5. CANCELACIÓN Y FUERZA MAYOR / CANCELLATION AND FORCE MAJEURE

Fuerza mayor / Force Majeure: Cualquiera de las partes queda exonerada del cumplimiento si el evento no puede celebrarse por circunstancias ajenas a su control razonable —entre ellas restricciones oficiales impuestas por las autoridades públicas, catástrofes naturales o emergencias de salud pública— conforme al artículo 1105 del Código Civil. En caso de fuerza mayor, las partes negociarán de buena fe para aplazar el evento. Los importes previamente abonados se imputarán al evento aplazado.

6. SEGURIDAD ALIMENTARIA Y RESPONSABILIDAD / FOOD SAFETY AND LIABILITY

La empresa de catering se compromete a cumplir: (a) los procedimientos APPCC (Análisis de Peligros y Puntos de Control Críticos) conforme al Reglamento (CE) 852/2004; (b) las normas de higiene para alimentos elaborados del Real Decreto 3484/2000; (c) los requisitos de cadena de frío y control de temperatura durante la preparación, el transporte y el servicio de alimentos; y (d) los requisitos de supervisión en materia de seguridad alimentaria de la Agencia Española de Seguridad Alimentaria y Nutrición (AESAN).

La empresa de catering dispone de seguro de responsabilidad civil que cubre reclamaciones por intoxicación alimentaria, daños materiales en el lugar del evento y accidentes causados por el personal. La responsabilidad objetiva por alimentos defectuosos conforme a los artículos 135 a 149 del Real Decreto Legislativo 1/2007 (TRLGDCU) corresponde a la empresa de catering como productora y distribuidora de alimentos.

7. LEGISLACIÓN APLICABLE Y JURISDICCIÓN / GOVERNING LAW AND JURISDICTION

Este contrato se rige por el Derecho español, principalmente el Código Civil (artículo 1544 y ss.), la Ley 17/2011 de Seguridad Alimentaria y Nutrición y el Reglamento (CE) 852/2004. Los litigios se resolverán ante el Juzgado de Primera Instancia del lugar del evento o del domicilio social de la empresa de catering, a elección del cliente.
