What Is a Emergency Custody Application Colombia?

The Emergency Custody Application Colombia (Solicitud de Custodia de Emergencia) is the urgent written request that a parent, grandparent, other relative, or any concerned adult files with a Defensor de Familia of the Instituto Colombiano de Bienestar Familiar (ICBF) or a Comisario de Familia to obtain immediate temporary custody of a minor child who faces a serious, imminent threat to their physical or psychological integrity. Colombian law confers on Defensores de Familia broad protective powers under Ley 1098 de 2006 (Código de la Infancia y la Adolescencia — CIA) to intervene rapidly when a child is at risk, without requiring the delay of a full judicial proceeding before a Juez de Familia.

Ley 1098 de 2006, promulgated on November 8, 2006, and in force since its publication in Diario Oficial No. 46.446, establishes in Article 7 the principle of interés superior del niño (best interest of the child) as the governing criterion for all decisions affecting minors in Colombia — whether administrative or judicial. Article 50 of Ley 1098 empowers the Defensor de Familia to declare a child in a state of abandonment or danger (estado de peligro o de abandono) and to adopt emergency protective measures (medidas de protección) within 24 hours of a verified risk, including: (a) placing the child with a family member capable of providing care; (b) placing the child with a foster family (familia de acogida) registered with the ICBF; or (c) placing the child in an ICBF-certified institution (hogar sustituto or centro de emergencia) if no suitable family placement is available.

Comisarías de Familia — municipal-level family protection offices established under Ley 575 de 2000 and regulated by Decreto 4840 de 2007 — share concurrent jurisdiction with ICBF Defensores de Familia over emergency child protection matters. A Comisario de Familia may issue medidas de protección under Ley 294 de 1996 and its reform Ley 575 de 2000 when violence within the family unit (violencia intrafamiliar) endangers the child. Article 5 of Ley 294 de 1996 establishes specific protective measures including the removal of the aggressor from the family home (desalojo del agresor) and provisional custody to a non-offending parent or guardian.

The Sistema Nacional de Bienestar Familiar (SNBF) — coordinated by the ICBF under Ley 7 de 1979 as modified by Ley 1098 de 2006 — integrates the ICBF, Comisarías de Familia, Personerías Municipales, and Policía Nacional (through the Policía de Infancia y Adolescencia) in responding to child emergencies. Any of these entities may receive an emergency custody request and are mandated by Article 51 of Ley 1098 to act immediately upon verified risk to a minor.

The emergency custody order issued by the Defensor de Familia is provisional and must be ratified by a Juez de Familia within 30 days, or converted into a formal custody judgment (sentencia de custodia) through civil family court proceedings under the Código General del Proceso (Ley 1564 de 2012). Article 119 of Ley 1098 de 2006 grants Jueces de Familia primary jurisdiction over custody disputes (regulación de custodia) as permanent judicial decisions.

When Do You Need a Emergency Custody Application Colombia?

The Emergency Custody Application Colombia must be filed immediately in the following circumstances governed by Ley 1098 de 2006 and Ley 294 de 1996.

Physical Abuse or Violence: When a child has suffered or is at imminent risk of physical abuse (maltrato físico) — including beating, burning, or other physical violence — by a parent, step-parent, household member, or caregiver. Under Article 18 of Ley 1098 de 2006, every child has the right to protection from all forms of physical and psychological mistreatment. The Defensor de Familia may adopt emergency protective measures within 24 hours of notification.

Sexual Abuse: When there is credible evidence or reasonable suspicion of sexual abuse (abuso sexual) of the minor by any person. Article 20 of Ley 1098 de 2006 places sexual abuse on the list of the most serious threats to children's rights requiring immediate intervention. Reports may also be made simultaneously to the Fiscalía General de la Nación under Article 206A of the Código Penal.

Domestic Violence Endangering the Child: When violent episodes within the family home (violencia intrafamiliar) — defined by Article 229 of the Código Penal — place the child at risk, even if the child is not the direct victim of the violence. A Comisario de Familia may issue an emergency protection measure under Ley 294 de 1996 removing the aggressor from the home and awarding temporary custody to the non-offending parent.

Abandonment or Neglect: When both parents or the sole custodial parent have abandoned the child (abandono), left the child without adequate supervision for an extended period, or failed to provide basic necessities (food, healthcare, shelter) — triggering the state of abandonment provisions in Articles 52–57 of Ley 1098 de 2006.

Substance Abuse or Mental Health Crisis: When the custodial parent or primary caregiver is incapacitated due to substance abuse (consumo de sustancias psicoactivas), a mental health crisis, or a physical medical emergency, leaving the child without responsible care — conditions that warrant an emergency protective placement under Article 50 of Ley 1098.

Parties in Colombia should prepare a Emergency Custody Application Colombia proactively rather than waiting for a dispute to arise. Courts interpret agreements based on the written terms rather than oral representations. Under Colombian law, the Codigo Civil governs marriage, divorce, custody, and maintenance. The Ley 1098 de 2006 (Codigo de la Infancia y la Adolescencia) protects minors through the ICBF (Instituto Colombiano de Bienestar Familiar). The Ley 640 de 2001 governs conciliation. The Registraduria Nacional del Estado Civil records births, marriages, and deaths. The Defensoria del Pueblo protects fundamental rights. Where the transaction involves regulated activities, prior approval from the relevant authority may be required before execution.

What to Include in Your Emergency Custody Application Colombia

A complete Emergency Custody Application Colombia under Ley 1098 de 2006 must include the following essential elements for the Defensor de Familia or Comisario de Familia to act immediately.

Identification of the Minor Child: Full legal name; date of birth; registro civil de nacimiento number; current residence address; school name and grade (if applicable); and any known medical or psychological conditions that affect the child's care needs.

Identification of the Petitioner: Full name; cédula de ciudadanía number; relationship to the child (parent, grandparent, sibling, aunt/uncle, or other responsible adult); contact phone and address; and any existing legal relationship — custody order, guardianship, or kinship placement — already in force.

Description of the Emergency Risk: A detailed, factual account of the specific threat to the child's safety — including dates, locations, descriptions of incidents, names of perpetrators, and any witnesses. The description should identify the type of risk: physical abuse (maltrato físico), sexual abuse (abuso sexual), psychological abuse (maltrato psicológico), neglect (negligencia), abandonment (abandono), domestic violence (violencia intrafamiliar), or exposure to criminal activity, referencing the specific Articles of Ley 1098 de 2006 that are engaged.

Evidence Supporting the Risk Claim: Medical certificates (certificados médicos) documenting injuries; photographs of injuries; police reports (denuncias ante la Policía Nacional or Fiscalía); school attendance records showing unexplained absences; sworn statements from neighbors or relatives; and any prior ICBF or Comisaría de Familia intervention records.

Proposed Emergency Custodian: The petitioner's proposed person or household to receive temporary custody — with their cédula de ciudadanía, address, relationship to the child, and a brief statement of their capacity and willingness to care for the child during the emergency period. Under Article 50 of Ley 1098, the Defensor de Familia prioritizes family placements over institutional placements.

Request for Specific Protective Measures: The petitioner should explicitly request the measures sought — for example: (a) temporary custody to the petitioner; (b) removal of the aggressor from the family home; (c) a restraining order (medida de alejamiento) under Ley 294 de 1996; (d) suspension of visitation rights for the alleged abuser pending investigation; and (e) referral to the Fiscalía for criminal investigation.

Request for Expedited Medical or Psychological Evaluation: Under Article 79 of Ley 1098 de 2006, the petitioner may request that the ICBF arrange an immediate medical and psychological evaluation of the child by an ICBF-appointed forensic specialist (perito forense) to document the harm and support legal proceedings.
