBG requires the authority to provide information in the requested format where technically and reasonably feasible.

Optional Motivation: Although not required under Article 17 LTAIBG (no reason is needed), providing a brief explanation of the public interest or personal interest in the information can help the authority assess exemptions — particularly for requests involving personal data or commercial confidentiality where the authority must balance competing interests under Articles 14 and 15 LTAIBG.
