What Is a Domestic Violence Protection Order (Medida de Protección VIF) Colombia?

The Solicitud de Medida de Protección por Violencia Intrafamiliar (Domestic Violence Protection Order Petition) in Colombia is the legal mechanism established primarily by Ley 294 de 1996 — modified and complemented by Ley 575 de 2000, Ley 1257 de 2008, and Decreto 4799 de 2011 — through which any family member who is a victim of physical, psychological, economic, or sexual violence may appear before the Comisaria de Familia of the municipality or the competent Juzgado Civil Municipal to request immediate protective measures that stop the violent conduct and prevent its recurrence.

Article 1 of Ley 294 de 1996 establishes the fundamental objective of preventing, remedying, and sanctioning violencia intrafamiliar (VIF, domestic violence), defined as any physical, psychological, or sexual harm, threat, grievance, offence, or any form of aggression by one family member against another. Article 2 of the same law defines the family broadly for protection purposes: spouse or permanent partner (compañero/a permanente), parents and children, siblings, grandparents, grandchildren, in-laws, siblings-in-law, and any person who permanently lives under the same roof.

Ley 1257 de 2008 — the landmark law on awareness, prevention, and punishment of violence and discrimination against women — significantly expanded the scope of protection by including economic violence as a form of violence against women (Article 3), establishing priority care measures for female victims in healthcare institutions, and requiring employers to adopt employment protection measures for worker victims of VIF. Article 16 of Ley 1257 de 2008 created the obligation of territorial entities to guarantee shelters and refuges for victims.

The Comisaria de Familia — an administrative entity of the national family welfare system established by Article 83 of the Codigo de la Infancia y la Adolescencia (Ley 1098 de 2006) — is the administrative authority competent to hear domestic violence protection order petitions at first instance in all municipalities. The Comisario/a de Familia is empowered to issue provisional immediate protective measures (Article 17, Ley 294/1996) when the victim faces risk of imminent violence, without prior summons to the aggressor. The conciliation hearing and ruling must be held within four business days of filing (Article 14, Ley 294/1996 as amended by Ley 575/2000).

Protective measures available under Article 5 of Ley 294 de 1996 include: ordering the aggressor to vacate the family home; prohibiting the aggressor from approaching the victim anywhere; suspending the aggressor's possession, carrying, and use of firearms; ordering the aggressor to attend a therapeutic or family orientation programme; ordering protective measures for minor children in coordination with the ICBF; prohibiting the aggressor from disposing of or encumbering family assets; and ordering the victim's reinstatement to the home when expelled by the aggressor.

Violation of protective measures is punishable by arrest of one to thirty days and a fine of one to ten monthly minimum wages (SMLMV) under Article 7 of Ley 294 de 1996. If the violent conduct constitutes a criminal offence — personal injury (Article 111, Codigo Penal), domestic violence (Article 229, Codigo Penal), or sexual assault (Article 212, Codigo Penal) — the Comisario/a must refer the matter to the Fiscalia General de la Nacion for parallel criminal investigation, without prejudice to the administrative protective measures.

When Do You Need a Domestic Violence Protection Order (Medida de Protección VIF) Colombia?

The Solicitud de Medida de Proteccion por Violencia Intrafamiliar is required in Colombia when a family member is a victim of any form of violence by another member of the family unit and requires immediate State protection under Ley 294 de 1996 and Ley 1257 de 2008.

Victims of physical domestic violence — blows, pushes, slaps, kicks, burns, injuries with objects, or any act causing bodily harm — should file the petition with the Comisaria de Familia immediately after the incident. Victims of sexual violence within marriage or cohabitation — including non-consensual sexual intercourse between spouses, which was classified as a criminal offence under Article 212 of the Codigo Penal per Sentencia C-285/1997 — file simultaneously with the Comisaria de Familia and the Fiscalia General de la Nacion.

Parents who witness violence between their partners and fear for the safety of their minor children file the petition to obtain protective measures that include the children, in coordination with the ICBF under Ley 1098 de 2006.

Victims with existing protection orders that have been violated file a new petition documenting non-compliance so the Comisario/a applies the arrest and fine sanctions under Article 7 of Ley 294 de 1996.

Article 13 of Ley 294 de 1996 allows the petition to be filed orally when the victim cannot prepare a written document.
